The beginning process of these disputes, and Experian 's lack of response started in XX/XX/XXXX of XXXX. Experian 's violation of the Fair Credit Reporting Act has been ongoing. Here is my response to their re-investigation : Dear Experian, Thank you for your response regarding my dispute on XX/XX/XXXX, through the CFPB Complaint Portal. I appreciate the time and attention you have given to my concerns. However, I must express my disappointment that Experian has failed to comply with the requirements of the Fair Credit Reporting Act ( FCRA ) with regards to my dispute. \n\nSpecifically, the FCRA requires consumer reporting agencies to investigate and resolve disputes within 30 days of receiving the dispute. In my case, I filed my dispute on XX/XX/XXXX, and yet, Experian failed to provide any proof that they conducted the investigation and resolved the dispute within the XXXX timeframe. Instead, Experian stated that the result summary was sent to me for review on XX/XX/XXXX, which they need to require proof of the return receipt via certified mail. Nonetheless, they have a long history of non-compliance ( see documents attached in XXXX ). \n\nFurthermore, I never received any correspondence indicating that Experian had received my dispute. According to the FCRA, consumer reporting agencies must inform consumers in writing that the dispute has been received within XXXX days of receipt. Experian did not provide a specific factual basis for the denial as required by law, despite having received a valid identity theft report and proper identification. \nI believe Experian failed to comply with its obligations under the FCRA by refusing to block identity-theft-related information without providing a legally sufficient explanation or conducting a reasonable investigation.Under the Fair Credit Reporting Act 605B ( a ), a consumer reporting agency is required to block identity-theft-related information within four business days after receiving a valid identity theft report and required identification.
