They responded and verified that the disputed information was accurate as reported, however, they may have updated other aspects of the account ( s ). they lied and said the accounts I mentioned weren't on my consumer report but this was a lie. The result summary was sent to you for review on XX/XX/2021 '' Experian has no authority what so ever to furnish any information to my consumer report but they are acting as if they do. The bureau describes Experian as an elaborate mechanism as an elaborate mechanism developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. \nThe banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. \nConsumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. \nThere is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. \nExperian has failed to comply with 15 USC 1681c. I never gave authorization, to EXPERIAN or any furnishers to consumer reporting agency to make any consumer report containing any of the following items of information, Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years pursuant to 15 USC 1681c ( 4 ) and any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years pursuant to 15 USC 1681c ( 5 ). Experian is required to have proper authorization and consent to report any information to my consumer report. I never gave them consent nor authorization. Experian is now liable. Experian has failed to comply with 15 USC 1681i and 15 USC 1681e ( b ), they are reporting accounts that are inaccurate. There are accounts reporting to my consumer report which are furnished as credit card accounts but this information is incorrect based off of the bureau definitions. Experian has failed to comply with 15 USC 1681a ( 2 ) and is liable pursuant to 15 USC 1681n. The consumer report does not include : any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; ( ii ) Experian has furnished reports containing transaction between myself and others. This information is supposed to be excluded from all consumer reports this is a violation of 15 USC 1681a ( 2 ). I was contacted by Suntrust bank later that evening because a fraud alert had been issued on my account. I spoke with a representative from the fraud department and it was discovered that XXXX was charged on my debit card. I realized that I had lost my debit card and it was found and then used without my authorization or consent. Suntrust issued a provisional credit but later determined that no error occurred and reverse the decision along with XXXX of NSF to my account. I sent an affidavit of fraud disputing the charges. They then sent me an additional form asking me to provide more information why they should look further into this matter. I sent them a detailed explanation that I did not make the charges. I went on further to ask them to look at my previous spending trends as well as the areas in which I normally make purchases. The purchases that were made were in stores that I had never previous shopped nor was it in the area in which I live and normally make purchases. I suggested that they further investigate by checking surveillance and matching the time of purchases to see if I actually made the purchases. I also asked them to compare signatures with my own signatures on receipts as well as the fact that on most occasions I use my pin number to make purchases and they individual/individuals had to use a credit in order to make purchases which is n't consistent with the way I normally handle transactions. I also suggested if they were to locate the individual/individuals who make the said purchases they could not affiliate them with me in any way. After all of the information that I gave them to further investigate they still refused to reverse the charges and credit the amount back to my account. As a consumer I feel that my rights have been violated and I have unfairly been a victimized and the bank has violated my rights under the Reg E electronic funds transfer act. I am reaching out to your organization to help me resolve this matter as soon as possible. I am sure millions of other consumers have experience this in regards to banking institutions and it causes extreme stress and anxiety when you have been a victim and feel you have no rights or protections against others who set out to commit fraudulent activities due to lost or stolen debit cards. I went to XXXX XXXX in person and they said they can charge any card that you use for a payment in the store for a membership fee which sounds illegal so I told them I didnt have an account with them at all and my parents did and Im not on that account so how did my card in my name get charged {$110.00} not once but twice without my authorization. I was told and made out to believe this case was finished when I got my money back from them. Well I was wrong today XX/XX/XXXX I was just charged {$110.00} from my money from a claims reversal. I called Wells Fargo to get to the bottom of this because the only claim I had was with XXXX that was in XXXX its XXXX now. And they said because they gave me a credit of {$110.00} they took it back. And that they can because I still have an open investigation and when a case opens they have 45 days to act on it. Well its been longer than 45 days if that was the case they should have took the money if it was money to take out in the beginning of XXXX it is XX/XX/XXXX and now they are technically stealing my money. Also they dont have any ownership on this money as for XXXX charged me twice. Wells gave me 1 credit for {$110.00} the first charge that XXXX took from me. Then XXXX charged me again the next day and XXXX gave me the money back for 1 of the transactions. Im saying if wells wanted their money back they needed to get it from XXXX because they double charged me. This change caused my order to get delivered to a completely different address. \n\nWhen I brought this to XXXXXXXX XXXX attention, an investigation was done. Therefore, to refute the AMEX agents claim, I reopened the dispute and attached pictures of a package that was delivered to my address with the XXXX zip code on it, THE SAME EXACT WAY THAT I GAVE IT TO XXXX XXXX, so if other packages could get delivered directly to me using the same exact address that I gave to XXXX XXXX, what would give XXXX XXXX the right to change the zip code that I gave them? AMEX took such evidence to reopen my dispute. \n\nTo respond to AMEX, XXXX XXXX, without ever addressing my true claim, submitted the SAME EXACT original documents that they already provided to AMEX, showing that the package is showing as delivered, when that is not the crux of my claim. Thus, I <em>NEVER</em> received the items that is showing as delivered."]},"sort":[15.143418,"6729696"]},{"_index":"complaint-public-v1","_id":"15115965","_score":14.526982,"_source":{"product":"Checking or savings account","complaint_what_happened":"Complaint Update Capital One Missing Funds from Partial Authorization Hold This is an update to my prior CFPB complaint regarding missing funds from a Walmart Auto Care Center transaction on my Capital One debit card ending in XXXX. \n\nAfter my original CFPB complaint was closed because Capital One provided a response, Capital One closed my dispute days later internally with the same denial reason they gave before : that they could not reach the merchant. \n\nWhat Happened : On XX/XX/year>, Walmart placed a {$220.00} authorization hold for a tire installation. \nThe appointment was canceled, and Walmart never finalized the transaction. \nWalmart issued a refund for {$160.00}, leaving a difference of {$64.00} missing from my account. \nThe Issue : Capital One claims I am not owed {$64.00} because they say : The original {$220.00} fell off their system. \nThe {$64.00} was never in their system as a separate transaction. \nHowever, this ignores the basic math : {$220.00} was held from my account. \n{$160.00} was returned by Walmart. \n{$64.00} is missing and has not been returned to my available balance. \nTimeline & Proof : My first dispute was denied because Capital One claimed they could not reach the merchant. \nI called Walmart and spoke with XXXX, who provided transaction # XXXX confirming the canceled appointment and that Walmart never received the funds. \nI filed an appeal of the denial, but Capital One denied it again for the same reason could not reach merchant. \nI then set up a three-way call between Capital One representative XXXX ( EID : XXXX ) and Walmart customer service representative XXXX ( who investigates Walmart claims XXXX. \nDuring the call, XXXX stated that the reason my claim had been denied was because Capital One could not reach Walmart and that I would need to resolve the matter directly with them. \nXXXX immediately responded that Walmart could not resolve a charge they never received, which is why there was nothing for them to refund. She also gave XXXX the Walmart case number XXXX related to the investigation. \nAfter this, Capital One still did not issue the refund but stated they would escalate and look into it. \nExplanation of Account Activity and Missing {$64.00} : Capital One states that the missing {$64.00} is not in their system and never showed as a separate transaction on my account. I want to clarify how this impacts my available funds and why it is still an error they must fix : When Walmart placed the {$220.00} authorization hold, my available balance was reduced by that amount temporarily. \nWalmart refunded {$160.00} of that amount, which was credited back to my account and increased my available balance accordingly. \nHowever, the remaining {$64.00} portion of the hold was never properly released or credited back by Capital One. This means my available balance remains short by {$64.00}, even though there is no separate transaction reflecting this missing amount. \nThis situation means the missing {$64.00} is effectively a phantom amountthere is no transaction on my statement for it, but my accessible funds are still short by that amount due to Capital Ones system error. Capital Ones failure to properly post the release of this partial hold has caused me to lose access to my money. \nAccording to Regulation E, banks must correct errors that cause missing funds, even if the issue arises from internal processing failures or system posting errors. Capital One must credit the missing {$64.00} back to my account to make me whole. \n\nPotential Violation of Regulation E : Under Regulation E ( 12 CFR 1005.11 ), Capital One is required to conduct a reasonable investigation of reported errors. Denying my dispute on the grounds of could not reach merchant despite clear evidence that I did contact the merchant and even connected them directly on a call indicates a failure to perform this investigation. Someone found it and began using my cards without my authorization. \n\nOn Sunday XXXX XXXX someone used my debit card from checking account at Discover Bank, at a casino for the amount of {$3600.00}. Immediately after discovering usage on my debit card I contacted discover and began a dispute. They gave me provisional credit, and then several weeks later I received a letter stating my claim had been denied because the merchant provided proof that it was a valid charge. Since I never authorized this transaction, I contacted Discover bank and they sent me the information the merchant was using to claim it was a valid charge. The information they provide was from the XXXX XXXX stating the transaction was done and verified by ID to match the card, I explained to Discover that my entire wallet was lost including my Driver license and that if the merchant didnt verify the debit card and ID belonged to the person using it, then that was not my responsibility. I sent in a statement including all this information and also proof that I had lost my phone and had to purchase a replacement. Discover Bank reopened the investigation and again denied my claim. Once again I called and they used the same phrase, about the debit card and ID name matching so it was a valid charge. They suggested I do a police report to reopen the claim and investigate again, which I did, only to have my claim denied again. They are refusing to show me video or camera surveillance of the person using the card to verify it was not me. On XX/XX/XXXX the merchant refunded the {$140.00} but the following day they charged my account again with another {$160000.00} It was then that I called American Express and told the American Express representative that I didn't authorize my account to be charged by that company. The American Express Representative said that she would put a block on my account for that Merchant and will open a dispute for the charges. American Express didn't block my account from as they had told me they would and again on XX/XX/XXXX my account was charged a third time with {$1600.00} Then I called American Express and the representative on the phone said that probably the previous representative didn't block the merchant correctly and this time the representative issued a new card number to make sure that didnt happen again. The previous representative should have done that on the first place. I explained the American Express representative that she can see a that this company was charging my account and that I have been disputing the charges from the very beginning. She acknowledged that. XXXX XXXX University was trying to sign me up several times on a program, taking me into their materials and online rooms. All the sudden American Express sent me a contract that they say that XXXX XXXX University sent them saying that I Electronically signed, which I NEVER DID, I never signed anything with that company. American Express fail to block my account when I told them. American Express told me that they will investigate. After a few days American Express said that it was my fault because I gave the merchant my credit card information in the first place. I know I gave the merchant my credit card information, but ONLY for the {$7.00} dollars, the only amount that I authorized. I also explained American Express that they need to pay attention to the small charges, they were refunded because I was fighting them with the merchant before I contacted the credit card company ( when you are going to call the credit card for a complaint there is a recorded message that tells you to contact the merchant first and that is what I did ). I also explained American Express that if they note on the so-called contract that the merchant was providing that I never signed, the date on the contract is XX/XX/XXXX the date I called to make the complaint to the merchant for the {$1600.00} charge from the day prior and told American Express to note that, right after I had complained from the charge with the merchant, American Express fails to listen to all the facts that I have given them because they make money on the more I owe on the card. Remitly rep said they couldn't find any charges with my name and or my debit card number and to let it post and work with my bank to resolve the fraud as remitly will work with BMO. the next day the charges posted I opened a fraud case of with BMO XXXX I was told a provisional credit will be provided as they investigate and attemp to recover and resolve the fraud. I NEVER received any credit back. I kept calling BMO Harris back day after day week after week in attempt to recover MY MONEY that BMO Harris gave away to thieves! I kept getting the run around with BMO Harris, it will be posted in 24hr then next Monday. Then I finally was told it was denied and to wait for a letter explaining why. They do this as a stalling tactic which is really dishonest. Instead of helping the client who entrusted their money within their institution, they disrespect them with these semantics. Among other things they sent me a letter that didn't answer any of my questions see attach letter they sent back. According to the FCRA 1681b ( a ) ( 1 ) ( 2 ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : a subpoena, or In a accordance with the written instructions of the consumer to whom it relate. The FCRA also says a consumer reporting agency shall not prepare or furnish an investigative consumer report unless agency has received a certification from the person who requested the report. No disclosure of fact of preparation was clearly and accurately disclosed to me in writing, it was supposed to be mailed to me no later than 3 days after the date on which the report was requested and including a statement informing me of my rights to request the additional disclosures. According to the FCRA the furnisher was supposed to give me 3 disclosures ( XXXX ) the option to opt-out information reporting to a nonaffiliated 3rd party prior to them reporting it ( XXXX ) I was supposed to be given the opportunity before the time that such information is initially disclosed to direct that such information do not be disclosed to such third party ( XXXX ) I was supposed to be given an explanation of how I can exercise the nondisclosure option which I never received any of these documents. The furnisher was not incompliance with the procedures of the FCRA Laws, but yet TransUnion verified these accounts as accurate, TransUnion is also in violation according to the FCRA, by reporting my personal information without having a subpoena or written authorization from me the consumer I never gave TransUnion permission to report information on me. TransUnion also didn't go through the proper procedures they were not supposed to report any of my personal information without certification from the person who requested the report it was their job to make sure that the furnisher followed the proper procedures by provided me with all of the disclosures, when I request for investigation you are supposed to send me all of the physical documents that the furnisher gave you supporting their claim against me, you never did you just sent a letter saying the accounts were verified .Weres the contract or agreement with my signature on it showing that I have done business with these companies. On XX/XX/year> I decided to call Bank of America and inform them of my situation and the reason I have not been paying my credit cards to them and the main purpose of my call is to make a payment arrangement and to ask them to waive some of the late fees, on which the Bank of America Representative with the name of XXXX told me that he was going to try to waive some of the late fees and he gave me the reduced amounts that I would have to pay on each of my XXXX credit cards including my business credit card. \nOn that he asked me if I wanted to set some specific dates to make these payments on which I said NO, and the reason I said NO is because I didnt know when exactly I was going to be getting a check that I was going to get for {$7000.00}. The other reason I said NO dates because I had previously done it with XXXX Card and the money wasnt deposit on time when I had told them to take the money and they ended up charging me more extra fees. The total unauthorized transactions were XXXX credits and XXXX debits totaling XXXX unauthorized transactions in all. On XX/XX/XXXX around XXXX I received a fraud alert text for a transaction for {$360.00}. I was sleep and did not see this message until the next morning. Upon seeing this immediately checked my account and saw I was missing money and immediately called to report this. I explained to the representative that there were multiple transactions, both credits and debits on my account from XXXX XXXX and that they were all fraudulent as I have never had a XXXX XXXX or dealt with this merchant, nor had I given my card information to anyone or gave anyone authorization to use my card, which never left my possession. The representative explained to me that there was no mechanism to claim fraud for credits but that they could file a claim for the debits that had posted and make a note on my account that the credits were fraudulent also. They explained that I would have to wait until the rest of the transactions posted before I could make a claim on them and I would have to watch my account and call back everyday transactions posted to make a claim on the remaining transactions. The first representative filed a claim for XXXX transactions totaling {$1500.00}. The next day XXXX more transactions posted and I called in to make a claim for those transactions totaling around {$920.00}. Then the following day. XXXX, the last XXXX transactions posted and I again called to do a claim on them totaling {$1200.00}. Somehow prior to me being able to dispute all the transactions my claims were being denied before I was even able to finish filing claims on all the transactions. Today when I called to see why all my claims were being denied, she explained to me that the previous representatives had messed up my claims by filing some of them as fraud and some as disputes, which I have no idea the difference, however resulting in multiple claim numbers that possibly went to multiple different investigators that did not communicate with each other to know the other investigators had the other claims. She also explained that I was informed incorrectly that I did not have to call back daily to dispute charges as they posted and it should have been a note left that all XXXX XXXX transactions both credit and debit were fraudulent and should be included in the claim. She told me that most likely the credits did not get considered since they couldnt be disputed and resulted in a denial because it would have looked like there were transactions from this merchant that I did not dispute, which is not true. Navy federal has no mechanism to dispute credits which makes no sense when they turn around and use the credits they wont allow me to dispute as a reason to deny my claim. This is a very deceptive practice and not fair. Now I have to escalate my claim which they say has no time frame, so I could have to wait forever if they want to make. MAS Financial pattern and practices have caught up with them and they face multiple lawsuits. I have tried to resolve the issues with MAS, but their staff is extremely rude and harassing. They called my phone more than 3 times a day and when I want to discuss the status of the account, credit reporting, and who they carry the company insurance with, they would just hang up on me and order an unlawful repossession order. I asked XXXX to please provide me with information used to make its decision because I would like to bring it to the fraud department at XXXX to get answers into why these thing were said. XXXX told me I would have to wait 10 days to receive this information from chime and it would come by email. at this time our call ended. On XX/XX/XXXX I contacted XXXX about the conversation had between them and chime and I was told by XXXX that no such conversation existed and isn't protocol of how they handle matters of such. XXXX then went on to actually put a ticket in for the matter because he found that my debit card on my account was used on another account not associated with mines and had seen back in XXXX - XXXX and transaction very similar happened and was also unauthorized and reversed by my bank. XXXX gave my a ticket number XXXX and told me I should forward this information to my bank and It would settle the matter. I forwarded that information over to chime immediately on XX/XX/XXXX at XXXX XXXX cst. I found that to be extremely disturbing when a merchant is saying that the charges are fraudulently and should be reversed but Chime is refusing to do so just because.
