I photographed the tow truck during the seizure, and that photograph is attached as proof identifying the repossession agent responsible for taking my property. \n\nAt the time of the repossession, the vehicle was legally owned and titled in the name of my trust, which is a separate legal entity. Despite this, the repossession was executed without any evidence of a valid lien or contractual authority against the trust itself. Any alleged consumer debt appearing under my personal credit profile does not automatically create enforceable rights against trust-owned property. This indicates a failure by the repossession company and any directing party to conduct even basic verification before seizing trust-owned property. \n\nIn addition, the account allegedly associated with this repossession was under an active TransUnion fraud investigation, XXXX XXXX. XXXX, regarding identity theft and the reporting of accounts not associated with my true Social Security Number. Therefore, the validity of the debt itself was already in formal dispute at the time the vehicle was taken. Proceeding with repossession while the account was under active fraud review shows disregard for consumer protections and the dispute process required under the Fair Credit Reporting Act ( 15 U.S.C. 1681 ). \n\nTaken together, these facts demonstrate that the repossession was wrongful and unauthorized, as it targeted trust-owned property based on a contested and unresolved account. As a result, I was deprived of property belonging to the trust without proper legal authority. The repossession company and any involved creditor also appear to have failed to verify ownership, XXXX standing, or the fraud-dispute status of the account prior to repossession. \n\nThis wrongful repossession has caused extreme and immediate hardship. The vehicle was essential for daily transportation, including medical, family, and financial responsibilities. I am a parent, and losing this vehicle severely affected my ability to care for my child and provide for my family. This situation has caused significant emotional distress, disruption of daily life, and financial instability. These harms were entirely foreseeable and would have been avoided had proper verification and competent handling occurred. \n\nBecause of the financial and personal impact of this incident including the severe disruption to my family life, the emotional distress, the hardship of losing essential transportation, and the incompetence demonstrated in proceeding without lawful authority I am formally requesting compensation in the amount of {$60000.00} in addition to full corrective action regarding the vehicle. \n\nAccordingly, I request : 1.
