During my call with representative XXXX XXXX, she confirmed my name and date of birth. When she read back my contact information, I informed her that it was incorrect. Despite this notice, the representative did not attempt to update or correct my contact information in their system. \n\nI explicitly stated that I am a victim of identity theft and that this alleged account is fraudulent and not mine. XXXX XXXX  informed me that my account would be forwarded to their disputes team for further investigation and that I would receive an email notification when their review is completed. However, she also stated that the company does not have my email address on file, which contradicts the assurance that I would receive email updates. \n\nI advised that I have already filed an FTC Identity Theft Report and completed a notarized affidavit. When I asked how to submit these materials, XXXX XXXX  directed me to email them to XXXX. \n\nWhy this is a problem Spring Oaks is attempting to collect on a fraudulent/identity theft account. \n\nThe representative did not correct inaccurate contact information after I identified it as incorrect, increasing the risk of missed notices and further harm. \n\nThe company indicated it would provide email updates despite having no email on file. \n\nI have already provided notice that the account is the result of identity theft, which triggers consumer protections under the FCRA ( including the right to block reporting of identity-theft-related information ) and requires proper dispute handling and validation under the FDCPA. \n\nWhat Ive done Filed an FTC Identity Theft Report and completed a notarized identity theft affidavit. \n\nContacted Spring Oaks Capital and disputed the debt as fraudulent, requesting investigation and instructions to submit supporting documents. \n\nWas instructed to send documents to XXXX. \n\nRequested Resolution I respectfully request that the CFPB require Spring Oaks Capital to : Cease all collection activity on this account immediately, and mark the account as disputed and identity-theft-related in all internal systems. \n\nBlock and delete any reporting of this account with all consumer reporting agencies pursuant to FCRA 605B ( 15 U.S.C. 1681c-2 ) upon receipt of my identity theft report and affidavit. \n\nProvide written confirmation that the account has been removed from my credit reports ( if it was reported ) and that no further
