Those cards are an especially important financial lifeline for people who dont have traditional bank accounts. In pitching its reloadable prepaid cards, NetSpend Corporation promised consumers immediate access to their funds with no holds, no waiting. But according to an FTC complaint, the defendants business practices rendered that claim and other representations deceptive. \n\nImmediate access? Not so fast, alleges the FTC. NetSpends ads were replete with claims like No Waiting! and Use your card immediately. But the FTC says many consumers experienced delays in accessing their funds both in the initial activation process and later. For example, despite the companys use it today claim, consumers have to go through an identity verification process required by law before the prepaid debit card can be activated a process with requirements many people have difficulty satisfying. \n\nThe upshot? People who loaded funds onto NetSpend cards often had to wait and wait and wait to access their own hard-earned money. The FTC says those delays resulted in severe financial hardship to consumers, including evictions, repossessed cars, and late fees on bills. \n\nThe complaint also alleges that many customers who closed their accounts and asked for refunds had to wait several weeks to get their money back. In other cases, NetSpend imposed fees that depleted the funds from cards after consumers were unable to activate them. \n\nThe complaint takes on other instances in which NetSpends business practices were at odds with its marketing claims. For example, the lawsuit challenges as misleading NetSpends representation that consumers are guaranteed approval for a card. The FTC also alleges that NetSpend said it would grant provisional credit when consumers dispute charges on their cards, but often failed to live up to that promise. \n\nThe lawsuit was filed in federal court in XXXX. If you work in the financial services sector or have clients interested in alternative payment methods, this is a case to watch. \n\nI provided Netspend with my XXXX, bank statement, SS card Dr licence birth certificate, legal name change. I protested the charges, But Capital One declined my protest telling me that just because I got a different credit card number that certain vendors can still add new charges on my new account number even if they do n't know my new credit card number. This appears to be just as fraudulent as the unknown fraudulent charge that occurred on my card in XX/XX/XXXX! I specifically booked this hotel stay to use my prepaid hotel credit before the year ended. Amex Platinum Hotel Collection Benefit ( Disclosure Issue ) : American Express advertises the Hotel Collection benefit as follows ( paraphrased, because Amex does not allow full-page screenshots ) : Requires a minimum XXXX stay Must be booked and prepaid through Amex Travel Receive a statement credit of {$300.00} Credit applies to eligible prepaid Hotel Collection bookings made on the Amex Travel website using the American Express card The benefit page implies that the full prepaid cost of the 2-night stay is eligible for the statement credit. It does not clearly state that required hotel charges such as taxes, resort fees, or other amounts billed at check-in will become ineligible even if the total price is displayed up front on the Amex site. I received no email, and no booking confirmation, telling me that a portion of the hotels required fees or taxes would not count toward the Hotel Collection credit. The hotel simply informed me of a {$300.00} hold and additional resort fees upon check-in, which contradicts the idea that the stay was prepaid to qualify for the Platinum benefit. Why This Is Misleading : The Amex Travel site did not clearly disclose that the price would be split or that only part of the XXXX stay would count toward the credit. Amex advertises the Platinum Hotel Collection credit as applying to eligible prepaid bookings. I prepaid the entire stay according to the websites price. The website does not warn that mandatory hotel charges ( resort fees, taxes, on-property fees ) become ineligible for the benefit even though they are part of the advertised total. My brother purchased the card for me at a XXXX location and included a receipt stating it was {$100.00} on the card. A week later I went to activate the card and was told by a NetSpend customer service representative that I would have to give my social security number to them in order to activate the card. I told them that I've never been asked to provide my social security number to get access to a prepaid gift card. The representative told me if was company policy. I ended the call and stored the card away to figure out what was really required to activate the card. \n\nRecently, XX/XX/XXXX I called again to activate the card. I was asked again to provide my social security number. I told them I didn't feel comfortable with this as this is a gift card. The NetSpend representative then told me the card was actually bank/check card that only can be activated by opening up an account with them, hence the need for my social security number. I asked her to verify the amount on the card. The representative explained that there was {$100.00} loaded on the card back in XX/XX/XXXX but NetSpend has been charging me a monthly maintenance fee that they charge on all active accounts causing my current balance to be XXXX. \n\nI went back in forth with the representative to get a better explanation of what occurred. If by NetSpend 's policy I must open up a line of credit with them to activate an account and they charge a monthly maintenance fee for all active accounts, how was I charged a maintenance fee for an inactive account? \n\nI asked this question several times and was just told that is there policy. As of this date, Wednesday, XX/XX/XXXX, I have not activated an account with them. My complaint is regarding NetSpend 's false advertisement. All prepaid gift cards I have received in the past were sincere gift cards that did not require me to open up a an account with them tied to my social security number. If this is a bank card and not a gift card, NetSpend must change their packaging/advertisement to reflect this. Additionally, because NetSpend is advertising themselves to be a pre-paid gift card, retailers like XXXX are stocking them near gift cards making it easy for a customer to mistake this NetSpend Card as such. There is no way for the customer to know this is a bank card unless they purchase it and open it up. There is no way of knowing about the monthly fees that are apparently activated as soon as the card is purchased until you purchase the card. \n\nMy last complaint is regarding the monthly maintenance fee charged on activated accounts that was charged to an inactive account.
