As There was no accident, the responding police officer would not file an incident report, rather told him to get the vehicle fixed and file a claim with XXXX The vehicle was un-drivable and my husband had it towed to an authorized repair shop as directed by XXXX. The repair shop kept the truck for almost 4 months. Although we had no car, I made my required final 2 months of lease payments to XXXX as scheduled. The parts took 4 months to get from XXXX and after they repaired it, I returned it to a authorized dealer of their choosing. \n\nIf the XXXX dealer fixed the car properly in the beginning, or if XXXX delivered the parts to the authorized repair shop in a timely fashion, within the 2 months I had left on the lease, the truck would have been repaired and returned before the end of the lease. I paid the lease as agreed, I did not sue XXXX for returning an unsafe vehicle to us, Endangering our lives, or for all of the struggle I had over the last 9 years trying to get a new car and now a home mortgage loan. After all of this, they refused to close the account, damaging my credit for the last 9 years, leaving me unable to purchase a car or home having to use a co-signor for 3 years after they refused to close the account due to this erroneous report. XXXX still continues to refuse to remove this from my credit report, leaving this as an open account crippling my credit score and debt-to-income ratio. \n\nI was relocated and offered a relocation package due to the increased cost of living and I have been trying to get a home mortgage and have repeatedly been told that this report is adversely affecting my credit and not only have I missed buying 2 homes in the last 1.5 years, I have now lost my relocation benefits from my new employer as they expired. My mortgage lender stated this XXXX report is adversely affecting my score and my debt-to income ratio. Now I must continue to pay high rent and wait for this to be resolved. My relocation package was a large part of my decision to take this job as we moved from a very low cost of living area to a very high cost of living area. I was offered 30 % of my salary toward my mortgage payments over 4 years, company paid closing costs and 1 point paid down on my mortgage. \n\nThis loss is a huge impact to me and my family as I am head of household and currently the only income for my family. The housing costs have increased over the last 2 years and now I am looking at the same homes which are ~ {$100000.00} more than in XXXX. Ford said the part is not manufactured now and they dont know when it will be. Car stays in the body shop and I continue to pay the lease not being able to use the vehicle. Ive been told it could be month until they will find the supplier of this harness and fill the backorders. \nAfter XXXX  of calls to Ford, Ford Finance with question what are my options- they offered just the one - buyback my car subject for approval by Ford. I filed request and on Friday XXXX XXXX XXXX Ford officially informed me on rejection. They said buyback request and process is not subjective or decided by Ford Motor Company. The process is strictly based on compliance with the lemon law of your state. According to the review of the buyback team my vehicle does not meet state requirements for repurchase or replacement under the state of Virginia, as vehicle does not satisfy the requirement for days down or repair attempts. If I disagree with the decision, they said I may seek an independent arbitration. They recommended just to address it to XXXX, which is not a consumer protection authority but simply the claims website tbh. As last resort I asked dealership for my options and they offered nice trade-in option with full 3 years negative equity to go into my new vehicle So for XXXX $ part Ford is not able to manufacture or source Im paying XXXX $ lease for the next 3 years not being able to use the asset. At this time I verbally agreed with the shop manager who then stated that my new account number would then be e-mailed to me with a phone number to contact the company with any additional questions. I contacted the company and provided them with my checking account information because they stated they had to make sure I had an active account. They then explained that they would pay the retailer and I would then pay them back. However, at this time no financial figures were provided because at this point we were unsure of how much the repairs would cost. On X/XX/17 I went in to pick up my car and make my final arrangements I was told that the total bill was {$1200.00} for the repairs. This was then forwarded to One Road Lending. The retailer then stated that he could not spread the payments over a period of 24 months and could only do a 12 month span. I then asked what this would make my payments monthly. When I stated that this was 50 percent interest he stated that nothing could be done by the retailer and I asked to contact the loan company. I tried to reach out to the loan company over a period of five days and only was able to reach a voicemail that stated that the company is currently closed. The day I picked up my car I also could not get in touch with anyone from the loan company. I tried contacted the collecting company and they stated they could not help me and I would have to work through the lending company. I paid the {$200.00} to get my car back and the manager stated that the contract would be sent to me via e-mail. I have reviewed the contract and have decided not to sign it. XXXX is the secondary consumer reporting agency owned and operated by XXXX. XXXX gathers and shares data on how non prime consumers manage their loans. This information is used to create predictive credit insights, analytics, and risk scores for short-term lenders, installment lenders, non prime auto lenders ( including leasing companies ), and other providers offering credit to those with subpar credit histories. XXXX is XXXX 's in house subsidiary they use to validate consumer debts knowing the consumer market at large has no idea this secondary consumer reporting agency exists. \nXXXX XXXX also owned and operated by XXXX, collects and provides consumer payment history on payday and installment loans, subprime credit cards and other specialty loans. Consumer payment history is expressly prohibited to be included in a consumer report unless given permissable purpose by the consumer pursuant to 15 USC 1681. \nI placed a security freeze with Clarity Services owned and operated by Experian. Clarity Services is the subsidiary of Experian used to validate consumer debt when disputed as well. Clarity Services gathers and supplies data regarding payday loans, installment loans, auto loans ( including leasing ), check cashing services, rent-to-own deals, telecommunication account openings, and financial services, focusing on the lower-income and subprime consumer sectors. I've placed a security freeze on all my information with these secondary reporting agencies. They still continue to report inaccurate, and incorrect accounts, balances, and personal information that I previously disputed and filed complaints on multiple times. XXXX XXXX owned by XXXX, gathers details from consumers and shares it with payday loan companies, rent-to-own stores, furniture shops with financing options, auto financing companies, high-risk consumer finance firms, subprime home loan providers, subprime credit card issuers, banks, credit unions, cable/telecom companies, and debt collectors. XXXX is the secondary consumer reporting agency owned and operated by TransUnion. XXXX gathers and shares data on how non prime consumers manage their loans. This information is used to create predictive credit insights, analytics, and risk scores for short-term lenders, installment lenders, non prime auto lenders ( including leasing companies ), and other providers offering credit to those with subpar credit histories. XXXX is TransUnion 's in house subsidiary they use to validate consumer debts knowing the consumer market at large has no idea this secondary consumer reporting agency exists. \nXXXX XXXX also owned and operated by XXXX, collects and provides consumer payment history on payday and installment loans, subprime credit cards and other specialty loans. Consumer payment history is expressly prohibited to be included in a consumer report unless given permissable purpose by the consumer pursuant to 15 USC 1681. \nI placed a security freeze with XXXX XXXX owned and operated by XXXX. The inspected it at that time and said the bed was to far from the cab of the truck and the safety latch was not latching proper at all and that was a safety hazard so the bed was moved backed. It still did not fix the issue that the truck does not work properly the way it should. on XXXX the truck was put in the shop again for a control module. On XXXX the truck was taken back to the shop again for the air bags deploying. At this point they switched to shorter shocks absorbers to try and keep the air bags from deploying. I then called the service rider XXXX, spoke with him regarding all the concerns that the tires come off the ground, the bed does not hit the ground as they should and the air bags keep deploying. After speaking with him and himself taking a look at the truck he informed me that he would be reaching out to XXXX as there is an issue with the truck weather its the frame or the bed of the truck but that its not right. So XXXX was called and I was told that we needed to take the truck to XXXX for an over all inspection of the truck. on XX/XX/XXXX - XX/XX/XXXX the truck was put back into the shop for XXXX. Finally at the beginning of XX/XX/XXXX XXXX XXXX with XXXX a XXXX XXXX got a date scheduled to do a full inspection of the tow truck. After the inspection I was told that there is numerous issues with the truck and fixing it would probably be an issue ( attached inspection ) The specs of the truck do not meet within XXXX specs. So even after the inspection XXXX XXXX wanted another inspection done in the hopes that it would be different but nope not at all. The truck was then taken to XXXX at XXXX who himself state he can't get the truck to work right. After that they wanted a 3rd inspection done by XXXX trucking in XXXX. In which they never sent a report I spoke with XXXX XXXX who is employed by XXXX XXXX and he told me that XXXX XXXX sent them the wrong truck for the bed so I asked why was the bed put on and the truck returned to XXXX he got upset and stated its not his responsibility that its XXXX XXXX problem and hung up. At that point I contacted the attorney generals office then they reached out to me to try and fix the truck. I was told by XXXX XXXX the general manager of XXXX that they would be putting a stationary bed and fixing the truck but that did not happen they cut the stands too short and now there is no support under the bed but pressure on the frame of the truck. I have continued to be told by all inspections that this is the wrong bed for the cab axle. Even XXXX XXXX XXXX XXXX stated that the wrong truck was sent by XXXX. After that I was told by XXXX XXXX that the only way to resolve this issue was to bring in a XXXX XXXX in which from XXXX of XXXX to XXXX of XXXX they never got it resolved.I contacted a XXXX XXXX myself to have it inspected which they did. I let the dealer know i had it inspected and was told that by the inspector that this truck is all wrong. Once the dealer was informed it was inspected they acted as if they had done something stating XXXX said it was all good. I reached out to the XXXX myself who informed me that XXXX will not be getting involved in this truck and no inspection report will be drawn up off what he did as that was a courtesy, it was not requested by XXXX. That the responsibility lies on XXXX XXXX. No XXXX XXXX wants to send a report into the attorney generals office stating XXXX  is stating no issues but has not physical report. This is truck is not right and has never been. There is a misrepresentation of product and fraud as XXXX XXXX told me himself that XXXX XXXX sent them the wrong truck for the bed therefore the bed should have never been put on this trcuk... This truck has continued to go in and out of the shop for the entire year and is currently again in the shop for the air bags deploying again not only that but we have had to replace front wheel bearings and seals, front king pins and this could be due to the truck not being correct as we should not be having to replace all these things. I have also reached out to the Financial institution regarding the lease and there are clauses for misrepresentation and fraud in all dealer agreements and contracts signed by consumers. I have also recently settled a civil suit for {$30000.00} with XXXX XXXX in XXXX and am expected to get the Settlement check before the end of the year, ( 45 days from date of settlement ). \nMy attorney has also reached a preliminary settlement with XXXX and XXXX for less than 30 % as long as the full amount is received within 10 days from XX/XX/19 Therefore I thought is would be worth obtaining the remaining funds through Lending Club to resolve the XXXX and XXXX accounts ASAP and then use some funds from my settlement to pay off most of the Lending Club loan, I applied and Lending Club claimed they would do a soft pull of my credit, it was actually a hard pull. ( First confirmed lie ) In Lending Clubs response they implied that upon verification of my information and income I was Approved. ( This is the 2nd, 3rd, 4th,5th & 6th lie ) Lending Club requested 3 months bank statements, these confirm I deposit {$9000.00} to  {$10000.00} every single month. ( I provided these 4 times. ) Lending Club requested my social security verification, I provided this 3 times. \nLending Club requested my entire tax returns including schedules a through e, I provided these and also all other schedules. They inserted my electronic signature into the document even though I had not seen it before this time. I was busy and did not access the website at the time. \n\nYesterday, in scheduling my payment online for the credit card I used to pay this bill I discovered that Acima had initiated a cash advance and not a purchase charge for which XXXX XXXX  had charged me an additional {$10.00} fee. To their credit, they reversed this charge, moved the {$26.00} from a cash advance to a purchase and removed the interest accrued since the charge. \n\nAt this point I logged into the Acima website and discovered that the payoff amount that they had listed was {$1300.00}. The actual purchase was only {$1100.00} inclusive of {$70.00} Florida sales tax. Acima grossed up the sales price to {$1200.00} without giving any notice of why they were doing so or what other fees that they had rolled into the cost of the merchandise. This is their current business operation. I also was never asked to give any Identification documents outside of my social security number to create this account which was unusual. I visited the branch to add a pin number and add a government issued identification to my account. The branch manager told me they are unable to add my ID to my account because there is no way to access the citibank online system from within the bank branches computers. XXXX ( Accounting for Liabilities ) : Federal obligations are XXXX in legal tender ; private banks monetize negotiable instruments rather than lend their own money. \n\nFailure to Balance the Books/ Double-Dip at Charge-Off XXXX XXXX XXXX ( Allowance for Loan and Lease Losses ; ALLL ) and OCC Banking Circular 2012-33 : Banks must charge off consumer credit at 120/180 days and recognize the loss.\n\nBy recording the loss, the bank already took accounting and tax benefits.\n\nYet GreenSky / XXXX XXXX continues to report a balance due after charge-off, effectively claiming a loss while still collecting or reporting the same obligation. \n\nThis constitutes double-counting and false reporting under FCRA. \n\nFCRA, 15 U.S.C. 1681s-2, 1681i 1681s-2 ( a ) ( 1 ) ( A ) prohibits furnishing information known to be inaccurate.\n\n1681i requires correction after dispute.\n\nReporting a balance post-charge-off is inaccurate and unlawful.\n\nContradiction with IRS 1099-C Reporting A 1099-C Cancellation of Debt form has already been filed in connection with this transaction, reflecting cancellation of the underlying obligation.\n\nWhile the form lists XXXX XXXX XXXX. as the reporting party, the debt originated under the GreenSky XXXX XXXX XXXX agreement, meaning the same obligation has already been recognized as XXXX. \n\nOnce a debt has been canceled and reported to the IRS, it can not simultaneously be treated as collectible or reportable on a credit file. \n\nGreenSky / XXXX XXXX continued reporting or collection activity therefore constitutes false reporting and double-counting in conflict with IRS treatment and FCRA requirements XXXX \n\nXXXXract Void for Misrepresentation and Failure of Consideration Under UCC and federal accounting rules, my signed note was itself money. The bank did not lend me its own funds ; instead, it used my instrument as the funding source.\n\nBy labeling this a loan of money rather than a consumer credit transaction, GreenSky and XXXX XXXX misrepresented the nature of the obligation. \n\nA contract built on misrepresentation and failure of consideration is void and unenforceable.\n\nIII. Requested Remedies Immediate correction or removal of the tradeline associated with this account.\n\nBalance correction to {$0.00} if the account has been charged off.\n\nCessation of any further collection activity on this void and unlawful obligation. \n\nProduction of accounting records showing how the books were balanced at origination and at charge-off.\n\nRecognition that a 1099-C has already been filed, further proving discharge.\n\nInvestigation and enforcement action by CFPB to ensure compliance with TILA, FCRA, OCC accounting rules, and Pennsylvania UCC. \n\nIV. Background After an unsuccessful attempt to sell our investment property in Washington , DC, we started shopping for refinance options in XX/XX/XXXX. Our intent was lowering the monthly payments, which would make it viable for us to rent for a few years. Our goal was to have a positive cash flow from the rental and save the money needed to make the home improvements required to sell at full market value. \n\nAfter reviewing multiple similar refinance offers, we submitted a loan application to AmeriSave on XX/XX/XXXX. \n\nOn XX/XX/XXXX we received the first Loan Estimate and confirmation that the loan terms had been locked. On XX/XX/XXXX we signed the Loan Terms Agreement for Loan # XXXX. ( Attachment A ). \n\n2. AmeriSaves first attempt to change the Loan Terms Agreement On XX/XX/XXXX we received Closing Disclosures with terms different than the Loan Terms Agreement. After several requests for an explanation the Loan Officer replied via email on XX/XX/XXXX saying that he was reviewing the issue but had no idea what had changed and that he expected to get it resolved before the holidays ( see Attachment B ). \n\nAfter several days of unanswered emails and calls on XX/XX/XXXX we finally received a call from XXXX XXXX, Mortgage XXXX XXXX. He said that the loan terms had changed because our property was a multi-family property and not a single-family with an XXXX XXXX XXXX ( XXXX ). Right away we provided documentation from several official sources proving AmeriSaves claim was incorrect. For two weeks our requests to rectify the error were ignored or rejected ( See Attachment C ). \n\nOn XX/XX/XXXX, AmeriSave agreed to fix the property classification only after we reached out to parties involved and uncovered that AmeriSave was the one that had asked the appraiser to use the multi-family classification. AmeriSave ordered a second appraisal which was completed on XX/XX/XXXX. But the loan terms still did not match the original agreement in subsequent Closing Disclosures. \n\nUp to the morning of XX/XX/XXXX we were still being told by the Loan Officer and Loan Processor that they were working with the underwriter and their management to resolve the discrepancy on the loan terms. \n\n3. Ultimatum from AmeriSave Late afternoon on Friday XX/XX/XXXX we received a call from XXXX XXXX XXXX, XXXX XXXX  XXXX at AmeriSave, informing us for the first time that AmeriSave was not planning to honor the Loan Terms Agreement signed on XX/XX/XXXX ( see Attachment A ). The explanation this time was that the Loan Officer had not priced the subordination of our Home Equity Line of Credit correctly. Despite providing proof that the Loan Officer and Loan Processor were aware of the subordination prior to the Loan Terms Agreement being signed ( see Attachment D ), we were given one business day to accept AmeriSaves new loan terms ( see Attachment E ) or our loan would be canceled.\n\nAt that point we were out of options as similar offers received in XXXX were no longer available and interest rates were significantly higher. We were forced to accept the new terms with lender credits {$5400.00} lower and closing cost XXXX higher than the original agreement. We were forced to close under the new terms on XX/XX/XXXX, three months after the process started. \n\nThe loan Processor XXXX XXXX and Loan Officers XXXX XXXX and XXXX XXXX were always very helpful, professional and acted with integrity throughout this process. For more than two months they tried their best to do the right thing and honor the original loan terms, only to receive push back and excuses from the underwriter ( s ) and AmeriSave managers. \n\n4. Other Delays Throughout the three-month process, we kept receiving requests for additional documents at least every week. In total, AmeriSave requested at least 73 documents, that in addition to the standard documents that were submitted with the original application. \n\nHaving refinanced properties multiples times in the past ( including our primary home a few months earlier ) we knew some of the requests were not standard practice. AmeriSave had our credit reports showing excellent credit and never a late payment, but we were asked to submit full years of bank statements to confirm timely payments. To make matters worse, some of the documents were requested multiple times. After a few weeks we became worried that we were being treated differently because of our last name or that this could be a delay tactic to let the locked terms expire. If the refinance was not approved, monthly payments at the time wouldnt allow us to rent without a negative cash flow. Our efforts to lease the property had to be put on hold until we had some certainty around the loan. \n\nDespite our excellent credit, being top 3 % earners, having a respectable net worth, and providing a massive amount of documentation in a timely manner, our loan was not fully approved until early XXXX. \n\n5. Cost The cost of our decision to refinance our investment property with AmeriSave vs. other similar offers received at the time is significant. In addition to the almost $ XXXX difference in loan terms, it includes XXXX dollars in lost rental income, equity and interest over 3 months. Our cash reserves to fund the XXXXmprovements needed to rent or sell at a fair market price have been depleted. This could represent additional loses of $ XXXX if due to the resulting financial situation we are forced to sell the property at a discount without the required improvements.\n\nMost likely other means will be required for AmeriSave to compensate for all the losses resulting from the financial and emotional stress that this situation created for our family. But at a minimum we request that XXXXmeriSave honors the loan terms agreement originally signed and refund 1 ) the lender credits originally promised, 2 ) the difference on the loan amount, and 3 ) any incremental closing cost resulting from AmeriSave mistakes that were never agreed upon ( i.e. charges for multiple appraisals ).\n\nOur request to the Consumer Financial Protection Bureau is to investigate the situation.
