Your attempt to move this liability negotiation off the record is rejected. \n\nOmni Financial 's persistent conduct demonstrates Willful Non-Compliance with the FCRA and a Reckless Disregard for federal law, meeting the legal threshold for maximum damages in a lawsuit. \n\nI. Evidence of Legal Violations and Willful Non-Compliance Omni has repeatedly failed to conduct a reasonable investigation and correct the inaccurate tradeline : Military Lending Act ( MLA ) Violation & Void Debt : Prohibited Practice : The MLA, 10 U.S.C. 987, prohibits creditors from requiring a service member to use a military allotment to repay a consumer credit transaction. Omni 's Admission : Your communication to the CFPB confirms the loan payment was received via Allotment. This constitutes a legal admission that the loan is void from its inception. \n\nWillfulness : Omni had separate formal notice of the MLA issue in April 2025, yet willfully continued to report this void debt.\n\nIllegal Collection Attempts & Refusal to Communicate in Writing ( FDCPA Violation ) : Your demand that I call Omni to \" resolve your financial concern '' is an illegal collection attempt on a void debt. \n\nYour refusal to negotiate in writing and demand for a phone call is an attempt to evade the creation of a legally enforceable settlement document and will be cited as a further FDCPA violation in court. \n\nFurnishing Inaccurate/Aged Data ( FCRA Violation ) : Omni used documents stating a XXXX Debt Validation date for this account, which originated on XX/XX/XXXX. \n\nData Insertion During Active Dispute ( FCRA Violation ) : On XX/XX/XXXX, while this account was under an active dispute investigation, Omni added new data to the tradeline. Adding new data during a pending investigation is an illegal willful act that interferes with the dispute process. \n\nWillful Data Manipulation ( FCRA Violation ) : Following the formal dispute dated XX/XX/XXXX, Omni refused to delete the void debt. Instead, Omni engaged in willful data modification, altering 9 fields of data on the tradeline. \n\nII. Non-Negotiable Settlement Demand Omni Financial 's cumulative actions trigger a civil cause of action seeking statutory damages of {$100.00} to {$1000.00} per violation under the FCRA and FDCPA, plus attorney 's fees and punitive damages. To avoid an immediate federal lawsuit for all cumulative violations, I demand the following non-negotiable settlement : Immediate Deletion : Permanently delete the Omni Financial tradeline ( # XXXX ) from all three credit bureaus. \n\nCash Settlement : Pay a non-negotiable cash settlement of {$15000.00}. \n\nOmni Financial has 7 calendar days from today 's date to agree to this full settlement in writing. These errors are causing tangible harm to the consumer 's financial well-being and livelihood. The failure of previous investigations to rectify these issues points to unreasonable reinvestigation procedures by the credit reporting agencies ( CRAs ) and the data furnishers. \nBelow is a legal analysis of the violations found, a bureau-specific breakdown of inaccuracies, and customized disputes for each CRA and the Consumer Financial Protection Bureau ( CFPB ). \nXXXX XXXX XXXX FCRA Violations My credit reports contain clear evidence of multiple violations of my federally protected rights. The core issues stem from the bureaus ' failure to ensure the accuracy and integrity of the information they maintain and disseminate. \nXXXX. Violation of Maximum Possible Accuracy ( 15 U.S.C. 1681e ( b ) / FCRA 607 ( b ) ) This statute requires CRAs to \" follow reasonable procedures to assure maximum possible accuracy of the information. '' * Why it's a violation : The XXXX gap between the Equifax score ( XXXX ) and the TransUnion score ( XXXX ) is incontrovertible proof that XXXX or more reports are fundamentally inaccurate. The massive discrepancy in total balances, with Experian reporting a balance of {$89000.00} versus Equifax 's {$6600.00}, further demonstrates a catastrophic failure to maintain accurate data. Accounts like XXXX are reported as \" Current '' by Equifax while being \" Late XXXX Days '' on TransUnion and Experian, an impossible contradiction. \nXXXX. Failure to Conduct a Reasonable Reinvestigation ( 15 U.S.C. 1681i / FCRA 611 ) The FCRA guarantees a consumer the right to dispute inaccurate information. Upon receiving a dispute, the CRA must conduct a reasonable reinvestigation and delete any information that is found to be inaccurate, incomplete, or can not be verified. \n* Why it's a violation : Prior investigations failed to resolve these issues. The continued presence of demonstrably false and contradictory information is strong evidence that past reinvestigations were merely \" parroting '' the incorrect data from the furnisher and were not \" reasonable '' as required by law. \nXXXX. Furnisher 's Duty to Provide Accurate Information ( 15 U.S.C. 1681s-2 / FCRA 623 ) This law mandates that data furnishers ( creditors, lenders, etc. ) report accurate and complete information and conduct a proper investigation of their own upon receiving notice of a dispute from a CRA. \n* Why it's a violation : Furnishers are providing conflicting data on identical accounts. For the \" XXXX '' account, the balance is reported as {$170.00} by TransUnion and Equifax, but {$710.00} by Experian. For the \" XXXX '' account, the high balance is reported as {$8.00}, {$520.00}, and {$0.00} by the XXXX bureaus, respectively. These furnishers are in violation of their duty to report accurately. \nXXXX. Failure to Maintain XXXX XXXX XXXX XXXX ( 15 U.S.C. 1681c-1 / FCRA 605 ( c ) ) This provision requires CRAs to include an XXXX XXXX alert in the file of an XXXX XXXX military consumer upon request. This alert must then be included with any credit score or report generated. \n* Why it's a violation : The Experian report correctly includes an XXXX XXXX alert valid from XX/XX/XXXX. However, the reports from TransUnion and Equifax completely omit this alert. This is a serious violation that shows a failure to maintain a complete and accurate file for a servicemember, potentially denying him critical protections. \nViolations by Credit Bureau Here is a specific breakdown of the inaccuracies on each of XXXX XXXX XXXX credit reports. \nTransUnion Violations * Failure to Include XXXX XXXX Alert : Fails to report the consumer 's XXXX XXXX military status, a critical component of his file. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Inaccurately reports the account as \" Late XXXX Days '' with an {$86.00} past due balance, while Equifax reports it as \" XXXX. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports this collection account as \" XXXX '', which contradicts Experian 's reporting of the same account as \" Closed ''. This is also likely fragmented reporting of the \" XXXX '' account on Equifax. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports a high balance of only {$8.00}, which is drastically inconsistent with Experian 's {$520.00} and Equifax 's balance reporting. \n* Derogatory and Collection Accounts : Reports multiple derogatory accounts ( XXXX XXXX XXXX XXXX XXXX XXXX that are either unverified or inconsistently reported, contributing to the suppressed score. \nExperian Violations * XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX : This is the most damaging item on any report. It is a massive family support account with a balance of {$62000.00} and a past due amount of {$61000.00}, reported as \" Late XXXX Days ''. This account appears only on Experian and is the primary reason for the {$89000.00} total balance and severely damaged score. Its singular presence makes it highly suspect and unverifiable. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Inaccurately reports the account as \" Late XXXX Days '' with an {$86.00} past due balance. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports an incorrect balance of {$710.00}, while the other XXXX bureaus report a balance of {$170.00}. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports this collection account as \" Closed '', which contradicts TransUnion 's report. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports a high balance of {$520.00}, which is inconsistent with the other bureaus. \nEquifax Violations * Failure to Include XXXX XXXX Alert : Fails to report the consumer 's XXXX XXXX military status. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports the account as \" XXXX '' with a {$0.00} past due balance, a direct contradiction to the \" Late XXXX Days '' status on the other XXXX reports. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Inaccurately reports this rental agreement as \" Open '', while TransUnion and Experian both correctly report it as \" Closed '' and \" Paid ''. \nXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reports a derogatory collection account that is likely a fragment of the \" XXXX '' account on the other XXXX bureaus. This indicates flawed and duplicative reporting. \nDispute Letters for Bureaus and CFPB Submission Below are XXXX customized letters drafted for XXXX XXXX. What happened I filed a detailed consumer complaint with the Pennsylvania Office of Attorney General, XXXX XXXX XXXX XXXX ( XXXX ) against NewRez LLC d/b/a Shellpoint Mortgage Servicing concerning corrupted loan data, misapplied / unapplied payments, negative escrow, and foreclosure risk on my VA-backed mortgage. \nOn [ email date ], I received the attached email from XXXX XXXX, XXXX XXXX XXXX, Pennsylvania OAG XXXX, regarding Complaint No. XXXX. \nThe email states that the XXXX XXXX XXXX XXXX : attempted to resolve your complaint against NewRez LLC ( d/b/a Shellpoint Mortgage Servicing ) through a voluntary mediation process, but we have not been able to resolve this matter to your satisfaction and have reached an impasse between you and NewRez LLC ( d/b/a Shellpoint Mortgage Servicing ), and we will take no further action on your complaint at this time.\n\nThe email also confirms : A copy of your complaint will remain on file for future reference and for possible use in an investigation or enforcement action we may bring to protect the public interest of the Commonwealth of Pennsylvania.\n\nIn plain terms : a state Attorney Generals consumer-protection office tried to mediate my dispute with NewRez / Shellpoint . The company refused to resolve it, and the AG is now keeping my complaint for possible enforcement use. \n\nThis is not a situation where I refused mediation ; it is a situation where NewRez / Shellpoint declined to take the off-ramp that would have repaired their servicing errors and protected a 100 % permanently and totally XXXX veteran from further harm. \n\n\n\n2. Why this is willful & deliberate obstruction Federal law requires mortgage servicers to investigate and correct account errors and to respond to written Notices of Error : 12 U.S.C. 2605 ( e ) : Servicers must respond to borrower inquiries and error notices.\n\n12 U.S.C. 2605 ( k ) ( 1 ) ( C ) : Servicers may not fail to take timely action to respond to a borrowers requests to correct errors.\n\n12 C.F.R. 1024.35 : Servicers must acknowledge a Notice of Error within 5 business days and then either correct the error or provide a detailed written explanation within required timeframes.\n\n12 C.F.R. 1024.38 : Servicers must maintain policies and procedures to accurately credit payments, maintain records, and respond to borrower complaints.\n\nIn my case : I have already sent multiple RESPA Notices of Error and legal-hold letters to NewRez / Shellpoint about misapplied funds, inaccurate delinquency status, and corrupted escrow.\n\nInstead of providing the required written corrections or a consistent accounting, the company has closed XXXX as duplicates, refused to explain contradictory ledgers, and continued to change key figures ( unapplied funds, escrow balances, past due amounts ) while foreclosure pressure continued. \nThe Pennsylvania OAG XXXX email now shows that even when a state AGs office intervened, NewRez / Shellpoint still would not resolve the matter, causing an impasse and forcing the AG to suspend mediation and reserve the complaint for possible enforcement. \n\nA servicer that 1 ) ignores or duplicate-closes XXXX and 2 ) refuses to cooperate with a state Attorney Generals mediation process is not simply confused. It is obstructing the statutory error-correction framework that RESPA, Regulation X, and state consumer-protection laws are built on.\n\n3. Ongoing harm Because NewRez / Shellpoint refused to resolve this in the AGs mediation : My VA loan account remains corrupted, with conflicting ledgers and negative escrow despite significant payments. \nI remain under continuing foreclosure risk based on data that the servicer and now a state AGs office know is disputed and potentially unreliable. \nAs a 100 % permanently and totally XXXX veteran, this prolonged uncertainty and threat of losing my home causes severe emotional and psychological harm on top of the financial harm. \nOther borrowers who complain to the Pennsylvania OAG may face the same impasse, meaning this pattern is not just about me ; it raises a systemic risk that NewRez / Shellpoint / XXXX will stonewall state-level mediation while continuing harmful servicing practices. \n\n\n\n4. Damages requested For CFPB purposes, I am asking that this complaint be treated as both an individual harm case and an indicator of a broader pattern and practice : Individual relief requested {>= $1,000,000} in compensatory, statutory, and punitive damages for : financial harm from corrupted servicing, threats of foreclosure, and fees ; severe emotional and psychological distress aggravated by my status as a 100 % permanently and totally XXXX veteran ; time, cost, and effort spent pursuing corrections through multiple regulators and now the Pennsylvania OAG.\n\nFull payoff and release of my VA-backed mortgage so that my home is secured free and clear. \nFull correction of all tradelines and credit reports to remove any delinquencies, late fees, or negative remarks that stem from the corrupted data and unresolved errors. \n\nSystemic / public-interest relief requested Creation of a {>= $1,000,000} restitution and remediation fund for other borrowers serviced by NewRez / Shellpoint XXXX XXXX whose accounts have been impacted by similar data corruption, misapplied payments, or refusal to correct errors, with priority for VA loans XXXX FHA loans XXXX and loans to active-duty military and XXXX veterans. \nA comprehensive servicing-platform audit ( data integrity, escrow handling, payment application, XXXX response procedures ) supervised by CFPB and state regulators ( including Pennsylvania OAG and Tennessee XXXX XXXX. \nAppropriate civil money penalties for pattern-and-practice violations of RESPA, Regulation X, and unfair / deceptive acts or practices under the Consumer Financial Protection Act and applicable state UDAP laws. \n\n\n\n5. What I am asking CFPB to do Given the Pennsylvania OAG email, I respectfully request that CFPB : Treat this as evidence that NewRez / Shellpoint are refusing to participate in good-faith resolution with a state Attorney General, despite active servicing errors. \nOpen ( or expand ) a supervisory or enforcement investigation into NewRez LLC, Shellpoint Mortgage Servicing, and XXXX XXXX XXXX for violations of 12 U.S.C. 2605, 12 C.F.R. 1024.35 & 1024.38, and unfair / deceptive acts or practices. \nCoordinate with the Pennsylvania OAG XXXX XXXX XXXX XXXX to use my complaint file ( XXXX ) as part of any joint or parallel enforcement action. \nRequire the company to correct my account, pay damages, and implement systemic fixes so that other consumers are not forced into the same situation. \n\nAttached is the full email from XXXX XXXX, XXXX XXXX XXXX, Pennsylvania Office of Attorney General, XXXX XXXX XXXX XXXX, which documents the failed mediation and confirms that my complaint is being retained for possible enforcement use.","date_sent_to_company":"2025-11-19T15:07:50.000Z","issue":"Trouble during payment process","sub_product":"VA mortgage","zip_code":"37066","tags":"Servicemember","has_narrative":true,"complaint_id":"17370188","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Shellpoint Partners, LLC","date_received":"2025-11-19T14:47:57.000Z","state":"TN","company_public_response":"Company has responded to the consumer and the CFPB and chooses not to provide a public response","sub_issue":"Payment process"},"highlight":{"complaint_what_happened":["Why this is willful & deliberate obstruction Federal law requires mortgage servicers to investigate and correct account errors and to respond to written Notices of Error : 12 U.S.C. 1024.35 : Servicers must acknowledge a Notice of Error within 5 business days and then either correct"]},"sort":[7.7148542,"17370188"]},{"_index":"complaint-public-v1","_id":"16371366","_score":5.9946375,"_source":{"product":"Credit reporting or other personal consumer reports","complaint_what_happened":"b'Final Warning Fraudulent and Misleading Credit Reporting\\n\\nThis complaint applies to your companys continued false and misleading credit reporting in violation of the Fair Credit Reporting Act (15 U.S.C. 1681s-2), the Fair Debt Collection Practices Act, and Louisiana state consumer-credit laws.\\n\\nOver the past year, I have repeatedly disputed multiple violations across tradelines your company reports under my name, including but not limited to:\\n\\t\\tRe-aging of delinquent or charged-off accounts to appear recent\\n\\t\\tDuplicate reporting of sold or transferred debts\\n\\t\\tInflated or fabricated charge-off balances\\n\\t\\tPhantom or false payment entries\\n\\t\\tFailure to correct or delete inaccurate or unverifiable information after notice\\n\\nThese acts constitute willful and fraudulent misrepresentation of my credit history.
