I called Capital one, the Credit card ( cc ) company and reported the fraud the same day, had this cc company cancel this unauthorized transaction, deactivated my existing card and requested a new credit card. FYI- I changed my email password and unsubscribed to a mountain load of illicit online email subscriptions that was also done against my consent that day due to my identity theft. I assumed this would resolve this credit card transaction fraud and since no payment was made by the cc company there would be no problem/ delivery. \nHowever, XXXX sent me another email asking for a new cc information and stating that the item was still waiting to be delivered. Fearing this unauthorized transaction and unknown email address- unaware of the extent of where this identity theft issue would lead, I did not respond back to their email. It did not look legit to me. There was no phone number on their email either. \nAgainst my consent, this human sized large, wide and heavy unknown item was delivered to my house on XX/XX/XXXX. This really scared me at this point because I did not know what could be inside that box. So, I called the number provided on the delivered package immediately and left voice message requesting for immediate call back and to provide return/ disposal of this item the same day on XX/XX/XXXX. This call back was never received. Then, I saw that the credit card transaction was refunded to me XX/XX/XXXX by Capital One. However on XX/XX/XXXX I received a threat email from XXXX again saying they will ask the credit card company for repayment, withXXXX  shipping confirmation of the item as proof. I also received an email from Capital one on XX/XX/XXXX saying this fraud claim was deemed false as there was insufficient evidence of fraud and I was held accountable for the alleged transaction as I benefitted from it. In a state of helplessness, I reported this to the legal authorities on the same day, XX/XX/XXXX and filed a Police report. I also called XXXX to have the box returned back to the sender but they said they could not do that for me. \nI reported back to Capital One with the police report, a detailed letter as this one, with all the proofs including my initial call record to Panduit- the company whose number was on the shipping label of the package and let Capital One know the item was still unopened and waiting in the garage so, I did not benefit from it and requested the charge to be dropped. But Capital One told me they could not do anything for me and I needed to sell the item to get my money back. I asked her for the phone number that she was receiving this calls from and I decided to XXXX it. I found that people has been complaining about this number since back in XXXX and has received lots of complaints regarding scammers and threats to people for charges that they have no idea. Therefore, I told my mom to forget about that and do not answer their calls. We then decided to request a Credit Report on her and that 's when we noticed that there has been some inquiries on her report from different institutions like XXXX XXXX XXXX XXXX, XXXX, XXXX, XXXX XXXX, XXXX, Barclays Bank Delaware and XXXX since XXXX. There is also a name, address and charges pending to a Barclays Credit Card that are totally unknown to my mom. Subsequently, My sister took my mother to the social security administration office to report the use of her social security number by somebody else and I was amazed to know that this office does not do anything at all. They did nothing, they only advise my sister to do what I have already done. Shame on them! I strongly suggest that the social security office place a note in their system so that in the event of government benefits being stole, at least, there is a record acknowledging that it was notified. I attempted to send {$130.00} from my Navy Federal Credit Union checking account to an individual located in the XXXX XXXX electronically. \n\nAfter verifying my identity to two different individuals, bank personnel in the wire transfer department started asking me a bunch of personal questions about what the money was for and how I had met the person. While I realize there are a bunch of online schemes out there ( romance, get rich quick ) and could understand a bank employee being required to inform me about them, to mandating that I disclose personal details about my relationship with anyone is a violation of my privacy and an overreach of their authority. \n\nAfter reluctantly answering her questions. She requested to send me a confirmation code via phone. I requested this to be done by email, just like I have done ever since two party verification was mandated by the bank. I was informed that it had to be done via phone for some undisclosed reason. Again if I can use this method for my everyday banking needs and to send unlimited moneys from my account to anyone I want, why is it that I have to do anything via phone for a wire transfer. After reluctantly providing this information to the banker and verifying the code I was then informed that she could not perform the transfer for me and that I had to follow the very same procedure that doing this phone verification procedure was supposed to avoid. She stated I had to file a written request first electronically and the someone would contact me about it via phone. \n\nAs I'm sure that your agency is aware of, telemarketing and phone scams are the number one threat to consumer privacy and financial security in this country. Myself and many like me combat this by not giving anyone, anymore information than they need to accomplish their job. This would also include phone numbers. Every company out there will tell you they don't sell phone numbers and they won't market to you. Then they call you under the vise of some other XXXX or give it to one of the dozens of their affiliates so they can can hound you. I hope this letter finds you in good spirits as we do not like to hear about the bad things going on in our organizations, however these items need to be brought to your attention. \n\nMr. XXXX, I understand you just recently took the role of CEO of XXXX, and worked at XXXX for over 11 years. I am bringing this to your attention because I have reached out to Comenity Bank and Alliance Data, whom owns Comenity Bank to resolve this matter and they continue to make threats and tell my attorney and identity theft protection lies that are not true about this situation. What I am seeking is your assistance to take care of this matter. I have provided Comenity Bank with all the information and also emailed the CEO XXXX XXXX, whom had XXXX XXXX reach out to me and still tell me that I opened a card with your Brand on it with their bank and I never did, I have sent documents several times, made several calls along with my attorney and identity theft protection only to get threats that they have this and that on me and that I opened the card in a store which is a lie. I just can not believe that your organization lets a bank like Comeity Bank manage its card with your brand on it and treat consumers the way that is does. I am telling you my story because you as CEO should know what this is doing to the XXXX brand. We always hear the saying if something bad happens that person will tell about 10 others and so and so forth. Well lets just say I have already advised several persons about this situation and, from the market watch XXXX isnt doing so hot, and you were hired to turn this organization around, with things like this happening its only going to drive consumers away from the brand. I do not want to seek legal action as I think we are both intelligent persons and just to let you know 11 of the 14 accounts that were opened in my name without my knowledge are closed and deemed fraud and they all had the same situation as this account. The card was fraudulently opened in my name and I had no idea whom used my information other than the accounts were opened online at the retailers website and approved. This person used my SSN, DOB, Address, a fake email address and also opened several other accounts with other financial intuitions. \n\nOn XX/XX/XXXXI mailed your organization the FTC fraud affidavit, my police report and also documents to prove who I am and that I did not open these accounts. The Items were delivered to your organization in XXXX, OH XX/XX/XXXX, and again on XX/XX/XXXX. \n\nOn XX/XX/XXXX, I contact my identity theft protection and I also provided an Attorney in Fact POA to your organization, my attorney who is handling sent XX/XX/XXXX and received confirmation as well that it was signed for and then the fraud investigation began. I was told when I called on XX/XX/XXXX that all accounts would be looked into and in good faith sent the documents to prove my case to your organization that this card was opened in my name without my consent and was not aware of. I have called several times and asked to speak to a manager of the fraud investigations department and was advised they do not take calls. My POA has also called which is my Attorney handling the case and asked to discuss the account and numerous times they have denied her access to the information. I have called again numerous times, and my Attorney called and spoke to a female whom was not helpful other than to state that they found the information and will have the POA added to the account. When I spoke to a XXXX on XX/XX/XXXX, he states he will send a escalated request to have the POA added and I demanded that after we have faxed and mailed documents 4 and 5 times that this is a little out of hand and someone is not doing their job only to find out that the paper work was just sitting on an employees desk and had not been entered into the system. If I would run the organization that I work for like that there would be some very large changes to the process to make this simpler for the consumer as well. \n\nOn XX/XX/XXXX, I filed a Consumer Protection Bureau complaint against your organization for violation of the Fair Debt Collection Act, the Fair Debt Billing Act and also being in violation of regulations E and Z of the Truth and Lending Act. Comenity Bank/XXXX has not been honest with my attorney or myself in regards to this fraud case for the Comenity Bank XXXX Credit Card. I was never notified and was never shown any information from your bank about rates and any other items had these cards were opened in my name as it is by law that you mail this information and these cards would have been caught sooner than now. Your organization has failed to provided me with any resolution and the Consumer Financial Protection Bureau received my complaint and I have responded with my feedback. My attorney also sent additional documentation to your address in XXXX, OH again with additional information showing that I never made payments on this card with the account that your bank states that I did and also statements from my current back whom I bank with shows no payments ever made to your organization. These documents were mailed on XX/XX/XXXX certified mail, and we have also faxed your organization only to find out that the documents were just sitting on an employees desk and have not been handled. \n\nYour organization should have these documents this week and my attorney will be calling in to speak with your organization and XXXX XXXX at XXXX, whom responded to the Consumer Financial Protection Bureau complaint. As I stated above your organization has been most difficult to work with and has been rude to myself and my attorney and refused to provide pertinent information to either of us. In Mr. XXXX response he also states a cease and desist letter was sent from a XXXX XXXX XXXX XXXX   XXXX XXXX. I called and spoke to XXXX who is the executive manager of XXXX XXXX XXXX and he advised me that they have no record of me ever contacting them, he verified my SSN, DOB, Email Address, and Address and stated that he has no record or documentation that I ever contacted them to settle the debt with your organization, as I never knew about that account. \n\nMy attorney also has records to this fact where I spoke to XXXX and he provided that information, I also asked what his organization does and he explained and agreed that I never reached out to them for assistance and he has not record of such account. This is providing false and egregious information to a Government Agency on your organizations behalf and also violates my privacy and United States Citizen under the Patriot Act. This account was also opened online according to the officer investigating my case with XXXX XXXX Police Department. This is a complete violation of the Uniform Electronic Transaction Act ( UETA ). Your organization also violated the Sarbanes-Oxley Act ( SOX ), when allowing someone to pose as me online with a fraudulent email address and e-sign documents that I agreed to the account and would accept the credit card and use it for purchase, which I never did. Your organization also violates the Dodd-Frank Act ( DFA ), and the Graham-Leach-Bliley Act ( GLBA ), which are also governed by the Consumer Financial Protection Bureau, the Federal Deposit Insurance Corporation, and the Office of Comptroller of Currency. \n\nI dont shop at XXXX retailers nor would I ever have a credit card with this organization with the way consumers are treated. It is unjust and unfair to the consumers such as myself whom are victims of Identity theft and I have to go to these lengths to send all this documentation and get an attorney involved as well as my credit monitoring identity theft services to deal with your organization. I have proven with all the documents that I have sent to your organization that the account was sent up in my name fraudulently and is identity theft and I dont know what other course of action but to have my attorney take your organization to court and sue you for damages, losses, attorney fees, and pain and suffering from having to deal with this issue. According to the records that I have the account had {$1300.00} from the statement that was sent to me alerting me of the fraudulent card, and It was not me and if your organization wants to go to court over that, then we will have no choice but to do so. I do not want to go this far with your organization and harm its reputation around the globe, however I will do what is necessary to protect myself and my good credit. \n\nI continue to receive documentation from your organization that payments were made and the information is very vague, XXXX whom I spoke with in the fraud department on several occasions states that payments were made and so I went to the bank these payments came from as she states and got a letter that shows that I have no open accounts with them and never been a client. I also sent 5 months of my current bank statements that show that I never made any payments to your organization as in good faith to show that this account was opened in my name fraudulently and I did not make payments on the account. \n\nMy concern is if your organization treats customer whom show that they are victims of identity theft and also that person in good faith provides documentation that the accounts are fraud and they never opened them, nor made payments what is the issue? Does your organization continue to violate laws set for by the Congress of the United States of America and the Governmental agencies that monitor banks like Comenity Bank/XXXX? This is why I filed a complaint against the organization that you head. I also received an alerts from my identity protection that your bank fraudulently placed the charge account back on my credit report again and I will dispute again. This is a complete and utter violation of the Fair Debt Collection Act and the Fair Debt Billing Act and violation of 605B of the Act, while an account is in dispute it is to be removed from credit reporting agencies. \n\nOn a personal note does your organization not have any empathy for someone like myself who has to deal with this? I also purchased XXXX & used additional service with XXXX to avoid future errors. \nThis year, in XX/XX/XXXX, I applied for a credit card but was denied due to poor credit. I checked my annual credit reports with XXXX and XXXX, which were clean. However, TransUnion would not allow me to view my credit report online. After speaking with an agent over the phone, I had to fax in personal documents, such as my social security card, driver 's license, and proof of residence on XX/XX/XXXX. I was informed that the errored accounts associated with the other individual had been removed from my personal credit file and that a new copy of my corrected report was being sent to my residence. I am requesting a coordinated interagency investigation with specificity to county/state employee credit score reporting fraud, identity theft, mail tampering, harassment, FERPA violations, and falsified financial instruments which co-signers escalated into VA backed mortgage fraud. \n\nSince XX/XX/XXXX, I have been entrapped as a secondary co-signer due to fraudulent schemes that targeted and defrauded distressed active military and Veteran homeowners, investors, and financial institutions of fees, rental income, VA mortgage payment funds, property ownership and/or proceeds from the sale of their properties.My former residential property located at XXXX XXXX XXXX XXXX. in XXXX, Oklahoma was targeted by former property managers, a straw man tenant coordinator identified as XXXX XXXX, along with county/state employed family members who repeatedly leaked federally protected confidential information and intentionally damaged my credit rating with altered reports. Occupants withheld postal mail, official legal notifications, and created falsified loan documentation in an attempt to induce residential power sales. County and state employees circumvented regulatory processes in order to influence and force foreclosure short sales under homeowner duress and repeatedly violated the congressionally mandated Service-member Civil Relief Act ( SCRA ) protections. \n\nThe XXXX County scheme involved aggravated identity theft, false representations to mortgage lenders on behalf of the out-of-state homeowners ( specifically, ex-spouses ). Unlawful VA loan modifications were provided to guarantying breach of contract XXXX Doe occupants with undisclosed violent XXXX predator criminal history and rental payments to new unsecured buyers without expressed written consent or fiduciary disclosure to the out of state owner. Damaged credit score reports further disclosed additional anomalies, vague student loan processor charges, and dozens of identical unauthorized credit applications. Significant accounting inconsistencies remain disputed between verified student loan disbursements, recent unsolicited VA funded vocational program claims, and unverified regional support charges. \n\nNeither my official divorce decree nor final court order awarding the division of real property to the ex-wife/secondary co-signer were disclosed to the financial institutions which approved and funded unlawful modifications to the VA backed mortgage.As the ex-wife, secondary co-signer, and a Veteran myself I was defrauded of funds and robbed of my good credit as a direct result of county and state employees criminal misconduct, as well as the willful negligence of the primary co-signer ( Mr. XXXX ). Over the past 72 months the VA funded schemes employed tactics which included misuse of identities, VA records tampering, and illegally amended tenant contractual agreements. \n\nIn XX/XX/XXXX, a falsified court summons was hand delivered to the out of state secondary co-signer with a watermarked red ink Service Copy stamp placed in the top right hand corner of the document. The version I received as the secondary co-signer/ex-wife contained disinformation and did not match the legally binding digital file submitted and recorded by XXXX County clerk ( open records available to the public online, for a fee ). The additional 20+ pages attached to the hand  delivered Service Copy revealed forged co-signatures with mismatched dates on multiple loans and financial instruments. The forgeries covered illegal consents to waive owner rights and altered property transfer disclosures spanning from XX/XX/XXXX through XX/XX/XXXX. Compared to authenticated original copies and contrasted by the digital county clerk, records exposed systematic fraud leading to the intentional targeting and defrauding of the ex-wife/secondary co-signer.
