When contacting your company, I was directed to a Mrs. XXXX XXXX who told me that WaterStone Mortgage has a strenuous process for FHA loans to be reviewed under and that the information that I was suggesting was totally false. I was also told at the time that the loan was purchased on the second market by XXXX XXXX and if I had further concerns about the validity of the loan, to contact them. Mrs. XXXX firmly stated that the problem was for WaterStone Mortage to resolve. I have pursued XXXX XXXX and have spoken to senior management regarding this serious allegation. They emphatically state that since WaterStone was the company that originated the loan and the supposed fraud took place at the origination of the FHA loan, it is solely the responsibility of WaterStone Mortgage to investigated the fraudulence, since it occurred under their governance. The facts are as such ; the entire comparison set of dwellings used to support the FHA funding are completely false. If one carefully examines the appraisal in question, the dwellings used for comparison are of an entirely different construction structure that that of the home that the FHA funded through XXXX Mortgage. The home located at XXXX XXXX XXXX XXXX, Iowa is categorically a SPLIT - FOYER classification of dwelling when illegally compared to single and two story homes commanding an entirely different price set than a split - foyer property. The financial loss here is quite significant. In the year of funding the property ( 2019 ) the entire Iowa county of XXXX home sales, clearly shows dwellings that have closed escrow in the range of {$100000.00} to low to mid {$200000.00} range when this dwelling was funded for {$340000.00} resulting from WaterStone Mortgage and their negligence, by clearly overlooking this enormous error. There could be no defense on the part of WaterStone Mortgage other than to admit the lack of oversight on the part of WaterStone Mortgage solely. Why would XXXX XXXX be at fault, when the loan origination took place solely by WaterStone Mortgage. Why would the fault of the federal crime be viewed anything other than neglect? Simply, the laws for an FHA certified appraisal are the compliance of a comparison study of like for like dwellings, not those of a completely different construction, as is shown in my appraisal that WaterStone Mortgage gave their blessings to and wrote-off on to be submitted to the FHA for federal government funding. The aforementioned dwelling has been on the real estate market in XXXX, Iowa for 18 months with not one valid offer. A town appraiser said that the unstable barn should never have been counted in the property appraisal either, as it was an expense, not an asset. \nI am dealing with Wells Fargo/ASC as the servicer. This loan originated with XXXX XXXX, whom was subsequently delisted by the XXXX in XX/XX/XXXX, filed a Chapter XXXX Bankruptcy and became subject of a federal criminal investigation. I was not aware my loan was never assigned to a static entity by the originator within the legal 90 days stated in the IRC for REMIC loans. XXXX XXXX never owned the note or title, they were only a broker, yet XXXX supposedly acting on their behalf, assigned my mortgage in a very untimely manner, which is still against the law. Suddenly an assignment of my mortgage was made almost 4 years after origination in XX/XX/XXXX, after I filed for bankruptcy. I had to file for bankruptcy because of the predatory loans and the banks unwillingness to assist me. The first assignment took place in XX/XX/XXXX, but my mortgage originated XX/XX/XXXX. The broker, \" XXXX XXXX, '' submitted XXXX subprime XXXX loans as owner occupied mortgages, which is also illegal, and is also a part of the fraud at origination. Both of my properties went under water during the housing crash, and the rents on the income property went way down and could no longer cover the mortgage of that property. I also lost a long term partner and his income during this time. The servicer would not work out any fair modifications and the loan was exuberantly unaffordable, especially as they continued to add fees and fines. XXXX continued to assign the mortgage 2 more times by changing wording on each assignment, for a total of XXXX assignments which is also against the Internal Revenue Code law within REMIC loan rules. The Attorney General in Massachusetts ( XXXX XXXX, at the time ) brought a class action suit against XXXX XXXX for several illegal practices of the sub-prime lending scheme that were directly connected to XXXX. These illegal practices harmed homeowners, small investors and the economy. XXXX XXXX had to make payments to the servicers to assist homeowners to reduce their principal and make the homes more affordable. They also had to pay out to small investors whom were harmed as well. In my case, I won {$64000.00}. Barely, if any of this money was applied to my principal, instead it was applied to arrearages, fees and fines.. it was not used to assist me as intended, it never did reduce my loan or make it more affordable. After trying to work with Wells Fargo/ASC on many occasions, I finally gave up, as they had no intentions of helping me in any way and the modification department was always rude to me and still is today. I spoke with 2 Shellpoint professional and helpful representatives. I explained the situation and the first representative took information to see if we qualified for loan modification, but couldnt let me know until Tuesday XX/XX/XXXX. I also find out this house was in foreclosure twice in XXXX and XXXX. I also found out you don't have to go through the foreclosure procedure you can put it in without notice or Sale Date. Bank of America went back and forth between BAC and them. In XXXX my husband was bringing home {$7000.00} dollars a month. I was bringing home {$3000.00} a month. One year BOA didn't send us a Federal Government Mortgage Interest Document. Then the next year they sent a statement and it was double. It was doubled to around XXXX. XXXX saved us. BOA was coming at us from every direction. I have XXXX XXXX XXXX XXXX and both were active. I had XXXX in XXXX places in my body and didn't know it. I knew I was sick, but I didn't have time to care for myself until it was almost too late. Bank of America came at me and my family Hard. We have never missed a mortgage payment. The home portrayed in the report are an entirely different category of structure assuming a far greater value than the home that was funded.I have tried to alert LakeView-XXXX of the fraud that took place, many times calling several times a day to be connected to many various individuals such as supervisor after supervisor in many different departments, yet to no avail. I am just told they have never heard of such an instance before and can be of no help. The financial loss here is exceptional. I entered a lease purchase for this home putting {$20000.00} as a down payment. Then I paid over one years time another {$42000.00} in monthly payments spread into a 13month payment structure. Then the FHA funded {$340000.00} in the complication of the said loan. This totals {$400000.00} when the home value should be in the {$200000.00} range, when compared to the comp set of XXXX XXXX for all of XXXX County where the home is located. As of XX/XX/XXXX, before my knowing of this fraudulent event, I put the home in forbearance with LakeView-XXXX. Lakeview Mortgage owns the loan, XXXX services the loan. The forbearance is now to conclude next month in XX/XX/XXXX. The home can not be sold for what the FHA is owed. I am at a total loss here as to what to do. The assignment to the new current investor/lender ( XXXX XXXX ) would have to be from the Owner, XXXX, not the alleged Note holder or servicer ( Bank of America ). He used the last 4 of my social and DOB in order to find the account.\n\nI called back and spoke with a woman, who did not listen to a word I said from the opening of the call, I completely explained the situation, primarily that I wanted to comply with reporting the fraud to the police but that I needed more info in order to effectively do so, given that in order to file a fraud I would need to know the place where the fraud occurred so that I could contact the nearest police department, she responded saying that if it is a fraud that I need to file a police report ... She also mispronounced my name after I had just told her my name which was a nice touch. I requested a XXXX at this point explaining that laws have been violated on there end and that I would be filing a complaint through the CFPB. \n\nAt this point I spoke XXXX, who claimed to be a supervisor, He said that the woman I spoke with had explained to him what was going on and asked me to further elaborate, I asked what part he needed further explained and he began to go into telling me again that I would need to file a police report, I again explained that I need more information for filling the police report, being that I work in the industry and am very familiar with the process of a consumer being able or not able to file a report given the lack of information. He said that he can not provide me with information about the account in my name because I told him that it was a fraud. RESPA places a a section destined to protect the consumer and it is : MORTGAGE SERVICING TRANSFER DISCLOSURE, IT EXPLAINS THAT i SHOULD HAVE HAD, A WRITTEN NOTICE 15 DAYS PRIOR TO THE TRANSFER. \n\nWells Fargo has avoided my direct complaint, explaining that I signed a contract and that I knew all the facts. I received the offer letter, accepted the offer, submitted all required information and was simply waiting to move forward as usual. Their next email stated that they had an affidavit with my signature claiming identity theft against the mortgage loan. \n\nI then asked them to tell me the date or produce the document in question so I could look into the matter. The following day my recruiter was told I was ineligible for the role after I accepted the role. \n\nThe document they shared is dated XX/XX/XXXX. \n\nBack in XXXX, my realtor referred to a credit repair professional that sent me to XXXX to open an account that would kickstart a credit repair process to remove a few negative items or dispute any fraudulent or inaccurate reporting. I made a partial payment of roughly {$1000.00} upfront with the remainder to be paid during the process. \n\nAfter receiving the affidavit from XXXX I contacted the realtor about this issue. He provided the name of the individual he referred me to and I contacted them. XXXX, FHA Case # XXXX ) clearly identifies the property as a single-family residential home. \nThe later Manufactured Home classification recorded in XXXX XXXX was falsified and unauthorized. \n\nAfter closing, the loan was transferred to XXXX XXXX but all original fraud, forgery, and document manipulation occurred under Broker Solutions Inc. dba New American Funding during the origination and closing process. \n\nFraudulent Loan Transfer to XXXX XXXX XXXX XXXX XXXX Fraudulent Loan Transfer to XXXX XXXX XXXX XXXX XXXX : On the same day of closing ( XX/XX/XXXX ), Broker Solutions Inc. dba New American Funding executed a paper-only transfer of our FHA-insured loan to the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX through a forged Allonge to Promissory Note. \nThe document, signed by XXXX XXXX as Assistant Secretary, was neither notarized nor accompanied by any legitimate HUD assignment ID or authorization code.\n\nThe phrase Without Recourse on the document indicates that this was not a true sale or legal assignment of the loan, but rather a simulated transfer designed to conceal internal manipulation of loan and title records.\n\nThis transaction occurred before the official recording in the county ( XX/XX/XXXX ) proving that the transfer was premature and fraudulent, as the original property title had not yet been lawfully recorded. \nThe coordination between XXXX and XXXX shows an organized effort to disguise post-closing forgery, including the falsified manufactured classification and the fraudulent use of a Power of Attorney that had already expired under the 120-day limit. \n\nOn the same day of closing ( XX/XX/XXXX ), Broker Solutions Inc. dba New American Funding executed a paper-only transfer of our FHA-insured loan to the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX through a forged Allonge to Promissory Note. \nThe document, signed by XXXX XXXX as Assistant Secretary, was neither notarized nor accompanied by any legitimate HUD assignment ID or authorization code.\n\nThe phrase Without Recourse on the document indicates that this was not a true sale or legal assignment of the loan, but rather a simulated transfer designed to conceal internal manipulation of loan and title records.\n\nThis transaction occurred before the official recording in the county ( XX/XX/XXXX ) proving that the transfer was premature and fraudulent, as the original property title had not yet been lawfully recorded. \nThe coordination between XXXX and XXXX shows an organized effort to disguise post-closing forgery, including the falsified manufactured classification and the fraudulent use of a Power of Attorney that had already expired under the 120-day limit. \n\nHowever, the lender and its affiliates manipulated and forged several documents that were recorded in the county on XX/XX/XXXX, including altered pages, forged notarizations, and a false classification of the property as a manufactured home. \n\nThe lender misused a limited 120-day Power of Attorney to create and record a fraudulent Manufactured-Home Power of Attorney in the county on XX/XX/XXXX, and immediately after that, recorded multiple Deeds of Trust under that false authority effectively removing our ownership rights and control of the property. \nThis was done without our knowledge or consent. The property is a permanently affixed single-family home on purchased land, not a manufactured or leased property, and is clearly recognized by FHA as a single-family home.\n\nThe Affidavit of Purchasers was also forged. The original 3-page affidavit signed on XX/XX/XXXX was later replaced with a 4-page version. The added page included a California notary seal where WA XXXX XXXX had been crossed out, while witness signature blocks remained blank. \nAt closing, XXXX XXXX refused to give us copies of our signed documents, saying they would send everything to the closing department. We never received any copies, which allowed several days ( XXXX XXXX XXXX XXXX for them to alter or replace the documents before recording. \n\nThe XXXX XXXX  also committed fraud by staging a false service of foreclosure notice. \nThey claimed that service occurred on XX/XX/XXXX via certified mail and personal delivery, but I have photo and video proof showing that on XX/XX/XXXX, a man entered our driveway, taped three pre-prepared notices on our side laundry-room door ( not the main entrance ), took a quick photo, and left within one minute without knocking or speaking to anyone.\n\nI discovered the notices two days later by reviewing our security footage.\n\nAdditionally, we received three foreclosure notices mailed from three different addresses one from XXXX, WA, another from California, and another from XXXX XXXX all with the same date. \n\nAll of this shows an organized and coordinated fraud involving Broker Solutions Inc. XXXX XXXX, XXXX XXXX, XXXX XXXX, Loan Officer XXXX XXXX ( XXXX  # XXXX ), and real estate agent XXXX XXXX ( XXXX # XXXX ). \n\nAfter I filed a civil case in XXXX XXXX XXXX XXXX against these parties, my husband and I began receiving harassing No Caller ID phone calls, which appear to be attempts at intimidation. \n\nI request that CFPB and HUD OIG immediately investigate these acts of federal forgery, post-closing manipulation, and fraudulent foreclosure, void all falsified instruments, halt any pending sale or transfer, and protect me and my family while the investigation is ongoing.\n\nOriginal Loan Information : The original FHA loan number under Broker Solutions Inc. dba New American Funding is XXXX ( FHA Case # XXXX ). \nThis loan number was later changed by the XXXX XXXX XXXX after a questionable transfer, but all original documentation, fraud, and forgery occurred under XXXX during origination and closing. \n\n\nAttached evidence includes : Forged Manufactured-Home Power of Attorney Altered Affidavit of Purchasers.
