The Department of Education has admitted that fraud exist, along with countless lawsuits from State Attorney Generals, and the Department of Justice investigations/lawsuit into XXXX, who was the parent company of XXXX at the time I attended school. The DOJ investigation found that XXXX had a boiler-room style sales culture in which recruiters were instructed to use high-pressure sales techniques and inflated claims about career placement to increase student enrollment, regardless of the applicants qualifications. \n\nThese loans were the direct result of fraud, misrepresentation and deceit including, but not limited to, false claims about career placement, false claims regarding job placement statistics, predatory and high-pressure sales tactics, misrepresentations about the cost of a degree, and misrepresentations about the value of a degree from the XXXX XXXX XXXX XXXX. \n\nNavient is obligated to cancel these private student loan because of the Holder Rule, which makes all current \" holders '' of an initial loan responsible for any fraudulent misrepresentations made in the selling of the product. The FTC has stated that student loans are within the scope of the Holder Rule. The Department of Education also has regulations applying principles similar to the Holder Rule to many federal student loans. For private loans, the borrower may be able to cancel existing debt if a school fraudulently induced the student to enroll and had some relationship with the lender. It's important to note, that XXXX was the guarantor for one of my private loans at this college. \n\nThe CFPB also found that lenders are misleading some borrowers and keeping them in repayment for debt they do not owe. The issue of whether  XXXX  filed a lawsuit after the expiration of the statute of limitations is currently pending before my state 's Supreme Court on interlocutory appeal. Another part of the interlocutory appeal is whether the mistakes on the summons result in a lack of personal jurisdiction. My credit report showed that a completely different corporation owned at least   XXXX   of the loans sued upon.  XXXX  did not include all   XXXX   loan account numbers in the complaint and refused to add the true owners of the loans as \" necessary parties '' to the case.   In my state, a loan servicer that collects loans it does not own is operating as a \" collection agency. '' A collection agency must be licensed in my state, and  XXXX  was not at the time of the lawsuit. I have consolidated these loans and still have 3 totaling XXXX with high interest. I went to XXXX from XXXX. I would like to know if these loans will be cancelled as a result of this lawsuit. I had to file a complaint with the CFPB back in XXXX  due to struggling to pay back these loans. They offered a temporary reduction in rate. My loans had to be put into a 3 month forebearance. I have paid on the loans to 8-10 years and there is still a large balance. Navient and XXXX  were stealing from studnets trying to better their lives. Of Education as they are a third party debt collector. They shouldn't have had any rights placing on my credit report 20 times allocating I owe a significant amounts of funds due to the letters I have received in regards to my loans being forgiven which takes years to do. All these past due amounts are inaccurate and false. US Dept. of ED has all information leading to claim status of loan forgiveness program I enrolled so I am asking all of Navient 's reports claiming late or unpaid to be removed off my reports due to inaccurate and false information reported as this is affecting my life and ability to gain employment and other resources.
