I also have a letter from XXXX XXXX. dated XX/XX/XXXX, which explicitly states that at the time the debt was sold to Midland Credit Management, the balance consisted of : Principal : {$11000.00}, Interest : {$900.00}, Fees : {$250.00}, Total : {$12000.00}. \nHowever, XXXX 's validation response lists the entire {$12000.00} as XXXX XXXX ' with {$0.00} for interest and {$0.00} for fees. This misrepresents the character of the debt by relabeling {$1100.00} in interest and fees as principal, in violation of XXXX XXXX. Throughout the entire year, I encountered significant difficulties in dealing with Finance of America and its employees, including a lack of responsiveness and accountability. XXXX XXXX attributed these issues to staffing problems resulting from the COVID-19 pandemic. \nIt is important to note that my wife and I proactively sought information about the loan, including the protections afforded to senior citizens, by participating in a special interview conducted by HUD and FHA called \" Home Safe. '' We were determined to ensure that we fully understood the implications of a reverse mortgage and the safeguards in place to prevent misconduct, fraud, and exploitation of senior citizens. \nInitially, my agreement with XXXX XXXX was to replace my existing fixed-rate loan of 6.5 % with a fixed-rate loan of 5.5 %, saving me XXXX percentage point. I explicitly conveyed to XXXX XXXX that I would only accept a fixed-rate mortgage and would cancel the loan if any other type of loan was offered. \nRegrettably, I was not informed that the loan provided by Finance of America was adjustable and not fixed, contradicting our agreement and my explicit request. \nConsequently, all subsequent documents I signed were under the assumption that the loan was fixed at a rate of 5.5 %. This assumption was based on extensive discussions with XXXX XXXX over the course of a year. \nAs per federal regulations, reverse mortgage lenders are prohibited from engaging in unfair or deceptive practices. Section XXXX of the Federal Trade Commission Act explicitly applies to reverse mortgages, making it illegal to mislead or deceive potential borrowers regarding loan terms. Additionally, Regulation Z of the Truth in Lending Act ( TILA ) mandates that lenders provide specific disclosures to individuals applying for reverse mortgages. These disclosures include a good faith estimate ( GFE ) and an itemized list of loan charges.\n\nDespite my numerous attempts to obtain the initial disclosures that Finance of America claims to have, I have been unsuccessful in receiving any such documents. In fact, representatives from Finance of America, including their customer relations department and attorney, have repeatedly insisted that reverse mortgage loans do not require initial disclosures ( Exhibit B ). \nThroughout the entire process, from the onset of the reverse mortgage loan to its conclusion, I was kept in the dark, devoid of any initial disclosures, transparency, honesty, or truth in lending. I relied solely on the verbal information relayed to me by the mortgage broker, XXXX XXXX. \nRecently I was trying to refinance the loan and was told that in my contract with Finance America, there should have been a three-day recision period. I looked through the contract and it did not include that recision period. This has created a complete STOP on renovations of our home and has created much over costs since we can not move into our house. Since Movement Mortgage wo n't do anything for us, we have found a local Bank that maybe able to payoff Movement and issue a new mortgage. These issues contributed to total transmission failure, XXXX XXXX XXXX XXXX XXXX other major repairs to numerous engine, powertrain and transmission. XXXXThere were also concerns regarding the vehicles mileage accuracy that were discovered while researching for my complaint filed with XXXX  State Attorney Generals office.  Documentation from the National Motor Vehicle Title Information System (NMVTIS) and a XXXX state inspection report  which records data directly from the vehicles onboard computer  indicated discrepancies inconsistent with the mileage represented at the time of sale. Despite raising these concerns, I received only generic responses from XXXX and no substantive explanation or documentation.XXXXAfter ongoing problems and total transmission failure, the financial hardship, the vehicle was repossessed in XXXX XXXX, picked up, finally in XXXX XXXX by Bridgecrest. At the time of repossession, the vehicles mileage was approximately in the XXXX-mile rangeXXXXIn XXXX XXXX I received a lien notice stating that the vehicle had been found abandoned in a XXXX tunnel and towed by the XXXX State Police and XXXX XXXX. The notice listed a mileage of approximately XXXX  miles  a discrepancy of over XXXX  miles lower than the mileage at repossession. The vehicle was also reported to have been displaying a false license plate registered to a rental company and for a different vehicle make. This lien was put in my name, since they used fake plates, and broke down and was left there.  Bridgecrest and XXXX  were fully aware the car was undrivable due to total transmission failure that required XXXX in repairs.  This amount did not include other issues that may arise.XXXXAt the time of this incident, my insurance and registration had already been canceled months earlier, and the vehicle had been in the lenders possession since repossession. This raises serious concerns regarding the chain of custody, odometer accuracy, and handling of the vehicle after it left my possession.XXXXBridgecrest has informed me that the vehicle was sold through XXXX  auction services for XXXX, leaving me with a loan deficit of over XXXX XXXX Bridgecrest, and XXXX are all part of the same corporate structure. I had been on auto-pay with XXXX for about five years, and simply didn't notice that the auto-payments had stopped, as they were very small. I got no notice of the transfer from XXXX to Heartland until XXXX of the next year, when I got a default notice from Heartland. Once I got the default notice, I called up Heartland, and they instructed me to file a forbearance request, back-dated to XXXX of XXXX ( which, presumably, was when the first payment to Heartland would have been due ). They said that this would resolve the late payment issue and any potential credit reporting. The only real consequence was that I would have to pay a bit more interest ( but the interest rate was very, very low, so I figured that was not a problem ). It sounded like they had this problem a lot, because the guy immediately knew what to do ( almost like he was reading from a script ) after I described the problem. They also set up auto-payment on their system on that first call. I sent in the forbearance request and thought the issue had been resolved. \n\nA month or two later I got another default notice. When I called Heartland, they denied ever receiving the forbearance request, and asked me to send it again. They again said that the forbearance request would eliminate the default and reverse any negative credit reports. I sent them the forbearance request, along with the fax confirmation sheet that proved they received it the first time, too. I've attached this document to this complaint. This time, the forbearance was granted and I stopped getting default notifications. Again I thought the issue had been resolved. \n\nIn XXXX of XXXX, I refinanced my other student loans. My new lender asked me about these \" late payments '' on the Perkins loan ( which I wasn't refinancing ), so I called Heartland again. They told me on the phone that the granting of the forbearance request should have resolved any late payment credit reporting issues, and entered a ticket to investigate why it had not. They also told me that my loan had been transferred yet again to a new loan servicer in XXXX, so I scrambled to set up payment with that loan servicer. I figured out later that Heartland had given the new loan servicer the wrong address, even after I had corrected my address with Heartland on two different occasions. Fortunately, I was able to set up payment with the new loan servicer in time to avoid yet more default notices. \n\nThis year, I began applying for financing to purchase a home. My lender again asked me about \" late payments '' on the Perkins loan that are somehow still reflected on my credit. Now, with this judgment against me, AMEX has nothing to collect, and yet the entire process has caused irreparable damage to my health and well-being. The originator I dealt with was XXXX XXXX XXXX, NMLS # XXXX ( his phone number is ( XXXX ) XXXX and his email is XXXX ). \nWe locked in a refinance rate on or right around XXXX XXXX, 2015. This was for a very standard 30-year fixed rate mortgage that was eligible to be resold to XXXX of the big gov't agencies. We had just taken out this mortgage in conjunction with buying our home a few months prior, and had absolutely no issues or delays in doing so, based on our credit, income, assets, etc. \nWe locked in the rate for the standard term and the rate was to expire on XXXX XXXX, 2015. This left us plenty of time to complete the refinance. Based on the rate we chose, Gateway agreed to provide us a lender 's credit of {$4100.00}. Rates started increasing right after we locked in our rate, so we were quite happy with the rate we got. However, through no fault of our own, Gateway took an extremely long time during this process. It took them a full week just to order the appraisal, which then took another couple weeks, and at every step, the folks at Gateway were very slow and unresponsive. We provided them all the information they requested without delay at every step of the process. I called them many times to ask them to hurry and they did n't even reply to my messages most of the time. Towards the very end of the rate lock period, when rates were much higher, they came up with yet another issue for delaying the process. This issue was a credit check that was done by some other mortgage company at the time I was checking rates in early to mid XXXX, and Gateway admitted it had been on my credit record all that time. Yet, they only checked my credit again right before the rate lock was ending. It course turned out not to be an issue, but now our rate lock had expired and Gateway said they would have to charge an extension fee, so they reduced our credit by {$920.00}. \nI complained multiple times about this. Gateway admitted it was n't their fault but they refused to do anything about it. Finally, they said the best they could do was to knock off {$250.00} from the extension fee. So they reduced our credit by {$670.00}. At this point, rates were much higher and I felt I had no choice but to take this deal. \nI believe this is outrageous as well as highly suspicious. I know how these finance companies work, and that they hedge their interest rate risk on such rate locks by shorting Treasuries and those sorts of transactions, but that by delaying the process when rates have risen and recutting the terms, they can benefit themselves at the cost of consumers. I think CFPB should investigate Gateway and see how many times their underwriting processes go over the rate lock period during times when rates have gone up vs. times when rates have gone down. This second time TRANSUNION fixed 7 of the 10 accounts of my student loans with XXXX  but incorrectly left as open and with balances 3 of those 10 accounts but I was not able to access my credit report and see a repetition of the part of the initial mistake. When finally I saw my credit report, TRANSUNION was still reporting 3 of my student loans with XXXX  as with a open and with a balance. \nOn XX/XX/XXXX I filed again a request with TRANSUNION to correct their repeating error of reporting the remaining 3 student loan accounts with XXXX  as open and with the incorrect balances of {$20000.00}, {$10000.00} and {$10000.00}, which are incorrect since there were transferred, paid off and should be {$0.00} balance as XX/XX/XXXX as proved by the documents I attached. A couple of weeks later, I received a call from her boss, XXXX XXXX, sharing that XXXX was a new employee, I was her first client and she miss-quoted the 30-year fixed mortgage rate. It was 1/2 point higher than what she quoted. He explained that it was still close to 1/2 point under my current rate thus it was a good idea to move forward. He assured me that he would make it \" worth my while '' to move forward based upon the error and would make some additional adjustments on the closing documents. \nI explained that I would still move forward but since Citizens Bank holds my current mortgage and as a business owner I understand the amount of paperwork normally involved, I asked if Citizens Bank could expedite the process. Both XXXX and XXXX assured me of this from a time and paperwork standpoint. \nSix months later the process has been anything but expedited from either standpoint. No less than 50 emails, numerous calls and more than a substantial amount of documentation needed, the loan was denied on XX/XX/2017. \nThis denial came as an extraordinary surprise based upon the facts as I am aware of them and I believe there is more to this. XXXX told me many times during the process that the closing was imminent. Both XXXX and XXXX also shared on numerous occasions that this was the worst case of errors, miss-handling, and an uncalled-for length of time by Citizens Bank that they had ever experienced. XXXX explained that they switched underwriters more than once due to inadequacies. I can not begin to share all of the issues they apprised me of in this writing. Communicating that this has been a frustrating experience would be putting it mildly. XXXX had to extend the rate lock several times to accommodate. Regardless, I continued with the process. \nFinally, I contacted XXXX for the closing date as XXXX was not returning my calls. XXXX informed me that XXXX was denying the loan based upon a greater than 60 % liability to asset ratio and that they would be returning the fees that I had already paid. I can assure you that the reason given is not correct and I suspect this outcome was concluded for some other reason such as letting the rate lock expire in the current rising interest rate environment due to so many extensions, or due to something else. \nDue to the level of frustration and miss-handling experienced, in addition to the denial letter ( I 've never been denied anything monetarily ), I wanted to pursue an investigation and resolution. In a highly-regulated environment such as this, I 'm not sure how XXXX could make such an initial gross error in quoting me 3/4 point under the market.
