I'm writing to talk about an issue I found in my credit report. My name is XXXX XXXX XXXX, and I noticed that some of my personal information was shared with another company without my permission. I think this goes against the law that says you can't share someone's personal info without their say-so. \n\nI read about the rules ( 15 U.S. Code 6802 ) that say my personal info should be protected, but it seems like that didn't happen. The Fair Credit Reporting Act ( FCRA ) also gives me the right to control who gets my info, and it looks like my info went to someone who isn't connected to your company. This worries me because I didn't get a chance to say no, like the law says I should. \n\nJust to be clear, I don't have a problem with the companies I owe money to. My concern is with your company for sharing my info without checking with me first. \n\nI checked the law ( 15 USC 1681b ), and it says you need my written permission to share my personal info. I never gave that permission, so I need you to prove that I said it was okay. If you can't, it might mean you broke the rules of the FCRA. \n\nI already reported this to the Federal Trade Commission ( FTC ), and my complaint number is XXXX. I have attached my identity theft affidavit and a detailed letter outlining the issues at hand. \n\nChexSystems included account information in my report without obtaining my explicit consent or written authorization, which is a clear violation of the Fair Credit Reporting Act ( FCRA ). The FCRA mandates that consumer reporting agencies must secure proper consent before including information on a consumers report. \n\nTo support my complaint, I wish to highlight relevant federal cases that underscore the seriousness of these violations : 1. **Cunningham v. Equifax Info . Servs., LLC**, 2018 U.S. Dist . LEXIS 216015 ( E.D. Mich. Dec. 21, 2018 ) : This case illustrates that consumer reporting agencies must ensure the accuracy and legitimacy of information included in consumer reports and adhere to strict compliance standards. \n\n2. **Miller v. Equifax Info . Servs., LLC**, 2019 U.S. Dist . LEXIS 5607 ( N.D. Ill. Jan. 11, 2019 ) : This case reinforces that a failure to correct inaccurate information after being notified constitutes a violation of the FCRA .\n\n3. **Murray v. Experian Info. Solutions, Inc.**, 2019 U.S. Dist. LEXIS 43435 ( N.D. Ill. Mar. 14, 2019 ) : This decision highlights the importance of obtaining proper consent and provides a precedent for holding consumer reporting agencies accountable for non-compliance. \n\nGiven the gravity of this issue, I intend to file a federal lawsuit for violations of the FCRA. The unauthorized reporting of my account information has caused undue stress and potential harm to my credit profile. \n\nI request that the CFPB investigate this matter thoroughly and take appropriate action against ChexSystems to enforce compliance with the FCRA. Despite my previous 2 written requests, the unverified items listed below still remain on my credit report in violation of Federal Law. I am a victim of identity theft. I have alerts saying my information is compromised on the dark web. I've filed the proper reports and let all the consumer reporting agencies know of this matter. TRANSUNION is reporting inaccurate and incorrect information on my consumer report and has failed to follow federal laws and guidelines stated under FCRA Sec 605B ( 15 U.S.C 1681c-2 ) Section 605B of the Fair Credit Reporting Act ( FCRA ), which is codified at 15 USC 1681c-2 , contains provisions related to the blocking of information resulting from identity theft. Under Section 605B, if a consumer submits an identity theft report to a consumer reporting agency and requests a block on the reporting of information that resulted from the identity theft, the agency must comply with the request within four business days. Also, they failed to honor their responsibility under Sec 611 ( a ) of the Fair Credit Reporting act codified at 15 U.S.C 1681i ( a ) which requires consumer reporting agencies to \" follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Using e-OSCAR to process consumer disputes, does not satisfy the requirements of FCRA Section 611, which mandates a \" reasonable reinvestigation '' of disputed information. As highlighted in cases like XXXX XXXX Trans Union XXXX ( XXXX XXXX XXXX XXXXXXXX XXXX XXXX, XXXX ( XXXX ), courts have determined that CRAs can not solely rely on XXXX 's automated processes to meet their obligations under the FCRA. These rulings emphasize that merely forwarding disputes to data furnishers via XXXX without conducting an independent and thorough investigation is inadequate. The FCRA requires that CRAs take additional steps beyond the automated exchange to verify the accuracy of the disputed information, ensuring that consumer rights are fully protected. It has been well past the 4 day time period and I immediately request that these fraudulent accounts be deleted immediately. 15 U.S. Code 1681o - Civil liability for negligent noncompliance In general Any person who is negligent in failing to comply with any requirement imposed under this subchapter with respect to any consumer is liable for any actual damages sustained by the consumer as a result of the failure Negligent noncompliance means the law was violated not on purpose but just due to a lack of knowledge on the required reporting procedures. TRANSUNION has violated even more violations by failing to comply after my first initial CFPB complaint. TRANSUNION denied my request to block the fraudulent accounts and information due to not enough info via email I then resubmitted the info with adequate info to BEST of my ability as these accounts are FRAUDULENT. TRANSUNION has failed to respond or comply with requests and that was on XX/XX/XXXX I submitted our email exchange which transpired through TRANSUNION 'S secure email system. Further proof that TRANSUNION is failing to comply and violating the FCRA laws and my right under the FCRA. It has now been 13 days since my first 605b block request and they still have not communicated nor taken any action. The persistent delays, stress, and financial implications caused by TRANSUNION 'S negligence have put me at my breaking point. I urge the CFPB to intervene promptly and ensure that TRANSUNION upholds their obligations under the law.","date_sent_to_company":"2024-08-26T21:41:33.000Z","issue":"Problem with a company's
