I sent the paperwork, but to no avail. \nSo XX/XX/XXXX, I contacted Essex Mortgage and asked them why did my payment got up another {$200.00}. They told me that something changed. I advised them that my insurance did not go up and I am tax exempt. I tried to go and refinance my home and try to get XXXXXXXX to help me with that.. what they uncovered at XXXX XXXX was that mortgage company took out a second mortgage on my home to cover the past due payments. I did not agree to that nor did I know that they were going to do that to me.. here we are present day and for the past couple of months because of bad weather with snow, tornado destruction and my companies lack of loads because I am a truck driver. My hours have fell short, and my checks are even shorter. I am also going through a separation and a divorce from my wife. With all of this, I have several times tried to reach out to this mortgage company often staying on the phone about 45 minutes waiting on someone to come to the phone to help me for the phones to get disconnected. No one respond back through email they call or claim to call and Leave me a voicemail send they called but my phone never ring me reaching out to them via email asking them to call me from a different number or provide me with the number they are calling so that I can at least save it in my phone. They denying that me trying to tell them can I please send in partial payments just to show that I am trying to pay you guys for them to tell me that was declined, me asking and begging them to set up some type of deferment or some type of push to the end of my loan payment to keep me from going behind. They denying that me setting up XXXX emails requesting to have a conversation with them only for them to set up a time and not fulfill their promises. I am getting nowhere with them and at this point right now my account is showing delinquent by a large amount that I really dont have, I have been trying to ask for help. I have been praying for help and it seems like to me no one wants to help and it is not fair that you asked for help before it gets to this point no one wants to help you and then once it gets to this point, its like nothing they can do, so I am just looking for help. I did not discover the late payments until I applied for a loan to try to get caught up on my payments. And when I attempted to contact Essex Mortgage several times about my account there was never any answer, just an automated recording that stated my call was being placed in a queue and someone would follow up. I NEVER received any courtesy call from Essex Mortgage / Data Mortgage Inc . \n\nFurther, when I did finally speak with someone, I was assured that my account would not be reported to any credit bureau agencies while the account was under a financial hardship, and they did just the opposite. I have made several attempts to get these NEGATIVE inquiries corrected, and have had no success in doing so. Essex Mortgage continues to state that these inaccuracies are accurate, but they are not!! My account was in a 12-month forbearance, and when the 12-month forbearance ended, the account went back into forbearance. While the account was in forbearance, I received assistance from the XXXX  XXXX XXXX, who made payments on my account, which should have kept my account in a Positive status. After, the forbearance ended I was put on a REPAYMENT PLAN, where I was to make THREE consecutive payments before my account was to be considered for a PARTIAL CLAIM. I immediately started making the monthly payments as required, but because the first payment under the REPAYMENT PLAN was not made on the 1st of the month, ( but was paid before the end of the month and moreover, before 30 days of the next month ), it kicked me off of the REPAYMENT PLAN, and automatically went into \" LATE '' status. However, NO ONE from ESSEX MORTGAGE EXPLAINED THE REPAYMENT PLAN PROCESS TO ME, nor DID ANYONE contact me DURING THIS TIME TO NOTIFY ME THAT MY ACCOUNT HAD BEEN TAKEN OFF OF THE REPAYMENT PLAN. In speaking with HUD counselor, they asked why did Essex give me a letter informing me of start and end date of forbearance. When i asked them about it they said, it's up to them if they want to send one out. As the buyer i have a right to one. now a new year has rolled in my forbearance is scheduled to stop end of this month which means payments will be due again. they talked about the partial claim for after this 6 mos forbearance, that i could have a partial payment of around $ XXXX but we never discussed that that would be the route I was taking. We are in a new year now if I wanted to extend forbearance i should be able to do that but they are deciding for me what needs to be done and i'm the buyer. i did XXXX search on them and i can see alot of people have issues with them. the customer reps are rude and nasty. on XX/XX/XXXX, i received an email saying the following : Urgent : Return Your Documents. They had the forms attached to the email. this is the very first time i heard of these forms and them wanting me to complete them. This email didn't have the amount of time that I had to return the forms at all. The email did state this : If you haven't received the documents or have misplaced them, worry not! You can download them directly from our secure online portal. Simply log into your account at www.essexmortgage.com/myaccount, and you'll find the necessary forms readily available for download ... ..After so many months of being behind they disable the online portal so you can't login so there was no way that I had any knowledge about these forms. The system is not setup to send me notifications when and if documents are uploaded in the portal. By me not having access to the online portal I had no knowledge about these forms. These forms were dated XX/XX/XXXX. I first found out about them XX/XX/XXXX in an email, then the hard copy came in the mail about 4 days or so later. I saw the XX/XX/XXXX date, called Essex to inquire about the XX/XX/XXXX date and why am i just getting these documents. i also asked them when they mailed them, they said they didn't know when they mailed them but that i had 30 days to get them back to them if i wanted to be approved for the partial claims because forbearance ends end of XX/XX/XXXX for payments to resume beginning XX/XX/XXXX. I said 30 days?? I just got them and that I thought i had more time being that they only let me knew about it first on XX/XX/XXXX via email. they advised me it doesn't go by the date i received the forms but when they actually created the forms and that it is business days and not calendars minus the few holidays. according to them this would give me till XX/XX/XXXX to have the documents into their office. i was told because i live in XXXX XXXX i had to have XXXX witnesses and that the notary would serve as XXXX witness. when i asked if i could use an additional notary as my XXXX witness they told me no they would not allow it. i don't have any family here and the neighbors i don't really know enough to have them in my personal business like that. so i was needing that extra time i knew i was supposed to have being that i first received them email on XX/XX/XXXX and then hard copy about 4 days later in the postal mail. so i didn't make their deadline which was totally unfair to me no having the full 30 days to get that back to them. it's like they are trying to setup me so they can take my home. they are deciding for me which financial product i can get instead of letting me decide which one i wish to get. this is not right nor fair. it seems to be unfair unethical practices taking place here. they have no right to tell me i have XXXX business days to get these docs back to them when i never received them til XX/XX/XXXX and later than that in the postal mail. i will not allow them to take my home and will take every measure to keep that from happening. The document about \" information on avoiding foreclosure they send with loan documents each month if having financial problems clearly states that our options available to use if we are having a hardship. I received my seller 's statement, and noticed numerous payoffs, most of which I was aware of, but XXXX in the amount of {$29000.00} that I was not aware of. I was also told that since the payoff was through HUD that I would need to contact them for further information. When I contacted HUD, I was told that Essex Mortgage would have filed a claim for a specified dollar amount determined by them ( Essex Mortgage ) to cover the missed mortgage payments, therefore I needed to reach out to them for further information. The company has discontinued submitting documents through email or fax, now they only using XXXX to submit packages and missing documents. After XX/XX/XXXX, I found out that I was missing some documents out my package so I got the missing ones and tried to login to the website but I received a error message saying that my account was locked and I needed to contact support. I sent a message to support but I didn't received a message back. I was calling the mortgage company every other day and letting them know that I still couldn't access my account to submit my missing documents. Then they asked to do the forget tab but still didn't happened till this day, Therefore I missed the cut off date for the missing items because I couldn't access the website. They mailed me another package and I called to make sure that I had all the required documents, I explained the problem that I kept running into whenever it was time to submit the documents on this XXXX XXXX  website ). I was given two different numbers for customer service for the XXXX but I still couldn't get any help or I wasn't able to access my account. That customer service rep told me that I could use the email or fax number if I can't access the website due to that more than five clients are experiencing the same problem with this website. I attempted to send a fax as well as send a email but both wasn't successful. Therefore, I missed another cut off date, so another package out to me so on XX/XX/XXXX I called and explained that I didn't want to miss my next cut off date so the rep told me to mail it, so the package was mailed off but it wasn't until XX/XX/XXXX but everyone knows that on XXXX the post office is closed due to the holidays. Therefore I missed another cut off date, the last package that I received I have to get proof from my moms bank and she had to fill out paperwork because she give me the money for her bills and I pay them out my account, I also put another package in there just incase I missed the cut off date again, I had a missed called from the mortgage company due me at a doctors appointment and I was speaking with the doctors. I called back and they said the last package never came which I mailed it off the first Wednesday of XXXX and it was supposed to be received way before the XXXX of XXXX the package wasn't scanned into the system until after that date and it a false report was given saying that the XXXX payment wasn't enclosed the package which it was and the amount on it was {$420.00} and I placed it behind my mom 's bank statement. This was the reasons that closed my case the last time and I'm having to redo the entire again which isn't fair because someone refused to do their job and my house in foreclosure because of the actions of this company making changes that doesn't give a clients more ways to submit documents if one source doesn't work and others not taking the time to scan in packages before the cut off dates.
