The cashier submitted my information to CrossCheck, Inc. to verify my check was valid. The response from CrossCheck, IncXXXX indicated the check number had already been used and the check I presented was not valid. ** I immediately contacted my bank to determine if there were any problems with my checking account or checks. The bank responded by telling me the check number had not been used, there were sufficient funds to cover the personal check, and there were no restrictions or limitations on my accounts. ** The cashier submitted my information to CrossCheck, Inc. again after I verified with my bank the check was valid. The cashier and I verified the information submitted to CrossCheck, Inc. contained no errors. Again, the CrossCheck, Inc. response indicated the check was not valid and declined the check. ** I called the CrossCheck, Inc. phone number for consumers/checkwriters, ( XXXX ) XXXX, to see why my personal check was declined. The number is simply a recorded message. The checkwriter can leave a phone message with their information but CrossCheck, Inc. takes up to15 days to respond. I then contacted Customer Service, ( XXXX ) XXXX ; however they will not talk to checkwriters. There is no representative a checkwriter can speak to determine why a check was declined or correct false information in a timely manner. There is no other timely method to contact them and determine the problem or corrective action. CrossCheck, Inc. is not accountable to consumer/checkwriters. See attachment 1 for CrossCheck, Inc. contact information. ** As a result of the declined check, I was unable to pay for the vehicle repairs with my personal check and retrieve my vehicle. The consequences of frivolously declining a check can be significant. I am fortunate I was in my home town and not traveling where I may not have had any resources. ** I followed up this event by requesting an annual credit report from CrossCheck , Inc . The CrossCheck, Inc. report stated that no negative data regarding me or my check writing history was found and that there was no negative data associated with me in Cross-checks data base. I can confidently conclude the information provided by CrossCheck, Inc. to my XXXX dealer regarding the validity of my personal check was false and misleading. See attachment 2 for a copy of the credit report. ** A review of the Consumer Financial Protection Bureau, Consumer Complaint Database ( www.consumerfinance.gov/complaint ) shows many complaints against CrossCheck , Inc . I have attached the consumer narrative of two complaints that are similar to mine. See attachment 3. Many of the complaints do not have a consumer complaint narrative that the public may view so I can not determine if there are more complaints similar to mine. I would guess there are many more complaints similar to mine that could be viewed by your office. XXXX The XXXX XXXX XXXX database shows a number of consumer/checkwriter complaints against CrossCheck, Inc., also. ** Conclusion : CrossCheck, Inc. provided false and misleading information to my XXXX dealer that indicated my personal check was not valid. My personal check was not accepted by my XXXX dealer as a result. \nMy personal check was valid based on my contact with my bank, my personal knowledge, and the CrossCheck, Inc. credit report. I have an excellent record of paying debts on time with valid checks. \nCrossCheck, Inc. does not have a timely process for correcting false information on checkwriters. In XXXX, Congress passed the Debt Bondage Repair Act, forbidding consumer reporting agencies from including negative information related to XXXX XXXX XXXX XXXX in consumer reports. \n\nA consumer reporting agency may not make a determination based on the validity of the facts or circumstances in the consumers XXXX documentation submission. According to the Fair Credit Reporting Act ( FCRA ), a national consumer credit reporting agencys role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the furnisher of the information or the vendor that collected the information from a public record source, such as a court or other government office, notifying them of the disputed information and disclosing all relevant information regarding the consumers dispute. In order to help resolve the consumers dispute, Experian will review all relevant documents submitted by the consumer with the dispute and will forward such documents to the furnisher if Experian is unable to resolve the issue based on those documents. Consumers may also contact creditors directly to dispute items reported by the creditor. If the issue is not resolved, then the consumer credit reporting agency must offer to include a consumer statement on the personal credit report. When you dispute the accuracy or completeness of information on your personal credit report and tell us specifically why you believe the information is inaccurate or incomplete, we process your dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the item you disputed, and report back within 30 days of the date that we received your request ( 21 days for Maine residents and 45 days for disputes of information on an annual free credit report ). We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or can not be verified, we then delete that information, or modify that information, as appropriate, based upon your dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as you have requested or delete the information, and send you the results. In some instances, upon reviewing your credit file and any relevant information you have submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher or the vendor. After we complete our processing, we send you the results. In addition to your right to dispute information in your credit file with the credit reporting agencies, you also have the right to dispute information in your credit report directly with the furnisher of the information. A national consumer credit reporting agency stores information from credit grantors, collection companies as well as public record information that includes bankruptcies, judgments and liens. Potentially negative information, such as late payments and most public record items, which are obtained from courts and other government offices, remain on the personal credit report for up to seven years from the date of the original missed payment, with the exception of Chapters XXXX, XXXX  and XXXX  bankruptcies and unpaid tax liens, which remain for up to 10 years. A paid tax lien will remain for up to seven years from the date paid. Positive information may remain on the report indefinitely, although paid closed accounts generally display for up to 10 years from the date paid or closed. Requests for your credit history remain on your personal credit report for at least two years. Please note that there is nothing a credit repair company can do for you,  including removing inaccurate credit information that you cant do for yourself for free. We believe it is important to supply you with information about specific credit repair laws. The Credit Repair Organization Act, a federal law, prohibits credit repair companies from taking consumers money until they have fully completed the services they promised. It also requires such firms to provide consumers with a written contract stating all the services to be provided and the terms and conditions of payment. I hereby hold thesed companies liable for all damages that has been brought upon me since XX/XX/XXXX. \n\n\n\nThe Fair Credit Reporting Act states in 15 USC sec. 6802 obligations with respect to disclosures of personal information, the importance of consumer reporting agencies conducting their duties in a fair, unbiased, and privacy-conscious manner. These companies have violated the laws as well as my privacy according to the Privacy Act 1974. 15 U.S. Code 6801a - Protection of nonpublic personal information in Addition late payments, charge-off, and repossessions are illegal according to 15 USC 1681A ( 2 ) ( a ) ( i ). Under congress law I was not granted my rights. I never gave written or oral consent to provide any information. Therefore, these violations have brought forth serious civil penalties against these credit reporting organizations. Civil liability for willful noncompliance [ 15 U.S.C. 1681n ] ( a ) In general. Any person who willfully fails to comply with any requirement imposed under this title with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer because of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; 617. Civil liability for negligent noncompliance [ 15 U.S.C. 1681o ] Any person who is negligent in failing to comply with any requirement imposed under this title with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) any actual damages sustained by the consumer as a result of the failure; and ( 2 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. ( b ) Attorneys fees. On a finding by the court that an unsuccessful pleading, motion, or other paper filed in connection with an action under this section was filed in bad faith or for purposes of harassment, the court shall award to the prevailing party attorneys fees reasonable in relation to the work expended in responding to the pleading, motion, or other paper.\n\n621. Administrative enforcement [ 15 U.S.C. 1681s ] ( a ) Enforcement by Federal Trade Commission. ( 1 ) In General. The Federal Trade Commission shall be authorized to enforce compliance with the requirements imposed by this title under the Federal Trade Commission Act ( 15 U.S.C. 41 et seq. ), with respect to consumer reporting agencies and all other persons subject thereto, except to the extent that enforcement of the requirement 's imposed under this title is specifically committed to some other Government agency under any of subparagraphs ( A ) through ( G ) of subsection ( b ) ( 1 ), and subject to subtitle B of the Consumer Financial Protection Act of 2010, subsection ( b ). For the purpose of the exercise by the Federal Trade Commission of its functions and powers under the Federal Trade Commission Act, a violation of any requirement or prohibition imposed under this title shall constitute an unfair or deceptive act or practice in commerce, in violation of section 5 ( a ) of the Federal Trade Commission Act ( 15 U.S.C. 45 ( a ) ), and shall be subject to enforcement by the Federal Trade Commission under section 5 ( b ) of that Act with respect to any consumer reporting agency or person that is subject to enforcement by the Federal Trade Commission pursuant to this subsection, irrespective of whether that person is engaged in commerce or meets any other jurisdictional tests under the Federal Trade Commission Act. The Federal Trade Commission shall have such procedural, investigative, and enforcement powers, including the power to issue procedural rules in enforcing compliance with the requirements imposed under this title and to 82 621 - 15 U.S.C. 1681s require the filing of reports, the production of documents, and the appearance of witnesses, as though the applicable terms and conditions of the Federal Trade Commission Act were part of this title. Any person violating any of the provisions of this title shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act as though the applicable terms and provisions of such Act are part of this title. ( 2 ) Penalties ( A ) Knowing Violations. Except as otherwise provided by subtitle B of the Consumer Financial Protection Act of 2010, in the event of a knowing violation, which constitutes a pattern or practice of violations of this title, the Federal Trade Commissions may commence a civil action to recover a civil penalty in a district court of the United States against any person that violates this title. The audacity of non-compliance from reporting agency has tremendously affected my livelihood, judging my character, has made me seem as if I'm not creditworthy, lendable, just a complete embarrassment and downright humiliation. My performance as a consumer has been severally violated along with my financial stability. As a federally protected consumer I am seeking compensation for all violations and damages that have been intentionally acted against me {$2500.00} per violation and damages suffered {$1000.00} per reporting per month when disputes began. 15 USC 1681e The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumers credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. \n\n\n\nThis company actions have caused great damage to my well-being and creditworthiness. In the moment 15 days ( about 2 weeks ) upon receipt of this complaint I the consumer providing this complaint demand all inaccurate reporting information to be deleted immediately. ( These accounts will be stated below ). This complaint is not to be construed as a credit repair company and or organization. According to 15 USC 1697c You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau must include a summary of your statement about disputed information with any report it issues about you. I sent a disputed to investigate my consumer report out of curiosity and to update personal information such as name, address, work and remove all in accurate information. Ths company has sent correspondence, yet the reporting of inaccurate information remains the same. Following up with a re-investigation my disputes were still ignored the violations continued to reflect on my consumer report. Later I called the agents and used other means of communication to remove inaccurate reporting. A submission for cease and desist was given from me to the reporting agencies asking for proof of assumed signed documents of any written or oral agreements. No signed documents and or agreements giving them full authorization to disclose my personal information of said accounts below have been provided to me. Title 15 USC 1681i ( 1 ) Reinvestigation required ( A ) In general Subject to subsection ( f ) and except as provided in subsection ( g ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. I have submitted court documents which shows the expungement of my criminal records ( Prostitution ) that was a result of XXXX XXXX  Since the case was destroyed, the expungement qualified as a legitimate victim determination document. Experian is consistently declining my request, claiming that they are unable to verify the documents. Under what authority does Experian have the power to function as investigators, and how can they verify expunged court records? All other credit agencies have adhered to the law, with the exception of Experian, which is causing me to feel discriminated against.\n\nNow my life is further endangered due to the intentional and irresponsible actions of Experian and its representatives in disregarding federal laws. It appears that Experian is attempting to further humiliate me by forcing me to contact each creditor to request the removal of the account, when the CRA should be responsible for complying with the law. \n\nExperian has all of the documents and identity verification to process my request. Please ask them what are they attempting to verify? I am asking for federal and state assistance to hold Experian accountable for violating the laws set under FCRA. I demand to see the Verifiable, Validated proof ( an original Consumer Contract with a wet ink signature on it, ( copies of copies are not Validation and by law are not considered proof ), that you have on file for the account ( s ) listed below. For over a year, I have provided Experian with all required documentation under federal law to demonstrate that adverse information on my credit report is directly tied to my status as a survivor XXXX XXXX XXXX. Despite this, Experian has failed to comply with its legal obligations under the Fair Credit Reporting Act ( FCRA ), the Consumer Financial Protection Act ( CFPA ), and the Debt Bondage  Repair Act, causing severe harm to my ability to rebuild my life. \nLegal Obligations and Violations Under the Debt Bondage Repair Act, which amended the FCRA in XXXX, Experian is required to block adverse information resulting from XXXX XXXX within four business days of receiving proper documentation and to make a final determination within 25 business days. My documentation includes : A 605C Self-Attestation Form signed and certified by a tribal government entity, as permitted under the law. \nDetermination letters from a XXXX XXXX XXXXXXXX, my attorney, and my tribal government, all of which meet the criteria outlined in the CFPBs final rule implementing the Debt Bondage Repair Act. \nDespite submitting these materials repeatedly for over a year, Experian has failed to block or remove the adverse information. This refusal violates 15 U.S.C. 1681c-2, which mandates the blocking of adverse information resulting from XXXX XXXX \nAdditionally, I reference the Consumer Financial Protection Bureaus ( CFPB ) XX/XX/XXXX complaint against Experian ( Case No. XXXX ), which highlights systemic failures in Experians handling of consumer disputes, including : 1. Failure to conduct reasonable reinvestigations into consumer disputes, as required by 15 U.S.C. 1681i ( a ) ( 1 ) ( A ). \n2. Failure to forward all relevant information to furnishers, including consumer-provided documentation, in violation of 15 U.S.C. 1681i ( a ) ( 2 ) ( A ). \n3. Failure to block adverse information resulting from identity theft or XXXX XXXX as required by 15 U.S.C. 1681c-2. \n4. Improper reliance on furnishers responses, even when evidence suggests the furnishers are unreliable.\n\n5. Failure to notify consumers of the results of reinvestigations clearly and accurately, in violation of 15 U.S.C. 1681i ( a ) ( 6 ) ( A ). \n\nThe CFPBs XX/XX/XXXX Supervisory Highlights further emphasize that Experian has repeatedly failed to comply with the XX/XX/XXXX rule requiring the blocking of adverse information tied to XXXX XXXX. Experians refusal to accept determinations from legitimate entities, such as XXXX XXXX XXXX  and tribal governments, demonstrates ongoing noncompliance with federal law. \n\nPersonal Harm and Impact : Experians refusal to follow the law has caused me immense harm. For over a year, I have been unable to secure housing due to the adverse information on my credit report. As a result, I have been forced to live in and out of homeless shelters, and at one point, I lived in a tent with my XXXX grandchildren. This has caused significant emotional distress, disrupted my ability to rebuild my life, and perpetuated the financial abuse I endured as a survivor of XXXX XXXX \n\nThe adverse information on my credit reportwhich I have repeatedly demonstrated is directly tied to my XXXX  experiencehas also prevented me from obtaining stable employment, affordable housing, and access to credit on fair terms. This is precisely the type of harm the Debt Bondage Repair Act was designed to prevent, yet Experian continues to disregard its legal obligations. \n\nMy Specific Disputes : The following items on my credit report are directly tied to my status as a survivor XXXX  XXXX XXXX and must be blocked or removed under 15 U.S.C. 1681c-2 : 1. ( See documentation with adverse items ) 2. This report was in regards to the multiple names and addresses that were displayed on my profile. XXXX response stated the following : \" Unfortunately, we are unable to process your dispute or disputes, as it is not specific. If there is information appearing on a credit profile that is believed to be inaccurate or incomplete, we must have a specific dispute.Here are the following ID numbers that correspond to the names and addresses that are not legally connected to me. XXXX, XXXX, XXXX, and XXXX. The reason why I was not able to provide the specific names and addresses within the CFPB platform was due to privacy reasons and CFPB guidelines. \n\n\nAfter that letter, I filed multiple complaints and pursuant to CFR 1022.123 ( a ) ( 2 ), I directly provided proof of my identity to them. On the XX/XX/XXXX, In connection with complaint ID XXXX, Experian stated that on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, they received those documents, but willfully did not comply with the rules and regulations of the FCRA by not removing the incorrect information and only responding with a template-based form stating that the information they had was correct. \n\nOn the XXXX of XX/XX/XXXX, upon their unwillingness to rectify the issue, I sent them a notarized letter directly via certified mail addressing the inaccuracy of the names and addresses being displayed on my consumer account. This letter was accepted by one of Experian 's agents on the XXXX of XX/XX/XXXX. \n\nOn the XXXX of XX/XX/XXXX, After multiple attempts, Experian finally responded with the following : Upon further research and re-investigation, and in accordance with the FCRA, we are in the process of removing the referenced information. ( Refer to complain ID : XXXX ). \n\nExperians dismissive actions of reporting inaccurate and misleading information on my consumer profile have severely damaged my general reputation, creditworthiness, and character over the years, despite multiple complaints to Experian that the information did NOT belong to me. \n\n\n\n\nExperian 's inability and unwillingness to resolve the matter within a reasonable time and after so many attempts severely affected the integrity of my consumer report along with my ability to apply for personal credit. This, in turn, caused me emotional and financial distress. \n\nExperian 's actions have also resorted to a loss of time and money.
