Retaliating against a consumer for disputing inaccurate information on their credit report could violate FCRA. \n\nThese laws, among others, provide protections for consumers against retaliation for exercising their rights. \n\nI would like to point out that my CFPB complaint about this issue isnt closed yet, they served me on the XXXX giving me 20 days to respond, which potentially wouldnt give the CFPB complaint enough time to close to give me all of the evidence i need for a proper defense.i find this practice to be extremely deceptive. \n\nI have also attached an article posted on your website referring to a case where the CFPB has sued a debt collector and their owners for abusive practices, and I would like for you to do the same here. I am a XXXX veteran and I do not need undue stress, as all I was doing when this started was checking my consumer report to clean up my credit, found inaccuracies therefore leaving me unable to find the true accuracy of these accounts, filed a CFPB complaint about these inaccuracies which is my right to do so, and 27 days later am now being sued for exercising my consumer rights. Let the record state that LVNV Funding, XXXX, XXXX, and XXXX broke federal law, all i simply did was point that out and am now having legal action taken against me because of it. I demand LVNV Funding drop this lawsuit immediately as it is illegal retaliation against a consumer for exercising their consumer rights. I am also requesting that the CFPB take legal action against LVNV Funding for doing the same things listed in the article i have attached. In addition, the complaint alleges that Experian committed unfair acts or practices in violation of the Consumer Financial Protection Act of 2010 by ( 1 ) failing to convey consumers disputes to furnishers fully and accurately, and instead distorting, truncating, and mischaracterizing consumers disputes ; ( 2 ) relying excessively on furnishers to resolve disputes, routinely doing nothing more than sending the dispute to a furnisher and implementing the furnishers response, despite having evidence of that furnishers unreliability ; On XX/XX/XXXX I filed my own CFPB report to Experian for violations and illegal behavior under the FCRA with directives the inaccurate and unlawful information Experian has been reporting on my credit report. And exactly how the CFPB has alleged that Experian has failed to act and properly conduct their investigations correctly I am now a victim of this directly. Experian has failed to uphold the law, and if Experian fails to correct it's unlawful behavior I will be filing a pre-lawsuit and taking necessary steps legally to correct these inaccuracies and illegal behavior. \n\nI will provide here the inaccuracies and unlawful reporting on my credit report per individual law. \n\nUnder the definition provided in 15 U.S.C. 6809, a furnisher of information to credit agencies qualifies as a financial institution. According to 15 U.S.C. 1681, Section 604 ( a ) ( 2 ), it is explicitly stated that : \" In general, subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' As a financial institution, the furnisher of information to Experian, along with Experian itself, does not have my permission to furnish, collect, store, or distribute my consumer information. Furthermore, Experian does not have my written consent to do so. Therefore, I hereby revoke any and all consentwhether verbal, non-verbal, written, implied, or otherwisepreviously given to Experian or any furnisher of information reporting to Experian regarding the collection, use, or dissemination of my personal and financial data.\n\nAdditionally, under 15 U.S.C. 6802 ( b ) - ( c ), it is required that : \" A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is provided with a clear explanation of how they can opt out of such disclosure. '' At no point was I informed by Experian or any furnisher of information of my right to opt out of such disclosure, which is a direct violation of this statutory requirement. Given Experian 's failure to provide proper notice and obtain my explicit authorization, I demand the immediate cessation of any further collection, reporting, or distribution of my consumer information.\n\nAdditionally, 15 USC 1681c ( a ) ( 5 ) clearly states that 'Except as authorized under subsection ( b ), no consumer reporting agency may include in any consumer report any adverse information, other than records of convictions of crimes, which antedates the report by more than seven years. ' The account in question is an adverse item that is being reported without my permission, which is a clear violation of this statute. The continued reporting of this information is not only unauthorized but also illegal under federal law. According to 15 U.S. Code 1681a ( 2 ) Exclusions ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; This clearly states that any credit report containing my transaction history is illegal. Which Experian are in violation of.\n\nAdditionally, 15 U.S.C. 1681c ( a ) ( 5 ) explicitly states : \" Except as authorized under subsection ( b ), no consumer reporting agency may include in any consumer report any adverse information, other than records of convictions of crimes, which antedates the report by more than seven years. '' The adverse accounts in question are being reported by Experian beyond the legally permissible timeframe and without my explicit consent, which constitutes a clear violation of this statute. The continued inclusion of this outdated and unauthorized information in my consumer report is not only improper but also illegal under federal law.\n\nFurthermore, 15 U.S.C. 1681a ( 2 ) ( A ) ( i ) states : \" Report containing information solely as to transactions or experiences between the consumer and the person making the report. '' This provision makes it clear that any credit report containing my personal transaction history is illegal. By continuing to collect, store, and distribute this information without my consent, Experian is in direct violation of this statutory exclusion.\n\nGiven these clear legal violations, I demand the immediate removal of this adverse information from my credit report and an official confirmation of compliance.\n\nAccording to 15 U.S. Code 1681s-2 ( a ) ( 1 ) ( A ) : \" A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. '' Additionally, 15 U.S. Code 1681e mandates : \" Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' Experian has failed to uphold these legal requirements by not implementing or maintaining reasonable procedures to prevent the dissemination of inaccurate information within my credit report. Their failure to ensure accuracy has resulted in direct harm to me.\n\nFurthermore, under 15 U.S. Code 1681n - Civil Liability for Willful Noncompliance, the law states : \" Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00}. '' Given that Experian has willfully violated federal law, I am entitled to full compensation for damages under 15 U.S. Code 1681n. This includes actual damages I have incurred as a result of Experian 's noncompliance, as well as statutory damages up to {$1000.00} per violation.\n\nI demand an immediate resolution, including the removal of any inaccurate, outdated, or improperly furnished information from my credit report and compensation for the damages I have sustained due to Experians willful violations of federal law.\n\nFurthermore, under 12 CFR 1016.7, it is clearly stated : \" A consumer may exercise the right to opt out at any time. '' Therefore, I am formally opting out of Experians reporting services, as is my right under federal law. I hereby revoke any and all consentwhether verbal, non-verbal, written, implied, or otherwisepreviously given to Experian regarding the collection, storage, reporting, or dissemination of my consumer data.\n\nAdditionally, 15 U.S.C. 6805 establishes the Consumer Financial Protection Bureau ( CFPB ) as the proper agency to enforce my rights, stating : \" Under subtitle E of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5561 et seq. ], by the Bureau of Consumer Financial Protection, in the case of any financial institution and other covered person or service provider that is subject to the jurisdiction of the Bureau and any person subject to this subchapter, but not with respect to the standards under section 6801 of this title. '' As Experian is subject to CFPB enforcement, I respectfully request that the CFPB enforce my rights and require Experian to fully comply with my opt-out request, remove my consumer information, and cease all unauthorized reporting.\n\nFurthermore, I demand that Experian be held accountable for violations of my rights, and I request that all applicable remedies and corrective actions be granted as outlined in the Fair Resolution page of this complaint.\n\nThank you. \n\nXXXX","date_sent_to_company":"2025-01-30T03:41:34.000Z","issue":"Improper use of your report","sub_product":"Credit reporting","zip_code":"20814","tags":null,"has_narrative":true,"complaint_id":"11842812","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Experian Information Solutions Inc.","date_received":"2025-01-30T03:15:41.000Z","state":"MD","company_public_response":"Company has responded to the consumer and the CFPB and chooses not to provide a public response","sub_issue":"Reporting company used your report improperly"},"highlight":{"complaint_what_happened":["The continued inclusion of this outdated and unauthorized information in my consumer report is not only improper but also illegal under federal law.\n\nFurthermore, 15 U.S.C. 1681a ( 2 ) ( A ) ( i ) states : \" Report containing information solely as to transactions or experiences between the consumer and the person making the report. Of the many fraudulent activities that occurred with the illegal and improper use of my identity, 2 of my 3 USAA credit cards were compromised and used without my permission or knowledge. Upon learning my cards had been compromised I immediately notified USAA and the USAA CreditCheck & ID Monitoring service for which I paid a monthly fee. A case was opened and at first, it seemed USAA was being only slightly negligent. The credit monitoring service for which I paid actually offered little to no real help. I had to contact the bank directly myself repeatedly as they failed to credit the fraudulent charges back to me repeatedly. Each time their agents opened up a new fraud case for the same incident. It took about 6 months for USAA to finally fix and credit my accounts back for the fraudulent charges. While frustrating at times, I believed the identity theft was behind me. \nAbout a year after all investigations and credits to my account connected with the identity theft were finalized and the case was closed, without notice, USAA rebilled me for all the fraudulent charges. The rebilled items were only indicated by a label of security adjustment. Upon contacting USAA regarding these unknown charges, the USAA agent said they must be a fraud and opened a new fraud case. Two days later, in violation of the military lending act, I was restricted from accessing my accounts, online or otherwise. My Debit and Credit cards stopped working and all ACH transactions were returned. As I was set up for USAA paperless billing and online contact, I immediately requested USAA to begin physically mailing all paperwork to me. In further violation of MLA and FCRA laws, USAA failed to provide or make accessible to me any of my account statements, disclosure, or required documents. The only notifications I would receive for the next few years were emails informing me I had a letter waiting for me on USAA.com. However, I was prevented from viewing or accessing said notices by the restriction USAA placed on my online access. In further violation of FCRA, regulation Z, and MLA statutes USAA began and continues to furnish negative information to the Credit Reporting Agencies. The negative information being furnished to several CRAs is a direct result of USAA reversing their final decision a year after previously making a final decision in my favor and crediting my accounts for unauthorized charges reported. I have made repeated disputes with the CRAs regarding this negative data due to identity theft, which USAA has failed to provide any documentation of the results of their investigation or acknowledgment of my dispute. The only letter I received was in response to my complaint to the OCC, in which they state they are unable to hold me accountable a year after finalizing the fraud case. However, they failed to cease reporting the negative information or correct any of their illegal actions. I made hundreds of attempts to contact USAA via phone regarding this over the phone. Each time I was instructed I needed to speak to XXXX. I left over 200 voicemails for XXXX and her manager over the years. I have still yet to receive a single phone call in return. I have also filed numerous CFPB complaints such as but not limited to XXXX XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX to figure out what happened. The only response I have received from USAA regarding these issues in writing has been that USAA has decided to no longer pursue business with me but fails to explain as legally required. \nI worked a lifetime to establish my top tier credit rating and had always paid my bills on time. These massive violations by USAA have had extreme and long-lasting ramifications, barring me from access to any favorable or terms of credit at all. This includes preventing me from refinancing my sole remaining auto loan with another institution, purchasing a home, new vehicle, or opening any subsequent lines of credit with favorable terms. I have requested documentation on my accounts from USAA, especially for my auto loan which remained open. I especially needed the loan docs as USAA failed to provide any origination loan docs, account ledgers, or notice of any fees to negative actions they were, did, and have taken. This is especially crucial as upon freezing my accounts USAA refused to accept payments from external accounts. This prevented me from paying my auto loan and sending it into default and eventual repossession. I never got any notices of any of these actions or notices of fees added. I was simply told they would be credited over the phone for their errors. The only document USAA began to provide was my monthly consumer auto loan statement. This statement, however, fails to comply with the requirements set forth by the MLA and FCBPA. I have never been provided an account ledger for this or any of my accounts, representing a failure of USAA to validate the accounts in dispute they have been reporting negatively to the CRAs. \nIt has come to my attention this type of illegal and predatory lending practices are common at USAA, as have lost several large lawsuits. While the Office of the Comptroller of the Currency lowered USAA Banks overall Community Reinvestment Act performance evaluation rating from satisfactory to needs to improve after uncovering evidence of 600 violations involving customers. Furthermore, The Consumer Protections Bureau found that USAA violated the Electronic Fund Transfer Act and Regulation E by failing to properly honor consumers stop payment requests on preauthorized electronic fund transfers, and by failing to initiate and complete reasonable error resolution investigations. USAA also violated the Consumer Financial Protection Act of 2010 by reopening deposit accounts consumers had previously closed without seeking prior authorization or providing adequate notice. I am just another example of their willful noncompliance with federal, state, and government statutes.","date_sent_to_company":"2020-10-07T21:18:52.000Z","issue":"Problem with a credit reporting company's investigation into an existing problem","sub_product":"Credit reporting","zip_code":"78723","tags":"Servicemember","has_narrative":true,"complaint_id":"3886570","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"UNITED SERVICES AUTOMOBILE ASSOCIATION","date_received":"2020-10-07T20:53:17.000Z","state":"TX","company_public_response":"Company believes it acted appropriately as authorized by contract or law","sub_issue":"Their investigation did not fix an error on your report"},"highlight":{"complaint_what_happened":["In further violation of FCRA, regulation Z, and MLA statutes USAA began and continues to furnish negative information to the Credit Reporting Agencies. This program, intended to provide safe and reliable access to critical federal benefits for millions of unbanked Americansprimarily elderly, disabled, and low-income individualshas instead become a source of profound hardship, financial vulnerability, and outright harm due to persistent, systemic operational failures.\n\nThousands of cardholders, as documented across the CFPB 's Consumer Complaint Database, XXXX ( average rating XXXX from thousands of verified reviews as of XX/XX/XXXX ), XXXX XXXX XXXX XXXX and widespread reports, consistently report the following egregious issues : 1. * * Unacceptable Customer Service and Deliberate Call Disconnections * * : Cardholders routinely endure wait times of XXXX hours, only to be disconnected without assistance. The CFPB 's XXXX lawsuit against Comerica alleged the bank intentionally terminated over * * XXXX XXXX calls * *, leaving beneficiaries unable to report fraud, activate cards, or resolve blocks in a timely manner. This is not mere inefficiencyit is a calculated failure that strands people without access to their funds. \n\nXXXX. * * Arbitrary Card Freezes, Declines, and Forced Replacements * * : Cards are frequently locked or declined for \" suspicious activity '' ( even routine purchases ), with representatives unable to unlock them, forcing cardholders to pay expedited fees ( {$13.00} {$20.00} ) for replacement cards that often arrive late or fail to resolve the issue. Online transactions, bill payments, and in-person purchases are blocked without warning, causing missed payments, late fees, and evictions. \n\nXXXX. * * Frequent and Unexplained Declines at Merchants ( Online and Brick-and-Mortar ) * * : Despite being marketed as a XXXX debit card accepted XXXX XXXX is, the XXXX is routinely declined for legitimate transactions, even when sufficient funds are available. Egregious examples from verified complaints include : - Disabled cardholders unable to complete XXXX grocery deliveries ( essential for those without transportation ), with transactions repeatedly flagged as \" suspected fraud '' despite prior successful use at the same merchant. \n- Shoppers embarrassed at grocery store checkouts when cards are declined for everyday food purchases, leaving perishable items to spoil while waiting hours on hold for resolutionone reviewer reported their \" food was warm by the time I got to speak to someone. '' - Online bill payments ( rent, utilities, phone ) and purchases ( XXXX, XXXX XXXX ) declined without reason, forcing handicapped individuals to risk losing services or face shutoffs. \n- In-store declines at XXXX, XXXX stations, and USPS for routine needs, with XXXX cardholder noting higher daily rates on services because multiple attempts triggered overdraft-like penalties elsewhere. \nThese declines occur unpredictably, often on the same merchants used successfully before, turning a \" reliable '' government benefit card into an unreliable liability. \n\nXXXX. * * Mishandled Fraud Claims and Unauthorized Transactions * * : Fraud victims report drained accounts while awaiting replacement cards, with disputes taking XXXX days ( or denied outright due to \" insufficient evidence '' ). XXXX credits are rarely issued promptly, and investigations provide vague or no resolutions, violating Regulation E requirements. \n\nXXXX. * * Illegal Fees and Access Restrictions * * : Cardholders are charged improper ATM surcharges, transfer fees, or expedited replacement fees when the program 's own failures necessitate them. Burdensome identity verification processes lock people out of their own government benefits for weeks. \n\nThese failuresparticularly the rampant merchant declinesdirectly endanger the very population the XXXX XXXX program was designed to protect : seniors on fixed Social Security incomes, disabled individuals reliant on XXXX ( many homebound and dependent on online/delivery services ), veterans, and families receiving survivor benefits. When a card is arbitrarily declined at a grocery store, pharmacy, or for utility payments, beneficiaries can not buy food, medicine, or keep the lights on. Real-world consequences include spoiled groceries, missed prescriptions, utility shutoffs, evictions, and acute distress during emergenciesall because the entity entrusted with delivering lifeline federal payments prioritizes cost-cutting over basic competence, consumer protection, and reliable merchant acceptance. \n\nThe U.S. Treasury 's continued reliance on a contractor with such a documented history of failure is incomprehensible and unacceptable. Additionally, a separate issue involves allegations of discriminatory mortgage lending practices and an investigation into the denial of fraud claims by customers. \\nFraud and debt collection\\n\\tClass-action lawsuit: Navy Federal reached a proposed XXXX XXXX settlement over allegations that it improperly rejected fraud claims, particularly after accounts were drained by unauthorized users. The lawsuit alleged the credit union failed to comply with federal rules regarding fraud investigation and member notification.\\n________________________________________\\nXXXXnStephenson v. Navy Federal Credit Union\\nis a class-action lawsuit that alleged the credit union violated the Electronic Funds Transfer Act (EFTA) by improperly denying members\\' unauthorized transaction claims and failing to provide sufficient explanations or documentation. The case has resulted in a proposed XXXX XXXX settlement, which would compensate approved claimants and require Navy Federal to revise its explanation letters. \\n\\XXXX________________________________________\\nIf a fraud or theft claim with Navy Federal is denied, you should first review the reason for the denial and gather additional supporting documentation, such as a police report or more transaction evidence\\n. You can then ask to speak with a fraud specialist at Navy Federal for a second review or file a complaint with the CFPB or the NCUA. It is crucial to report fraud as soon as possible and distinguish between fraud and scams, as you are not covered by the zero-liability policy for scams where you authorized the transaction. \\nIf your claim is denied\\n\\tReview the denial reason: Understand why your claim was denied to determine the next steps.\\n\\tGather more evidence: Collect additional documentation that can support your claim, such as screenshots of fraudulent emails, a police report, or statements showing unauthorized activity.\\n\\tRequest a second review: Contact Navy Federal and ask to speak with a fraud specialist to have them review your case again.\\n\\tEscalate the issue: If you believe the denial was unfair, file a complaint with the Consumer Financial Protection Bureau (CFPB) or the National Credit Union Administration (NCUA). \\n\\t\\nHow to file a fraud claim\\n\\tReport it immediately: The sooner you report the fraud, the better your chances of stopping or reversing the transaction.\\n\\tUse the correct forms and addresses: Navy Federal has specific forms and mailing addresses for different types of fraud. For example, use the Statement of Forgery form for debit card fraud or the Declaration of Forgery/Fraud form for other account types.\\n\\tSubmit the claim: You can typically submit claims online, by mail, or via eMessage. \\n\\t\\nImportant considerations\\n\\tFraud vs. scams: Navy Federal\\'s zero-liability policy covers fraud but not scams where you authorized the transfer yourself, even if you were deceived into doing so.\\n\\tProvisional credit: Navy Federal may issue a temporary, provisional credit, but this can be removed if the claim is not validated.\\n\\tIndividual review: Navy Federal states that each case is reviewed individually based on available evidence, and outcomes may vary.\\n________________________________________\\nXXXX XXXX??
