Falsely Claimed Debt Validation and Continued Collection in Violation of FDCPA Complaint Narrative I am submitting this second complaint against ProCollect Inc. due to the companys failure to comply with federal debt collection laws and for misrepresenting compliance in its response to my prior CFPB complaint.\n\nProCollect Inc. previously claimed that it mailed proof of the debt to me on XX/XX/year>. However, ProCollect has never provided any documentation that satisfies the validation requirements under the Fair Debt Collection Practices Act ( FDCPA ), including but not limited to : No copy of any contract bearing my signature No proof of assignment or chain of title No documentation demonstrating ProCollects legal authority to collect No itemized accounting from the original creditor Merely asserting that documents were mailed does not constitute validation under FDCPA 1692g ( b ). ProCollects response to the CFPB contained no description of what documentation was allegedly provided and therefore constitutes a false representation of compliance.\n\nFurthermore, ProCollect improperly attempted to shift the burden to me by stating that I had not provided proof that the debt was invalid. This is a misstatement of law.
