Pursuant to 15 USC 1666e Capital One Bank declined all sales transaction with XXXX due to the credit card limit of {$500.00}. Please see attached email from Capital One regarding each transaction with XXXX. \n\nAccording to the attached file from Capital One Bank it is very clear that they are not following MasterCard Chargeback guide and have not issue a Chargeback under MasterCard Guidelines regarding the Fair Credit Bill Act pursuant to 15 USC 1666i ( a ) as the card issuer under MasterCard Chargeback guide regarding Chargeback code 4840.\n\nMasterCard Guidelines are very clear that the dispute code 4840 must be submitted to MasterCard and all documents must be submitted to MasterCom. No Chargeback was ever issue by MasterCard just a credit by Capital One Bank to violated XXXX. XXXX XXXX XXXX right under the Fair Credit Bill Act. \n\nThe attached document hasn't been submitted to MasterCard under the Fair Credit Bill Act. The Truth in Lending Act 15 USC 1601 limit XXXX. XXXX XXXX XXXX liability as the credit card holder for unauthorized charges on a credit card. See Krieger v. Bank of America 17-1275 ( 3rd Cir. 2018 ) which is attached. XXXX and Capital One Bank has fail to disclose information regarding the appropriate finance charges to be applied to the credit card under the provision of 15 USC SECTION 1666 ( b ) ( 2 ) regarding it response to the cfpb in three letters.\n\nCapital One Bank are not allowing MasterCard to investigate the dispute under the Fair Credit Bill Act and according to their letters to the cfpb are only threatening me because I used my rights under the Federal Credit Bill Act regarding the bill with XXXX under MasterCard Chargeback guide code 4048. During these calls, Synchrony representatives stated that the account would be frozen and that a fraud investigation would be initiated. \n\nDespite these repeated notifications, Synchrony failed to timely acknowledge my dispute in writing, failed to suspend billing and collection activity, and failed to complete a reasonable investigation within the timeframes required under the Fair Credit Billing Act ( 15 U.S.C. 1666 ). \n\nOn XX/XX/year>, I submitted a formal written fraud dispute pursuant to the FCBA. More than 30 days passed without proper written acknowledgment, and billing activity continued. On XX/XX/year>, Synchrony issued a missed payment notice attempting to collect {$290.00} on this same disputed account, demonstrating continued collection activity during an unresolved fraud dispute. \n\nIn subsequent correspondence, Synchrony issued contradictory written determinations. In one letter, Synchrony acknowledged fraud, confirmed account closure, and stated that credit bureaus were notified. In later letters, Synchrony denied my fraud claim and implied financial responsibility, without providing any supporting documentation. In XX/XX/year>, Synchrony continued to generate billing-related notices, including autopay cancellation, despite the account remaining under dispute. \n\nAt no point has Synchrony produced documentary evidence demonstrating that I opened, authorized, or benefited from this account. Specifically, Synchrony has failed to provide a signed credit application, IP address or device data, delivery confirmation, merchant documentation, or recorded call verification, despite multiple written demands.\n\nSynchronys denial relied on conclusory factors such as address matching, account age, or alleged prior payments. These factors do not establish consumer authorization and do not satisfy the requirement of a reasonable investigation under the Fair Credit Reporting Act ( 15 U.S.C. 1681s-2 ).
