The XXXX payment did not get transferred to sps until XX/XX/15 after the XXXX transfer date. Therefore, they are holding it in pending payments and that is preventing me from closing the refinance I have in place. They are forcing me into default. I just want them to apply the payment they already have that has cleared my account. This way I can move forward with my conventional refinance and pay the loan off in full. At first, I thought the transfer happened so they could give SPS the opportunity to refinance the loan, then I was told by SPS that SPS doesn't even do refinances. So, why would they transfer my loan at it's maturity date and cause these issues? During the call they indicated that my credit report showed I was currently in credit counseling ; however, I pointed out that I was never in credit counseling and that the account in question had been paid-off several years ago, to which they backtracked and realized they were wrong. XXXX also told me I had a public record on my credit report, and after I questioned her on this, she rescinded her statement and admitted there was no public record. She even admitted this wasn't the reason I was denied but she couldn't explain why she even brought it up in the first place. She mentioned my credit utilization was an issue, and also said she would look into options to ensure the loan proceeds would pay off the debt and lower the utilization, but I never got an answer on this either -- after putting me on hold she just transferred me back to XXXX, who then proceeded to try and steer me to a debt settlement service and even said it would have a bad impact on my credit, after I had already explained I was not interested in this service! The process was unnecessarily frustrating and they didn't seem to have any legitimate reasoning behind anything they were telling me. They also distributed my information to other loan companies, promising results, but no success here either and I didn't even apply to these companies! So that's when I looked online on MyFedLoan and seen where I had a message about my IDR plan that I had already submitted when they sent out a notification stating I needed to resubmit the application. The letter I had received from them stated \" We recalculated your monthly payment for your Income-Contingent Repayment ( ICR ) plan. We used your income documentation and family size to  determine your monthly payment of {$300.00} which is first due on XX/XX/XXXX. '' Now I assumed since I didn't receive anything about my IDR plan that nothing changed so I continued to pay my payment like I been doing. So to get things cleared up I called the toll free number. A lady that was super unhelpful basically told me the reason for the balance I had to pay for the {$300.00} was because I basically never resubmitted my IDR plan ( which I did I even have proof ) So she said that I needed to pay that for my IDR plan to basically get it back ( like a downpayment ) Then she as well stated that I didn't have to pay on my loans until XX/XX/XXXX XXXX possible graduation date ) due to the fact that I am back in school and my loans when into deferment ; however! I've been back in school since XXXX! I have no clue why it took them so long to process that and as well said when my loans go into deferment that they will have a huge impact on my credit score. So I still have questions about my IDR plan that I've summited before the due date, and she just keeps on telling me that I don't have to worry about any payments sine I am in deferment and KEPT on trying to explain to me what deferment meant, which already knew but she just wasn't answering anything I had an issue for. So I told her well I would like to still pay for my loans even though I am in school still that's when she sent me an email for the IDR plan to apply for which I ALREADY DID! The payment they wanted me to pay was not in my budget and I am honestly still confused and lost over the letter they had sent me about the repayment plan, plus I don't understand if my load was already in deferment then why did they send that out to me? We waited several more month and called again and were told it was still in process. Following that, our loans were transferred from XXXX to Mohela so after waiting a few months, my husband called Mohela only to be told that there was no forgiveness application on record. So he submitted the forgiveness application form again. When I went online to check on the status, it said the application was cancelled. So I called again and the rep on the phone told me it was cancelled because the name on the form didn't match any existing accounts. He looked into the issue and saw that indeed my husband 's name is attached to the loan and said it was a mistake that they didn't process the application. He said he would have it reviewed and added a note about the issue. He told me to give it XXXX business days to have it fixed but it still says that the application was cancelled. We are beyond frustrated at this point. We having been calling and submitting info for help for about XXXX years now and have gotten nowhere. The problem seems to be with the fact that my husband and I have different last names and the loan is under my name but since the loans came from my husband originally they need his employment verification ( which he has already submitted but they refused them ). Is there anyone that can actually help resolve this situation? We are now at XXXX payments out of the XXXX required ( so XXXX payments over ) and everytime this company says they are going fix the issue, we wait and nothing happens. Now we are looking at payments starting up again and will have to pay over a XXXXXXXX XXXX a month on a loan that should have been forgiven by now. We have called over and over again and can not get anyone to help. We even tried to get an administrative forbearance while they figure it out and although we were told once again that we could get one, that never happened either. Please help! Since I did not recognize that I already had a loan with them, it would not accept or even give me the ability to make my payment. I tried everything I could think of. Calling the company didn't work, it sent me to a recorded message that said there was high call volume and to call later and then just disconnected the call. It didn't matter how many times I called back, what day I called or time. The results were always the same. Disconnection and no assistance. \nI tried texting and got no reply. I tried XXXX XXXX in the app and could not get valid help to make my payment. And I email customer support which did respond eventually but kept giving me a generalized help answer which said I could change my payment date in the app. I didn't want to change my payment date. I wanted to make my payment. And since the app didn't recognize that I had a loan, not only could I not make the payment, I could not use their suggestion to change the payment date in the app for the loan it didn't show I had in the first place. I wrote them time and again informing them that I was trying to make my payments. And that the app would not show my loan or give me a way to make a payment and to please fix their app. Also I requested that since the app was not allowing me to make a payment to please inform me of any alternate means to make my payment. Perhaps via an online platform rather then the non working app or via a payment by phone with a representative as I wanted to get them the money I owed as soon as possible. \nI tried and tried for months. I finally got a response from a person that gave me other options to fix the glitch in the app rather then the constant change your payment date in the app I usually got. I followed all the suggestions to no avail and asked why since I obviously wanted to make my payment, couldn't they give me an alternate way to do so aside from the broken app which was hurting me by not allowing me to make my payments and not even showing that I had a loan. I believe the original loan was taken out in XXXX. I emailed them over and over to help me get my payment to them. But I was given no other choice than to pay it in the app that was obviously not working correctly. I also retired to connect with them via any other means I could think of including their phone number which still only disconnected the call. This was hurting my credit. Finally upon checking the app like I did regularly incase of it being fixed, XXXX day about XXXX or more months later it finally showed I had a loan with them and made a payment and again XXXX weeks later as agreed and upon making my XXXX payment was informed that my loan was past due and was being labeled as a charge off. A charge off? For what I thought. I just finished paying the full {$63.00} I owed.! And had the app worked or if customer assistance would have assisted me, it would have been paid back well before that time frame. But they didn't and I couldn't. Now, they have the loan on my credit report as late payments leading to a charge off and until recently and only after complaining to XXXX credit agencies did they acknowledge the complete amount being paid but still I says after charge off which I desperately tried to pay many many times beforehand and was met with no assistance or ability to do so. They told us they didn't know but we had to pay the taxes and that they are taking all the money out our current escrow to pay the taxes! Also that our mortgage would go up {$270.00} a month because now our escrow was delinquent. We sent numerous emails and called numerous times to try to get this resolved, they would only send us letters stating they were looking into our account and they kept extending the period of resolution. They finally reached out now and told us that they would refinance us with a lower percentage rate but are charging us {$5000.00} in fees, some duplicated from what we already paid in XXXX and then they try to make it better by saying they will give us {$2500.00} in lender credits. No matter how I look at this it just doesn't make sense or add up. They clearly made a mistake and admitted to it and now trying to get us to rush and sign the refinance paperwork. I don't know what to do at this point, I don't trust that they have our best interest at hand. We can't afford this increase and feel we shouldn't have to pay for their mistake but also feel like the refinance is just benefiting them and charging us for their mistake.David told me that his branch manager would be handling our case his name is XXXX XXXX, I have called him and he told me someone else would call me back. So then this guy named XXXX XXXX sent me an email about applying for a loan?! I called him and he had no knowledge of our account or the issues that they have caused with our escrow account! My local branch in XXXX Montana tried calling the corporate office and they could not get information provided either. \n\nThis resulted in my funds being sent back, being ineligible for a loan with a brand new non-established account elsewhere, my direct deposit from my work being returned and issued via paper check. \n\nAround XX/XX/year>, I was still receiving emails as if I were still a Chase customer and was having a difficult time obtaining an account at any bank due to being flagged with a \" BIC '', which has quite an impact on my life. Since I hadn't received a letter, I called Chase bank again. They said to disregard the emails, they take a while to stop being generated and no additional information could be provided about my account closure. He said a letter with more information was issued on XX/XX/year> however that was the letter and text date for me to contact them with additional information so no information was provided. He simply said Chase has decided not to bank with me anymore after a few years and that's all he could say. \n\nIn XXXX, I received my XXXX statement with only a few transactions up through the date of the account closure, which showed my loan funds of {$200.00} being returned ( which I already knew ), and I received a check for {$1.00}. \n\nOn XX/XX/year>, I received another letter from Chase stating the claim I opened on XX/XX/year> ( which I didn't open ) for the funds I never received for the loan transaction date of XX/XX/year> in the amount of {$230.00} had been investigated and the credits had been applied. I never received these funds, didn't open a claim and didn't even apply for the loan until XX/XX/year> ( after the transaction date on the letter ). The claim number was XXXX. \n\nI contacted Chase Bank after receiving the letter about the claim stating I didn't open it and never received the funds. She says she'll take the payment but it will cost {$17.00} to do it over the phone. Then it's {$7.00} because the website doesn't work. When I do it on the website it's FREE! She finally agrees to do it for free but then wants to apply it to the wrong loan. I have a home loan and a HELCO. She wants to apply it to the home loan which has already been paid for the month! I then call XXXX, who I had spoken with previously because of another issue. He's never available. I leave 2 messages. 2 days later and I don't hear back. I look at the complaint I filed earlier for the same time of issue and find the name of XXXX and a different phone number. I call that number. Message says that XXXX isn't available and sends be back to the Customer Service queue and it goes to someone in a foreign country AGAIN! I end up hanging up because he starts arguing with me! ALL I WANT TO DO IS MAKE A PAYMENT!!!! This is the second time I haven't been able to make payments. Every day that goes by the interest on a HELOC is continuing to add up. I really think this is a way for PHH to make additional money. If they can make it impossible for people to pay then they can continue to charge interest on the outstanding balance! With all of the loans they have this would add up to a lot of money real fast!!!!! I have had this loan with them for less than a year now, it was transferred from Ocwen. In less than a year I have had issues with payments for 4 months now. I have had issues with them and my home owners insurance. PHH claimed that the insurance policy didn't have the correct loan number on it, however, when I used PHH 's automated system it immediately pulled up all of the insurance information. At some point someone needs to step in and get these people in line or shut them down!!!! Unfortunately, the ONLY option the consumer has is to refinance and then there are all of the closing costs which must be paid so it makes it much more expensive! On XX/XX/XXXX of XXXX I sent an email about how to make sure that the rest of my loans were put on the SAVE plan once the grace period ended, and they told me that my loans would be automatically considered for the SAVE plan within 20 business days after the end of the grace period sometime in XXXX. They told me to reach back out if I hadn't heard from them by then. This was a reasonable timeline, so I complied and waited until XX/XX/2023, at which point I was told to wait until XX/XX/2023. This is where the problems started. Documentation of all email threads and screenshots of student loan repayment status from Nelnet 's website are provided as attachments. \n\nI followed up on XX/XX/2023 saying that I had entered repayment but was on the Standard Repayment and not the SAVE plan, and asked when I would be put on the SAVE plan. I received a reply on XX/XX/2023 from a different agent at Nelnet saying that I was still in the 20 business day-wait period after the end of the grace period, which was false, and also contradicted Nelnet 's own statements. I replied the same day saying there was a mistake and I was past the 20 day period already. Then I received a reply on XX/XX/2023 from another different agent that I had to apply for the SAVE plan. He told me this via a template email about how to apply for the SAVE plan, not addressing my issue at all. This was frustrating because 1 ) I had already applied for the SAVE plan, and 2 ) they did not take into account my specific situation but rather send a scripted reply that did not address my issue. I then replied the same day outlining my situation in full, and asking how I could get the rest of my loans on the SAVE plan. On XX/XX/2023, I received yet another template email from yet another agent, which did not address my issue at all, but instead was an outline of what the SAVE plan was. \n\nI started a new email thread to the same Nelnet customer service email address ( XXXXXXXX  ) on that same day, hoping that this would get a response that was specific to my issue. However, I had not received any replies by XX/XX/2023. At this point, I received an automated email on XX/XX/2023 stating that I had a {$1300.00} payment due by XX/XX/2023 ( see documents ). Apparently I had entered Repayment status on all my loans, and was on Standard Repayment for many of them. I panicked as I was on the hook for more than a XXXX dollars a month. I reluctantly decided to call Nelnet Customer Service, even though I had read on online forums that it would take 3+ hours of being on hold. I blocked out an entire day so I could get this sorted without paying those monthly pa\n\nyments, which I should not have had to pay in the first place since I was already enrolled in the SAVE plan. My call with Nelnet took over 3 hours. I was on hold for around 1.5~2 hours, at which point I was transferred to a customer agent. She told me that the only thing to do was to re-apply for the SAVE plan from scratch. It would take at most 2 months, so my loans would be put on forbearance until XXXX, which meant I wouldn't have to make payments, but I would accrue the {$1300.00} as interest every month. I was skeptical of this plan, because I didn't want to accrue that much interest, and I had been told that my loan would automatically be placed on SAVE once the grace period ended, but since the agent did not offer any other options I went ahead and did what she said. She offered me the option of applying online OR applying via the phone with her, and I chose to do it with her since I didn't trust Nelnet to handle an online application. \n\nWe spent about half an hour going through and submitting the application. At the end, I decided that I still wanted to talk to someone else to see if there wasn't another option, and told the agent this. She proceeded to curse me out for a few minutes before putting me on hold for another half hour, until another higher-level agent freed up. This last agent was somewhat helpful, as she understood my situation, but she also told me that my only option was to submit a new SAVE application and accrue the interest. This meant putting both my standard repayment loans and my SAVE plan loans into forbearance, which meant I would accrue interest on the SAVE plan loans. I would rather have kept the SAVE plan loans in repayment, but it wasn't an option. She tried to mollify me by saying that it will all be forgiven in 25 years because I was eligible for the student loan forgiveness programs. I pushed back, but ultimately was presented with no other options so gave up. After this call, I regularly checked my Nelnet account to see if my loans were put on the SAVE plan, but there were no updates. \n\nFinally, on XX/XX/XXXX, which was 2 months and 14 days later, I saw that some of my loans had exited forbearance and entered repayment. None of the Standard Repayment plans had been moved to SAVE. Many of those Standard Repayment plans had entered repayment, but the ones that had been on SAVE were still on forbearance. It was not clear why some loans were on forbearance and some were not. I assume that my agent placed me on a 3-month forbearance because she thought I would have been placed on the SAVE plan by then, but now my forbearance is expiring and most of my loans are still not on the SAVE plan.\n\nAt this point, I do not have it in me to try and figure this out with Nelnet. My loans were transferred to the Dept. of Ed / Nelnet  in XX/XX/XXXX. \n\nMy greatest issue is how/why payments were inconsistently & incorrectly applied to interest & principal, AND the incorrect loan origination dates. XXXX records have gaps in loan origination dates when my daughter didn't have any gaps in college attendance. As a result, none of my loan payments that I made in XXXX  were applied to my XXXX  loan. Instead I received an interest capitalization for the period, and payments didn't begin to be applied until 6 months later in XXXX. There are many other issues, and unanswered questions. For example, at the beginning of loan # 1 in XXXX, I paid 100 % of the accrued interest ( XXXX XXXX  ), yet XXXX charged me capitalized interest on XX/XX/XXXXXXXX  ( which is only supposed to be applied against accrued interest ). These issues MATTER because of capital compounding interest. \n\nBoth my loan servicer XXXX XXXX XXXX ( XXXX ) and XXXX XXXX XXXX XXXX XXXX  ( XXXX  ) were negligent & caused incorrect & wrongful application of interest charges/capitalization against my loans. \n\nWHY isn't there a class action suit like the XXXX student loan class action suit? What happened to me and many others with the capitalized interest & repurchasing the debt is the exact same as the XXXX case. \n\nDuring Covid-19 in XXXX  I was given nothing but misinformation concerning whether or not my loans are federal or private & whether or not I'm eligible to get the Covid benefit of interest & payment pause. It was mass confusion & it seemed that nobody knew the answer. All these years I thought I had a federal loan because that's what all of my documents say, yet during COVID I was told my loans are private & I didn't qualify for any Covid interest pause. When I inquired of XXXX as to who my private lender is since they said it's not the federal government, they couldn't explain/tell me clearly. XXXX acknowledged that they are the servicer ( which is what I thought ) yet XXXX could not tell me who my private lender is/who owns my loan. I never contracted with /borrowed from any private bank. \n\nIn XX/XX/XXXXXXXX  My defaulted loans were transferred to Dept of Ed/Nelnet servicer when Covid benefits were about to end. I received XXXX  interest pause for Covid nor during my bankruptcy from XXXXXXXX  I contacted Dept of Ed several times. For months in XXXX  I was told by Dept of Ed that they could see I was being transferred but the transfer wasn't yet completed in their system. Later when transfer was completed they said they could see my accounts but my records are now with Nelnet & they can't help with any thing! Nelnet told me to contact Dept. of Ed to resolve! \n\nIn XX/XX/XXXXXXXX  one Nelnet supervisor told me they'd look at my case to see what can be done concerning my unresolved issues, and whether I'm a candidate for loan forgiveness.. Later a different Nelnet supervisor said because my loans are almost XXXX  yrs old she didn't think anything could be done & advised me to consolidate my loans, which is now in the process. Most recently Nelnet told me that after I consolidate they could help. \n\nNelnet has acknowledged that my loans were grossly mishandled & advised me to file a complaint at studentaid.org which I did on XX/XX/XXXX. To date I still have no response to my complaint besides an acknowledgement that the complaint was received & is being processed. \n\nI re-paid $ XXXX of a $ XXXX student loan before defaulting. My loan guarantor XXXX  paid {$39.00} at the end of my bankruptcy when they finally realized I was in bankruptcy.. XXXX REPURCHASED my loans immediately the hour I finished bankruptcy & Now they want me to start over and repay $ XXXX. I defaulted & my loans were transferred to the Dept of Ed. The bottom line is : I just gave the banks $ XXXX. The banks already received $ XXXX for a $ XXXX loan & if they received $ XXXX more that means they would be repaid $ XXXX for a $ XXXX loan. Sallie Mae 's website has no way to confirm it was uploaded and when I called to confirm they said they didn't see it so I repeated this process 3 times. Finally Sallie Mae said they received in months later ( in late XXXX XXXX and that my loans would be deferred for the fall because I am in school. '' I called Sallie Mae on XX/XX/XXXX and was told that those charges were late fees that I incurred when I did not make a payment on my loans this summer, while going through that whole deferment/Clearing House confirmation process explained earlier in my response here. I asked how they could charge me late fees when I already established I shouldn't have been forced to make a payment this summer because I am still in school. They said to call back in 5 days and see if the late fees have been removed. This process of me calling about an issue and Sallie Mae saying they made a note and to call back in x days is exactly what it was like this summer trying to resolve my issue. Sallie Mae is predatory and does this constantly. The stress and time off from work it takes on a student to call them and upload documents repeatedly just to then be charged fees later is discriminatory and causes unfair hardships. My federal loans do not do this or have these issues. It's not right and the consumer financial protection bureau should do something to help people impacted by Sallie Mae 's predatory processes because there are millions of people like me who are struggling to interact with this company even though they are complying by Sallie Mae 's loan terms entirely. They find new ways to charge unnecessary fees or delay the processing time period for students submitting documentation. I am not asking for my student loans to be forgiven or trying to dance around rules or regulations regarding repayment -- I am simply asking for this company to be forced to follow the very guidelines they set in their loan repayment terms I signed. That is is the first issue, why did they only take the older ones ( about XXXX prior to XXXX ) and not the latest ( about XXXX that are post XXXX )??? NOTE : the consolidated ones went to MOHELA and the rest stayed with XXXX. \n\nBefore they took the consolidated loans right away they said I didn't qualify for the SAVE repayment plan and gave me some other one. Which from last year 's income my income has dropped from {$50000.00} annual to this year will be around {$35000.00}. My XXXX  union rep said I should have qualified for the SAVE. \n\nI need to mention that the PSLF application is still in Review at this point but my current ( which is my former employer ) XXXX  did not provide the verification of my employment dates ( past or current ). \n\nNext, Around XXXX or XXXX I start to get notices that I am in Repayment and the payment is around {$190.00} a month from MOHELA. I spoke with him again later that day and again asked for the loan estimate so that I could better compare one lender to another. He gave me the same response and frustratingly told me that he gave me everything I needed over the phone. In speaking with other lenders, they informed me of the 3 day rule that he would have to provide me the loan estimate within 3 days of a live application. I had provided him with everything including an address of the home I was buying so this would qualify. Therefore, I called him back the next day and again asked for the standard loan estimate that everyone uses. He replied \" I've told you everything, what else do you need to know? '' I insisted and he replied that he would try. Later that day, I get an email of an XXXX worksheet ( with someone else 's name on it ), not a legitimate loan estimate. I didn't hear from XXXX so I sent him an email. I also called the owner, XXXX XXXX, that morning. I left a voicemail stating I have a concern and I asked him to return my call. In the afternoon, an agent named XXXX called me and stated that his manager XXXX had received an email from me about feeling dissatisfied. I thought this was unusual because I never emailed XXXX nor do I know of her. I asked XXXX for my loan estimate and he told me the same thing that XXXX said about putting down the deposit first. I told him about the 3 day rule and he stated \" it doesn't apply to this company ''. I said it's a federal rule so of course it applies. I said I shouldn't have to pay to see my loan estimate. He tried to reconcile this by saying he won't charge me but he would like to take down my credit card number. I refused, stating I shouldn't have to do that either. He ignored me and proceeded to ask me about the home price, loan amount, etc. I went along with it for a little while until I asked why he was asking me all of this information that's already on my application. He stated he didn't log in so he did and then he tried to entice me by offering me a low rate. He totally dismissed my concern by trying to move on to other things so I said \" you are not listening to me and that I would like to speak with the owner ''. He said \" feel free '' and we hung up. I had already left a message for the owner ( XXXX ) that morning so I decided to wait patiently. I have yet to hear from him. \n\nI then emailed XXXX to let him know that I do not feel comfortable proceeding as he kept dodging my request for a loan estimate. He replied \" This is the standard worksheet we use here after having phone conversations like the ones we had for 2 days about rates, costs, escrows, points, lender credits, rate lock expiration, procedures and cash to close etc.. After customers agree to submit ; we take a deposit and that is what generates another detailed loan estimate within 3 business days. '' I find it interesting that he said \" another '' detailed loan estimate when he never gave me a loan estimate to begin with. He simply provided a worksheet like you would for someone who is looking but doesn't have a home yet. \n\nI feel this company has very shady lending practices. My initial reason for suspicion was that they quoted me a total lender fee of {$690.00} and then gave me a lender credit of {$890.00}. The reason he gave me the credit was because I was locking within 45 days at a rate of 2.875 %. Essentially, there are no lender fees at all ; just third party costs. In addition, their attorney fee is {$500.00} ( usually it's {$750.00} ) and the title search fee was free ( usually it's {$250.00} ). I told him that sounds too good to be true and how are they making money and he said \" it's their secret ''. I was getting the statements they didn't make sense as far as the balance but was told just keep making the payments so I did. I get an email 2 days ago stating we will be moving forward with the foreclosure. Why? According to my records I have paid {$26000.00} on a {$25.00}, XXXX debt. They claim, I didn't keep my end of the plan but like I said the statement are confusing with all these unapplied payments, I'm sending money faithfully but they are not applying to my debt last week I got a check back, however the money is in limbo because it comes from my bank and the deducted from my account. How can a debt collector refuse payment, no matter how much it is? Do they want the debt satisfied or not? Is that legal. In the meantime I called my Financial Aid to ask when the loans would be disbursed ( for my classes ), I didn't want there to be a problem and the new ones not be counted. I say this because two weeks ago I received a letter from the XXXX XXXX office ( the office of the Department of Education that deals with these requests ), and I didn't see the new Summer loans there and so I wanted to do my due diligence and make sure everything was in working order. My FinAid office assured me it would be fine and that the funds have been sitting in my account for a while now, it was just a matter of waiting for all my professors to put in their grades. Only then would the funds get dispersed and reflect in the Department of Education 's end. This is how XXXX holds their student accountable - it was school policy. Unfortunately, one of my professors ( I took 3 classes ) didn't put in her grade till last week. Also late last week is when I saw that my past loans got XXXX as well ( which was amazing ), but without the finals loans being counted in ( {$21000.00} ). They could not get disbursed prior to, due to school policy, not because I wasn't approved or because they were not requested. The wrongfully denied my mortgage assistance stating the reason was I did not reside at the property. That is false. I was told to dispute it and provide utility bills. I did that. I then received a letter stating I had been granted a forbearance. Not what I had applied for but that is what they had approved. The forbearance was granted and set to end XX/XX/XXXX. On XX/XX/XXXX, I called Carrington and their employee gave me the amount due to be current. They set that up for ACH with my bank to be transferred on XX/XX/XXXX. The amount was {$17000.00}. That was processed and taken out of my account. XX/XX/year> I received an account reinstatement notification. It states I owe a total of {$23000.00} by XX/XX/year>. This amount includes {$150.00} for late charges, {$1300.00} in corporate/expense advances, {$30.00} paid unrecoverable, {$25.00} unapplied funds credit, plus {$21000.00} in mortgage payments. They took my {$17000.00} on XX/XX/year> that they told me would make me current and did not apply it and are now telling me they mailed a check back on XX/XX/year> for that. However, today I received a letter from them, dated XX/XX/year> and still have not received the check they supposedly sent back two days prior to this letter. Today I spent two hours on the phone asking for an explanation regarding them processing the ACH prior to the deadline of my forbearance expiring, yet not applying it to my loan and now requiring me to wait to receive my money back, while applying fraudulent penalties and fees, and giving me a deadline to send the money back to them that I haven't received back from them to begin with. They have crossed so many lines at this point. The entire process started with wrongful foreclosure when they immediately would not accept any payment in good faith. Then following that, they wrongfully denied my mortgage assistance. After they advised me to dispute that, they still proceeded with the foreclosure process, after telling me that would stop it. After I accepted the forbearance, they will continue with the foreclosure. Even after calling to get the amount to be current and setting up the ACH with them, that they successfully took, they are still trying to pursue penalties for foreclosure. They are not trying to charge unauthorized fees. Late fees when I tried to make multiple payments and continue to be denied to make a payment. I also abided by their terms of the forbearance and in order to try to collect additional, fraudulent fees, they are returning my payment with no explanation. They only explanation is that they want it to appear as if I didn't meet that deadline so they can proceed in the foreclosure process as well as apply additional penalties. They are also clearly mishandling payments. ONLY after calling XX/XX/year>, was I told they are mailing that payment back now instead of applying it and making my account current. In addition to that, now I must WAIT to get MY money back that I already sent them once, so I can set it up as a wire now with additional fees applied. \nAnother form of mishandling is not letting me make a lesser payment amount when it initially became past due to get it caught back up before all of them even transpired. \nThey have failed to follow loan modification agreements as well. They forbearance was approved by them. They provided the terms and expiration date of XX/XX/year>. I abided by those terms successfully. \nI am also being discriminated against. This is an FHA loan, section XXXX, XXXX XXXX XXXX. My loan did not originate with Carrington. It was sold to them. I have documented every person I have spoken with at Chase, their employee number and all details of this assumption process, so I have a very transparent case if details are requested. I am requesting that they give a more reasonable explanation for why they are delaying the process, other than my gender. The escalations department at Chase Mortgage has been ineffective at oversight of their own assumptions department.
