The outgoing call lasted approximately XXXX minutes and began at XXXXXXXX XXXX \nDuring this call, an Equifax agent informed me that my drivers license and Social Security documentation were considered invalid, that my existing disputes were being marked invalid, and that I was required to resubmit identification including my full Social Security number. The agent explicitly stated that providing only the last XXXX digits of my SSN was insufficient. \nI explained to the agent that I have never provided my full Social Security number to Equifax for disputesonly the last XXXX digitsand that this method has been consistently accepted by Equifax in the past. \n\nDisputes Improperly Targeted The agent specifically referenced the following Equifax dispute confirmation numbers, all of which had already been accepted and issued by Equifax : Confirmation # XXXX Confirmation # XXXX Confirmation # XXXX Confirmation # XXXX Confirmation # XXXX Confirmation # XXXX Confirmation # XXXX Equifax must ensure that the closed confirmation numbers listed above were properly handled, and that the open complaints listed below are properly handled as well. \nEquifax can not retroactively invalidate disputes after identity verification has already occurred and confirmation numbers have been issued. \n\nProof of Disparate and Inconsistent Treatment Equifaxs claim that my identification is invalid is contradicted by its own historical conduct. \nI have filed numerous prior CFPB complaints against Equifax, all using the same identity-verification method ( government-issued ID and partial SSN ). Many of these complaints were accepted, investigated, and closed, with no indication whatsoever that my identification was invalid or insufficient. \nExamples include ( not exhaustive ) : CFPB complaint IDs from XX/XX/XXXX through XX/XX/XXXX, all marked Closed Company Responded Additional closed complaints from XXXX XXXX and XX/XX/XXXX, all processed using the same identification method None of the closed CFPB files reference invalid documentation, identity failure, or refusal to investigate due to missing full SSN This establishes that Equifax has previously verified my identity using the same documentation, and that the sudden demand for a full Social Security number is new, inconsistent, and selectively applied. \n\nImproper Demand for Full Social Security Number Equifaxs demand that I provide my full Social Security number as a condition to reinstate or process disputes is unreasonable and unsupported. \nThe Fair Credit Reporting Act does not require consumers to disclose their full SSN to dispute inaccuracies Equifax has repeatedly accepted disputes from me using a partial SSN Identity verification had already occurred, as evidenced by issued confirmation numbers Additionally, I was not provided any written notice identifying a specific deficiency in my identification or explaining how to cure it, despite Equifax claiming my disputes were being So by opinion of works you can only send letters and close accounts. Anyone reading any of these will find NO resolution because the Bureaus can not. Several laws has been broken and pointed out since then. \nFinally, XXXX didnt bother to respond to my certified mailing and all fail to respond by law. All Bureaus failed to respond or provide any physical proof that I indeed made the alleged inquiry.\n\n1.I filed the dispute of this particular Inquiry that you are reporting under FCRA 611 ( a ) ( 7 ) that specifically requires a description of the procedure used by your agency in providing and obtaining this inquiry record.\n\n2. I contacted your firm with a formal dispute under the FCRA 611 ( a ) ( 7 ). In addition I sent a formal written validation demand to the Creditor for the Inquiry that you are reporting. I requested to all 3 bureaus that my files be frozen and created security PIN 's etc. to be used when requesting temporary or extended/permanent un-freezes for legitimate inquiries. This seemed to work well for some time ( 1 year approximately ) however, after 2 different situations recently when attempting to legitimately allow companies to access my reports/files I ran into issues with Equifax. \n\nWhen attempting to obtain a home loan ( XX/XX/XXXX ), I went online to XXXX 's freeze website and was able to easily use my PIN to unlock my report for a temporary inquiry, I did the same for XXXX with ease, however, when I attempted to temporarily lift the freeze with Equifax I ran into several issues. First, the website that I previously used to unlock/unfreeze the file was changed to a dedicated site, I attempted several times to both login with existing credentials used for the previous equifax site ( which still work on that site ), then I attempted to register a new account without success and after several help requests via email went unanswered, I called via phone to unlock the report. \n\nThis is where things got even worse. The customer service agents that answered the call were clearly from a foreign call center and of the 4-5 agents I interacted with, it was almost impossible to understand or communicate clearly with any of them. I am myself a bi-lingual person and understand the nuances and complexities of trying to speak in different non-native tongues and can appreciate these agents efforts, however, their particular capabilities were not even on par with basic English communicators. The questions being asked to verify my identity were completely confusing and vague at best. I was asked open ended questions such as \" did you have a merchant account, credit account, or bank loan '' full stop, when I answered I've had dozens and started naming some, the first 3 - 4 agents were not satisfied with the answers and denied me the ability to unlock my report. Only after almost 2 hours of repeated calls did I reach an agent that was finally satisfied with my answers and unlocked the report. As anyone can imagine, this was completely infuriating. I then learned that the only alternative to unlocking online was to speak to representatives at this call center and endure a similar process every time or mail a physical letter and wait several business days for the action to be performed. \n\nSince I had such a difficult situation with their phone option ( on two different occasions ), I started reaching out to their online customer service contacts for help correct whatever issue was happening with my online profile that would allow me to unlock/unfreeze the reports myself via their website. I submitted a help request on their website on approximately XX/XX/XXXX-XX/XX/XXXX ( don't have a date because it was an online form and only have an estimate due to the time I was having the difficulties and compared to the date when I received teh response. When I submitted that help request I detailed my issues and received the following response on XX/XX/XXXX : On Thu, XX/XX/XXXX at XXXX XXXX Customer.care@equifax.com <customer.care@equifax.com> wrote : Dear XXXXXXXXXXXXXX,  We appreciate the opportunity to address this matter and apologize for any inconvenience you have had so far accessing your myEquifax account. \n\nUpon further review, the option to utilize the online website, MyEquifax is not available to you. Your company was at fault for the 145 million person data breach that has forced consumers to take identity protection into their own hands. The government has mandated that the bureaus provide a mechanism that is easy to use that allows for people to freeze and unfreeze their credit and protect their information. Your phone system is not easy to use, it is time consuming and it is prone to errors and repeated failures both with the automated portion as well as with a live representative of which your company chooses to use outsourced companies for that are based overseas with nearly impossible accents to understand. \n\nI demand that someone reevaluate my account and correct the problems that prevent me from using the online portion. On XX/XX/XXXX I sent my dispute and debt validation for multiple accounts to Equifax via certified mail. The main item that has been reporting inaccurately is Texas Attorney General Child Support division and they have been reporting inaccurately since XX/XX/XXXX. Equifax failed to submit a description of the procedure used to determine the accuracy and completeness of the information on any account disputed, which violates 15 U.S. Code 1681i ( a ) ( 6 ) ( B ) and/or 15 U.S. Code 1681i ( a ) ( 7 ). \nThe incorrect balance they reported I owed began around ~ {$3500.00}. Since then, it has constantly increased, to its most recent amount of ~ {$7300.00}. Equifax claimed they investigated the issue, but with a proper investigation it would have been obvious that Texas is not owed anything, and isn't the original state to which I pay child support for. \nI submitted a follow up dispute with supporting documentation on or around XX/XX/XXXX for incorrect information on my report. This was closed on XX/XX/XXXX with Equifax stating the account was valid and the information reported was accurate. No consideration was given to the documentation I submitted proving Texas should not be involved and the information being report is inaccurate. This violates 15 U.S. Code 1681i ( a ) ( 4 ). \nOn or around XX/XX/XXXX, I submitted an additional dispute citing problems with Equifaxs investigation into an existing problem. Equifax concluded that the account was accurate, reporting correctly, and closed their dispute investigation on or around XX/XX/XXXX. However, on XX/XX/XXXX, a representative from the Texas Attorney Generals office contacted me confirming that the balance is incorrect and would be corrected immediately. The fact that I received this information 8 days after the consumer reporting agency closed the investigation proves they did not conduct a proper investigation to ensure maximum possible accuracy, which violates 15 U.S. Code 1681e ( b ). This confirms negligent and willful intent of failure to conduct an adequate investigation and correct or delete the inaccurate account from a consumers credit report per FCRA 15 U.S.C. 1681i ( a ) ( 5 ) ( a ). I have attached the following : - Email communications between myself and the Texas AG CSO XXXX confirming that I am current - The amount Texas is reporting is inaccurate- All payment receipts from XXXX - Original court documents from Indiana dated XXXX with the same cause number as Texas dated XXXX The cause number from Indiana is dated XXXX. This is the original state which I am current on my child support with a credit due to me. \nEquifax has reported false information on my credit report for over a year without verifying the accuracy which is required according to the FCRA 15 U.S.C. 1681e ( b ). I am now being labeled a child support evader. With the continuous inaccurate and false reporting, I am nearing criminal charges. This has been a very stressful and costly situation for my family and me. I live in daily fear of a false warrant being issued to me. This false information is also increasing insurance rates while driving down my payment history plus credit score. \nXX/XX/XXXX filed first dispute XX/XX/XXXX second dispute XX/XX/XXXX disputed through CFPB XX/XX/XXXX reinvestigation completed On XX/XX/XXXX, I submitted a complaint to the CFPB citing improper reinvestigation processes by the credit reporting agencies. Equifax responded on XX/XX/XXXX, stating all the information disputed was verified and correct. On XX/XX/XXXX, I reached out to a Texas Representative ( XXXX  ) of my home county for assistance in rectifying this inaccuracy. I was then contacted by an assistant of the state representative to provide a summary of what has been going on. I was advised that the information would be forwarded to someone at the Texas AG office for review. On XX/XX/XXXX, XXXX, XXXX, from the Texas AG Child Support Division-Interstate Central Registry reached out advising that per their interface, I am current. I was notified that a request to terminate the Texas child support account will be submitted, as Indiana is current. \nI sent Equifax a very detailed dispute and debt validation letter informing them of the FCRA 15 U.S.C. 1681e and 15 U.S.C. 1681i, and my expectations in XX/XX/XXXX. It was in hopes that they did an honest investigation and be transparent which they failed both of us. I want this nightmare to end, my name cleared, and the credit reporting agencies to report accurate information because this has gone on for over a year. Equifax has shown grossly negligent behavior over the past year and very corrupt business practices. \nEquifax failed to conduct a reasonable reinvestigation and correct the inaccuracy. \nEquifax failed to conduct a reasonable reinvestigation of the disputes submitted to them and the CFPB multiple times. Equifax also failed to correct the disputed information, which is in violation of 15 U.S.C. 1681i ( a ) ( 1 ) ( A ). \nWhile recognizing that consumer reports play an important role in the economy, Congress wanted consumer reports to be fair and equitable to the consumer and to ensure the confidentiality, accuracy, relevancy, and proper utilization of consumer reports. 15 U.S.C. 1681. \nCongress, concerned about inaccuracies in consumer reports, specifically required consumer reporting agencies to follow reasonable procedures to assure maximum possible accuracy in consumer reports. 15 U.S.C. 1681e ( b ). Consumer reports that contain factually incorrect information which does not belong to the consumer at issue are neither maximally accurate nor fair to the consumers who are the subjects of such reports. \nUnder 15 U.S.C. 1681e ( b ), consumer reporting agencies are required to follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. \nUnder 15 U.S.C. 1681i ( a ) ( 1 ) ( A ), consumer reporting agencies are required to conduct a reasonable reinvestigation to determine whether the disputed information is accurate and record the current status of the disputed information or delete the item from the file in accordance with 15 U.S.C. 1681i ( a ) ( 5 ) before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. \nEquifax disregarded its duties under the FCRA with respect to my credit report. Equifax places its business interests above the rights of consumers and reports such inaccurate information because it is cheaper for Equifax to produce reports containing information that is inaccurate and incomplete than it is for Equifax to exert proper quality control over the reports prior to their being provided to Equifax customers. Equifax reports such erroneous and incomplete information because it wants to maximize the automation of its report creation process, thereby saving the costs associated with conducting the additional review necessary to remove the inaccurate or out-of-date entries. \nEquifax charges its customers the same price for reports that are grossly inaccurate as it does for accurate reports. Appropriate quality control review of my report would have been made clear that Equifax was reporting an inaccurate account. The sole reason the inaccurate account was reported as belonging to myself was that Equifax failed to follow reasonable procedures to assure the maximum possible accuracy of the information it published within the credit report it furnished. \nHad Equifax followed reasonable procedures, it would have been discovered that I was current on my child support per Indiana, the state of origin, and should not have been included in my consumer report. \nEquifax Failed to Conduct a Reasonable Reinvestigation and Correct the Credit Report in XX/XX/XXXX. On or about XX/XX/XXXX, I received an email correspondence from Equifax confirming that it had received my dispute but needed me to identify what Miscellaneous/State Specific I was disputing. I was confused, because in both my XX/XX/XXXX, dispute and XX/XX/XXXX, dispute, I specified that I was disputing the inclusion of the Texas Attorney General Child Support account in my consumer report. Worried about the process of my dispute, I again reached out to Equifax requesting a copy of my consumer report. On or about XX/XX/XXXX, I received another email correspondence from Equifax notifying me that my dispute was still in process. On or about XX/XX/XXXX, I received a copy of my consumer reports, and my review confirmed what I had already come to believe : that the consumer report included inaccurate reporting of the Texas Attorney General Child support account. \nUpon information and belief, on or around XX/XX/XXXX, I received another email correspondence from Equifax notifying me that my dispute had been completed and that an updated consumer report was available. \nUpon information and belief, on or around XX/XX/XXXX, I accessed a copy of Equifaxs dispute results through its online portal. On XXXX XXXX, XXXX, I submitted CFPB Complaint # XXXX to Equifax concerning obtaining my personal information from their The Work Number service -- a third-party employment verification service run by Equifax. On XXXX XXXX, Equifax responded that this had to do with XXXX XXXX XXXX- - what?! No where in my complaint did I mention anything to do with XXXX XXXX, so it's my belief that Equifax responded to the incorrect complaint of another consumer whose situation has nothing to do with me. Whatever the case, this is another example of Equifax 's poor data management and complaints handling process. I am asking Equifax to slowly, carefully and thoroughly re-read my original complaint, which I'm including in this new complaint, and have one of their executives respond directly to me. Further, it took Equifax nearly 30 days to respond to me, and I believe their XXXX XXXX response was merely a system-generated response to avoid any potential penalties they may incur for late responses ; that is, Equifax deliberately responded with false, inaccurate information concerning my complaint to stop the clock on their time to respond to me. Here is my complaint one more time : On XXXX XXXX, XXXX, I attempted to place a freeze on my The Work Number report, which is managed by Equifax, via their online system. I provided all my personal information requested by Equifax, including my name, date of birth, address, Social Security number and more. I was successfully able to create a log-in username and password, which then gave me access to The Work Number 's dashboard of tasks including the ability to view my report online at that time. When I clicked on the option to view my report, I received an error message that stated something to the effect of : \" We're sorry! This doesn't happen often, but we need additional information to allow you access to view your report, '' at which point it told me to download a form -- a form that asked me for the exact same information I provided to gain access to The Work Number site and dashboard, along with sending in documents to provide my identity and address -- a driver license, passport, lease, utility bill, etc. I was frustrated and confused at this point, because Equifax was asking me to handwrite a form and send in copies of documents with sensitive data on them, which would contain precisely the same information I already supplied to gain access to my The Work Number site in the first place. I then called the customer service number to place a freeze on my report by phone, because Equifax says you can place a freeze by calling their XXXX XXXX XXXX at ( XXXX ) XXXX. I called the XXXX XXXX XXXX, only to be told that they can't actually place the freeze over the phone -- I had to go back to TheWorkNumber.com and follow the online prompts to send an online message to request to open up a dispute case to place a freeze on my report. To say that we can place a freeze on our report data is deceptive and unfair, because their XXXX XXXX representatives can not do that ; consumers are required to use their online system. So, once again, I had to fill out Equifax 's online contact form with my personal data, explain that I wanted a freeze placed on my report, at which point I sent off the online contact form, only to receive a reply that Equifax would follow up with a secured email, with no specified timeframe for the follow up, with more information on how to complete placing the freeze on my report. Approximately 24 hours later, I received their secured email, which made me click on a link to take me to the secured email and enter my previously created username/password, and then I had to click yet another link to be sent a verification email by yet another company called XXXX, XXXX sent me an email that advised me to click on yet another link to verify that I have proper access to view the secured email sent to me by Equifax. At this point, in order to open up one secured message from Equifax, I had to go through Equifax, click a link to verify my identity, enter my username/password, wait for another email from XXXX, click on their link to verify I'm who I say I am and entitled to view Equifax 's secured message to me, and then finally I can view the message. Once I viewed the message from Equifax, I was advised to use their secured/encrypted messaging platform to upload identification documents to prove my identity and current address -- On XXXX XXXX, I uploaded my Social Security card, Minnesota driver 's license, a recent electricity bill and my signed lease agreement. In the body of my message to Equifax, I specifically stated I want an immediate freeze placed on my Work Number report, because I am in the process of closing on my mortgage and I don't want any new inquiries or fraud on my credit and consumer reports. Since XXXX XXXX, I have received nothing but carbon copies of the emails I've sent Equifax, where I've asked them for a status update on my freeze request on XXXX XXXX. Each email I send them requires me to twice click on links to verify and immediately re-verify my identity through Equifax 's third-party messaging service through XXXX. On XXXX XXXX, I called the same XXXX XXXX XXXX number as before to speak to a live person to ask for a status update on my freeze report request. The representative told me they can not confirm or deny any freeze requests over the phone -- it would all need to be done by email to : XXXX. So, I emailed that email address, only to receive an automated reply telling me I need to submit all my identity and address verification documents again. This email provided absolutely no update or any personalized response to my request for a status update on my freeze request -- all the while I'm trying to freeze my consumer data so I can smoothly complete the home-buying process. I provided all my personal information requested by Equifax, including my name, date of birth, address, Social Security number and more. I was successfully able to create a log-in username and password, which then gave me access to The Work Number 's dashboard of tasks including the ability to view my report online at that time. When I clicked on the option to view my report, I received an error message that stated something to the effect of : \" We're sorry! This doesn't happen often, but we need additional information to allow you access to view your report, '' at which point it told me to download a form -- a form that asked me for the exact same information I provided to gain access to The Work Number site and dashboard, along with sending in documents to provide my identity and address -- a driver license, passport, lease, utility bill, etc. I was frustrated and confused at this point, because Equifax was asking me to handwrite a form and send in copies of documents with sensitive data on them, which would contain precisely the same information I already supplied to gain access to my The Work Number site in the first place. I then called the customer service number to place a freeze on my report by phone, because Equifax says you can place a freeze by calling their XXXX XXXX XXXX at ( XXXX ) XXXX. I called the XXXX XXXX XXXX, only to be told that they can't actually place the freeze over the phone -- I had to go back to TheWorkNumber.com and follow the online prompts to send an online message to request to open up a dispute case to place a freeze on my report. To say that we can place a freeze on our report data is deceptive and unfair, because their XXXX XXXX representatives can not do that ; consumers are required to use their online system. So, once again, I had to fill out Equifax 's online contact form with my personal data, explain that I wanted a freeze placed on my report, at which point I sent off the online contact form, only to receive a reply that Equifax would follow up with a secured email, with no specified timeframe for the follow up, with more information on how to complete placing the freeze on my report. Approximately 24 hours later, I received their secured email, which made me click on a link to take me to the secured email and enter my previously created username/password, and then I had to click yet another link to be sent a verification email by yet another company called XXXX, XXXX sent me an email that advised me to click on yet another link to verify that I have proper access to view the secured email sent to me by Equifax. At this point, in order to open up one secured message from Equifax, I had to go through Equifax, click a link to verify my identity, enter my username/password, wait for another email from XXXX, click on their link to verify I'm who I say I am and entitled to view Equifax 's secured message to me, and then finally I can view the message. Despite these clear legal requirements, I have observed that the CFPB has FAILED to hold these credit reporting agencies ACCOUNTABLE for ongoing violations of these provisions. In many instances, inaccurate and unverified information remains on consumer credit reports, causing significant harm to consumers credit scores, financial stability, and overall well-being. The CFPBs failure to ENFORCE these laws effectively allows credit reporting agencies to act with impunity, ignoring the rights of consumers under the FCRA. In XX/XX/XXXX I made a complaint via the cfpb about EQUIFAX not correcting an existing problem with reporting inaccurate and unverified information AFTER A DISPUTE Equifax responded through the CFPB portal that every account I listed came back VERIFIED. I want to know how that could be when it shows on my Equifax credit report that THE DATE OF FIRST DELINQUENCY FOR XXXX XXXX {$1000.00}, IS XX/XX/XXXX but reports no data for the entire year of XXXX. It shows the first major delinquency is XX/XX/XXXX but not only does it show no data, but I also received a letter on XX/XX/XXXX showing a {$0.00} balance as of XX/XX/XXXX. ON the payment status it shows a charge off in XXXX XXXX. Last payment date for XXXX shows XX/XX/XXXX but Equifax shows XX/XX/XXXX. How can any bureau report that it's a charge off for XX/XX/XXXX when my letter shows a paid in full account from the original creditor in XX/XX/XXXX. XXXX XXXX- {$3600.00}, Shows date of first delinquency ON EQUIFAX XXXX XX/XX/XXXX but credit report status shows XX/XX/XXXX, It shows no data from XXXX XXXX no data XXXX, its reported-ON TIME PAYMENTS ON XXXX CREDIT REPORT from XXXX XX/XX/XXXX, no data from XXXX. IF ITS VERIFIED THEN HOW COULD THIS ACCOUNT SHOW A CHARGE OFF FROM XXXX XXXX TO XXXX XXXX FOR XXXX BUT ON EQUIFAX IT SHOWS XXXX AS A COLLECTION? inconsistent and obviously not verified properly. If the last payment was reported on my CR on XX/XX/XXXX, why does it show no data? It shows the last payment is XX/XX/XXXX but on my Equifax credit report it reports as a charged off account. I also have a letter from XXXX XXXX reporting a {$0.00} balance and nowhere in the letter did it say the account was charged off with a balance of {$1600.00}. Furthermore, it shows {$1200.00} CHARGED OFF and DATE OF FIRST DELIQUENCY IS XX/XX/XXXX on my Equifax credit report but my letter shows that the account was paid in full of a {$0.00} balance as of XX/XX/XXXX. HOW CAN AN ACCOUNT SHOW WRITTEN OFF, CHARGE OFF WITH A BALANCE but the letter says paid in full? XXXX XXXX XXXX- {$1400.00} is Reporting to my Equifax XXXX the PAST DUE payments for XXXX but on XXXX it shows on time payments from XXXX, XXXX Equifax is reporting the account as CHARGED XXXX. XXXX shows DATE OF LAST PAYMENT IS XX/XX/XXXX, Equifax says last payment is XX/XX/XXXX. It shows on Equifax the DATE OF FIRST DELINQUENCY XX/XX/XXXX BUT THE PAYMENT STATUS SHOWS THE DATE AS XX/XX/XXXX BEING FIRST DELIQUENCY. XXXX and XXXX show account status as paid but Equifax shows DEROGATORY. Equifax is reporting XXXX and XXXX is past due for 150 days how could both months be past due 150 days? Did you verify these inaccuracies? XXXX XXXX XXXX- {$20000.00} show the account as PAST DUE for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX on Equifax but on XXXX is ON TIME PAYMENTS. It shows NO DATA for the rest of the calendar year. How is that possible if the account was verified as a charged off account? It shows DATE OF LAST PAYMENT on Equifax XX/XX/XXXX but XX/XX/XXXX on XXXX. It shows high credit of {$23000.00} for XXXX but {$20000.00} for Equifax. NOT TO MENTION I AM A VICTIM OF THE EQUIFAX DATA BREACH.
