I contacted the original bank, which confirmed that the account was opened without verifying the identity of the applicant and that it had been sold or transferred to a third-party collection agency. Despite repeated efforts, neither Capital One nor the collection agency has provided any documentation bearing my signature or showing that I authorized the account. \n\nI have taken the following actions : Filed a police report for identity theft. \n\nSubmitted a FTC Identity Theft Affidavit. \n\nDisputed the account with all three major credit bureaus filed to OCC Sent a written demand for validation of the debt, including a request for the full account number, original application, and signed documentation. \n\n\nDespite these efforts, the account continues to appear on my credit reports, causing harm to my credit profile. I have never opened, used, benefited from, or approved this account in any way. My identity was stolen and used for fraudulent purposes and I am the one suffering the consequences. \n\nI submitted all the required identity theft documentation, including a sworn affidavit, FTC Identity Theft Report, and XXXX Police Report # XXXX. Despite this, TD Bank has ignored my documentation, refused to delete the account, and continues to report this information as valid. They have failed to comply with their legal obligations under the Fair Credit Reporting Act ( FCRA ), especially : 15 U.S.C. 1681s-2 ( b ) Failure to conduct a reasonable investigation 15 U.S.C. 1681c-2 ( Section 605B ) Failure to block fraudulent information after identity theft was reported 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) Furnishing information known to be false California Civil Code 1798.92 et seq. Refusal to correct identity theft records Gramm-Leach-Bliley Act ( GLBA ) Failure to safeguard nonpublic personal information Defamation of credit Knowingly reporting false and harmful data TD Banks only response was to imply that the account was valid because payments were once made. However, this is not a legal basis to deny an identity theft claim. Federal law and case precedent are clear : the fact that someone made a payment does not prove the account is legitimate. ( See Valentine v. First Advantage Saferent , Inc., 2009 WL 4349694. ) They never provided : A copy of the original application Any signed contract IP address or metadata used to open the account Any internal investigation notes This shows a complete failure to investigate as required by law. They did not verify with the original system or database. If they are using third-party software to \" verify '' without actual records, this is a procedural FCRA violation. A real investigation includes checking actual data not just relying on automated systems. \n\nAlso, I never lived at the address associated with this account. Specifically, XXXX XXXX XXXX is not and has never been my residence. Including this address in my file is further evidence of fraud and mishandling. \n\nI first notified TD Bank in early XX/XX/XXXX, and my affidavit of truth and legal demand was sent on XX/XX/XXXX, and went unrebutted. This raises further concern that the address may be used by multiple residents and that anyone could have used that location when applying for credit. \n\nIf Wells Fargo approved a credit card using an address that was not verified as belonging to me, this demonstrates a failure in their identity verification procedures. \n\nSavings Account Wells Fargo Claims Is Mine Wells Fargo also claims that a payment was made from a Wells Fargo savings account ending in XXXX. I have never opened or maintained any Wells Fargo bank accounts. If Wells Fargo believes this account belongs to me, they must provide documentation proving that my identity was verified when that account was opened. \n\nFailure to Conduct a Reasonable Investigation The documentation Wells Fargo provided suggests that their fraud review and internal investigation occurred within an extremely short timeframe, effectively a one-day internal review, before concluding the account belonged to me. \n\nA one-day review based only on internal transaction records does not constitute a reasonable investigation. \n\nUnder the Fair Credit Reporting Act, companies must conduct a reasonable investigation and ensure the accuracy of information they report. \n\nHistory of Regulatory Violations It is also important to note that Wells Fargo has previously faced enforcement actions related to unauthorized accounts and improper banking practices. \n\nFor example : In XXXX, the Consumer Financial Protection Bureau, the Office of the Comptroller of the Currency, and the XXXX XXXX XXXX XXXX XXXX fined Wells Fargo {$180.00} XXXX after discovering millions of unauthorized bank and credit card accounts were opened without customer consent. \nIn XXXX, the Federal Reserve imposed an asset cap on Wells Fargo due to widespread consumer abuses and risk management failures. \nIn XXXX, the U.S. Department of Justice announced that Wells Fargo agreed to pay {$3.00} XXXX to resolve investigations related to opening accounts without customer authorization. \nIn XXXX, the CFPB ordered Wells Fargo to pay {$3.00} XXXX in penalties and consumer redress for widespread consumer harm. \n\nThese enforcement actions demonstrate a documented history of improper account practices and unauthorized accounts. \n\nRequested Resolution Because Wells Fargo has failed to provide the requested documentation verifying that I opened or authorized this account, and because the address used on the application has never belonged to me, I request that Wells Fargo : XXXX. XXXX  is conducting sham investigations and leaving consumers helpless to stop fraud. \n\nOn XX/XX/year>, I received notification from First Horizon Bank that I could submit a request for information regarding a fraudulent account allegedly opened in my name. I immediately responded the same day ( XX/XX/year> ) via email, submitting all the requested documents to verify my identity and request full disclosure of the account details. \n\nDespite my timely response, I was told via email that they could not verify my identity, even though I submitted the documentation they explicitly requested. Furthermore, they stated in writing that the only method they would use to communicate further details was via phone call, which is not an appropriate nor verifiable method of recordkeeping for identity theft disputes. I clearly informed their representative that I required a full report in writing as part of my identity theft documentation process. \n\nSince that time, First Horizon has refused to respond to multiple follow-up requests for written documentation or verification of the alleged account. They have failed to provide any explanation, any evidence of the accounts legitimacy, or any documentation proving their attempts to properly investigate the matter. \n\nIn parallel, XXXX  has failed to uphold their legal obligations under FCRA by not thoroughly reinvestigating the disputed account and by ignoring my repeated Method of Verification ( MOV ) requests. These negative entries are damaging my credit profile and misrepresenting my financial history. I have never filled out an application with them, never signed a contract, never activated an account, and never carried any form of Barclays credit. The presence of this account on my credit file is the result of fraudulent activity conducted without my permission. \n\nWhen I first discovered this fraudulent Barclays Bank Delaware account on my credit report, I immediately disputed it with the credit bureaus. In each dispute, I clearly stated that I do not own the account and that it is the product of identity theft. I specifically requested a complete reinvestigation under the Fair Credit Reporting Act ( FCRA ), including verification of how the account was opened and documentation showing my connection to the account. I asked the bureaus to provide any original applications, signed agreements, identification documents, or proof that I opened this Barclays account. None of the credit bureaus provided any such documentation. \n\nInstead of producing real validation or documentation, the credit bureaus responded with automated statements that the account had been verified, without showing me how it was verified or providing any evidence that the account is mine. Under FCRA 611 ( a ), I have the right to a reasonable reinvestigation, and the bureaus must provide a Method of Verification ( MOV ) explaining how the account was confirmed. They did not do this. They simply accepted Barclays Bank Delawares automated response without proof.\n\nBecause this Barclays Bank Delaware account is fraudulent and the bureaus failed to properly investigate it, I took further action and filed an FTC Identity Theft Report. This report formally documents that the account is unauthorized, fraudulent, and not connected to me. Barclays Bank Delaware, however, has not provided any documents proving the account belongs to me, and the credit bureaus have not removed the account despite the lack of evidence and the identity theft filing. \n\nBarclays Bank Delaware has not demonstrated that they followed proper identity verification procedures when the account was opened. They have not shown any application data, identity matching checks, address verification, phone verification, or fraud-prevention safeguards that were used to verify the applicants identity. Because this account is fraudulent, it is clear that Barclays failed to properly verify the identity of whoever applied for the account. The company can not produce documentation that does not exist, and therefore they can not prove the account belongs to me.\n\nUnder FCRA 602A and 607 ( b ), furnishers must ensure maximum possible accuracy in reporting consumer data. Reporting a fraudulent account especially one that has been associated with an FTC Identity Theft Report is a violation of this federal requirement. Additionally, under FCRA 623 ( a ) ( 3 ), Barclays Bank Delaware was required to report the account as disputed by the consumer once notified. If the furnisher or bureaus failed to apply this dispute notation, that constitutes an additional violation.\n\nThe ongoing reporting of this fraudulent Barclays account also violates FCRA 605B, which gives me the right as an identity theft victim to have fraudulent accounts blocked from my file. When I filed the FTC Identity Theft Report, the account should have been blocked unless Barclays provided proof. Barclays has not provided any proof, yet the account is still being reported. This is not compliant with federal law.\n\nBarclays Bank Delawares failure to provide documentation, combined with the bureaus failure to remove the account, has forced me to continue disputing an account that I do not own. This process has required significant time, effort, and emotional energy. I should not be forced to continually dispute a fraudulent account that has already been reported as identity theft. I have filed an FTC Identity Theft Report and identity theft affidavit, attesting under penalty of law that this account is the result of fraud. The companys response improperly dismisses my identity theft claim, relies on inadequate verification methods, and unlawfully shifts the burden of proof back to me as the consumer. \n\n1. After enduring more than four months of attempting to resolve this issue, it has become increasingly apparent that the banks actions have served to justify and preserve the existence of a contract and supporting documents that I did not sign and did not authorize. \n\nFrom the outset, the bank failed to address the central issue raised in my original complaint : that a representative from its fraud investigation team, XXXX, explicitly informed me during recorded calls that there was no action the bank could take in cases involving forged documents. This statement was made in connection with an unauthorized auto loan opened in my name by car dealership XXXX of XXXX XXXX. There was never a valid loan agreement executed by me. The dealership itself has acknowledged this fact, and the bank has been aware of these circumstances throughout. \n\nDespite receiving clear notice of fraud, the bank failed to treat the matter as identity theft. Instead, it intentionally sent me affidavit documents that would characterize my claim as non-forgery and continued reporting the fraudulent loan to the credit bureaus during the investigation period in an apparent attempt to collect on an invalid debt and force me into mediation with the dealership. As a direct result, my XXXX XXXX XXXX  from approximately XXXX to the low XXXX. \n\nEven after I formally disputed the account with the credit bureaus and provided both my FTC Identity Theft Report and police report, the bank repeatedly verified the account as legitimate. This conduct caused ongoing damage to my credit and constitutes unlawful debt collection activity in violation of the Florida Consumer Collection Practices Act. \n\nOn XXXX XXXX, 2026, I received two letters from the bank that were clearly mailed together. One of these letters was backdated to XXXX XXXX, 2025, and claimed that the loan had been assigned to JPMorgan Chase. This statement is false. I never executed a contract with JPMorgan Chase and did not sign any documents dated XXXX XXXX, 2025, which were used to open the account. Notably, I did not request an investigation update until after filing a complaint with the Consumer Financial Protection Bureau on XXXX XXXX, 2026. The existence of a backdated update raises serious concerns about the legitimacy and integrity of the banks internal processes. \n\nThe contract documents themselves contain multiple material inconsistencies between the retail installment contract and the vehicle buyers order that raise questions about how the loan would of even gotten approved. Forged warranty documents containing wet signatures were also submitted, and these documents were so carelessly altered that they still listed XXXX XXXX  only lender with whom I actually executed a contractual agreementinstead of JP Morgan Chase. Additionally, the dealership misrepresented XXXX warranties as third-party Dealer General Warranties on XXXX retail installment contract. My fraud affidavit clearly outlined these material misrepresentations, yet the bank failed to address any of them. \n\nSince XXXX XXXX, 2025, I have consistently notified the bank that I did not sign the documents used to open this account and that I was unaware of the accounts existence. This has never been a contractual disputeit is identity theft and forgery. I requested a fraud investigation beginning on XXXX XXXX, 2025, but was never provided a case number. \n\nAfter I filed my CFPB complaint, the bank refused to provide investigation updates in writing and continued contacting me by phone despite my requests for written communication moving forward. Approximately XXXX months later, the bank denied my fraud claim without providing a written explanation and instead has asked me to call for further information. At the same time, the bank is attempting to assert that the fraudulent loan had been legitimately reassigned to them. The bank also stated that it had failed to obtain the police report that it had previously instructed me to file if I was not present at the dealership on XXXX XXXX, 2025. \n\nThe banks actions now appear to assisting in concealing of identity theft and fraud facilitated with forged documentation rather than correcting it. The dealership has attempted to characterize this matter as a civil dispute despite clear evidence of criminal conduct. The banks decision to allow the dealership to pay off the loan nearly 3 months later further supports concerns regarding intentional misconduct and the preservation of a fraudulent transaction. \n\nNo valid contractual agreement ever existed between myself and JPMorgan Chase, yet the bank has consistently treated the loan as legitimate. There was no reassignment of a valid loan only fraud facilitated through forged documentation. \n\nOver the past XXXX months, the banks conduct reflects more than mere negligence. It represents a sustained failure to properly investigate identity theft, address the use of forged documents, and prevent ongoing harm.
