This is a shameful and unacceptable practice which must be stopped immediately. \n\nI discovered in XXXX XXXX that a late payment was reported to my credit report by Wells Fargo. This occurred in spite of the fact that I never received any billing statement in the mail. \n\nI contacted Wells Fargo the very same day, to inform them that I had never received a statement from them. They admitted that they did not have my address on file ( see attached document confirming their incorrect records and update of information ). \n\nI also informed that my payments had been made before the derogatory credit info was sent to the credit bureaus and asked them to remove the late payments from my record. They transferred me to a myriad of departments, I was given the run around by several different people until eventually a representative informed me that they would remediate it with the credit bureau within 30 days. \n\nHowever, instead of correcting the issue - Wells Fargo exacerbated the problem the next day and in the days to follow by sending alerts to the all three credit bureaus after my phone call to them - by placing flags/disputes on my account with the credit reporting agencies without my permission. I have attached proof of that Wells Fargo flagged my account at the Credit Bureaus on XXXX, after my phone call to them. \n\nI called Wells Fargo again a few days later to inform them of my concerns and was assured that it would be taken care of within 30 days. \n\nUnfortunately, Wells Fargo was not honest with me and they did NOT investigate or correct their error. Instead they sent me a menacing letter dated XXXX XXXX ( see attached ), in which they admitted that after I contacted them, they flagged my account at all Credit Bureau with a Compliance Condition Code this is a conclusive remark stating that my concerns had been resolved even though when they placed those flags ( on XXXX/XXXX/XXXX etc. ) they obviously had NOT conducted an investigation of my concerns - within the short time span of one day. \n\nFurther, in a reprehensible attempt to intimidate me, Well Fargo threatened to leave this negative mark on my credit record, which could harm my future opportunities with potential credit grantors - unless I write them a letter that agrees that the misinformation on my credit report was accurate and essentially validate their inappropriate behavior. \n\nWells Fargo employs coercive tactics that are meant to frighten consumers instead of helping them. This is a disgraceful and inexcusable system which must be stopped. \n\nBy failing to correct the information reported on my credit report, Wells Fargo is in violation of Section 623 ( a ) ( 2 ) of the FCRA. The advisory opinion states that the Section 623 ( a ) ( 2 ) of the FCRA addresses the duty to correct and update information by furnishers, or persons who furnish information to consumer reporting agencies ( CRA ) such as credit bureaus. In particular, this section requires a person that has furnished to a consumer reporting agency information that the person determines is not complete or accurate to promptly notify the consumer reporting agency of that determination and provide any information needed to make it complete and accurate. Thus, on its face, this provision requires a furnisher to provide corrected or updated information to the consumer reporting agency that it had reported to originally. This duty extends to all loan accounts reported to CRAs. \n\nFurthermore, Wells Fargo is similarly in violation of Section 623 ( a ) ( 7 ) of the FCRA which requires it to inform consumers about negative information placed on a consumer 's credit report within 30 days. States I have the right to privacy.\n\nIt has been over 30 days, only to be met with improper responses from Experian and XXXX, no response from XXXX. \nAppaling, because I have provided the necessary information in order to assist all three in their Investigation.\n\nAll three not only false accused me of being a credit repair agency, but have also asked me for more personal information than I have sent already. But, I complied in order to further assist. They are required by the FCRA to respond properly, and all three failed to do so. According to the Fair Credit Reporting Act 15 USC 1681, this is a violation for willful noncompliance 616. Civil liability for willful noncompliance [ 15 U.S.C. 1681N ] I have made the attempt to dispute with all three credit agencies about this. Item anchoring remain with no change on my credit report. I feel as if I am taken advantage of and being ignored by my disputes. Section 611 ( a ), it states that failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report.\n\nThey should be deleted promptly. I waited 30 days, received my investigation, and everything is still the same. All three consumer reporting agencies which is XXXX, Experian, and XXXX did not modify, nor removed anything. The date opened is incorrect, date last active incorrect also on all three credit reports, which is a violation. Monetary harm has resulted clearly, and is unacceptable as well. States I have the right to privacy.\n\nIt has been over 30 days, only to be met with improper responses from XXXX and Equifax, no response from XXXX. \nAppaling, because I have provided the necessary information in order to assist all three in their Investigation.\n\nAll three not only false accused me of being a credit repair agency, but have also asked me for more personal information than I have sent already. But, I complied in order to further assist. They are required by the FCRA to respond properly, and all three failed to do so. According to the Fair Credit Reporting Act 15 USC 1681, this is a violation for willful noncompliance 616. Civil liability for willful noncompliance [ 15 U.S.C. 1681N ] I have made the attempt to dispute with all three credit agencies about this. Item anchoring remain with no change on my credit report. I feel as if I am taken advantage of and being ignored by my disputes. Section 611 ( a ), it states that failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report.\n\nThey should be deleted promptly. I waited 30 days, received my investigation, and everything is still the same. All three consumer reporting agencies which is Equifax, XXXX, and XXXX did not modify, nor removed anything. The date opened is incorrect, date last active incorrect also on all three credit reports, which is a violation. Monetary harm has resulted clearly, and is unacceptable as well. I acquired my credit report, and asked the credit bureaus to check to ensure everything was complete and accurate according to 15 USC 1681i ( 5 ). I demand the accounts deleted immediately or I will file for litigation due to the stress you caused me. First off, instead of receiving a free credit report I should get to see when pulling it up online, however, it makes new users sign up on the site. \nUpon reviewing my {$8.00} a month credit report, I have come across the following misinformation. \nA completely different score, higher than the one on XXXX from TransUnion. Both on XXXX and on XXXX, when I pull up my credit report from XXXX, TransUnion, and XXXX, all three show 30 day, 60 day, and 90 day Late Payments on my credit report. I did not give any credit report agency, nor did I give any data furnisher permission to do so, nor did I even give them written instructions. The inaccuaracies that are still on my credit report, especially after attempted disputes, violate 15 U.S. Code 1681e - Compliance procedures ( b ) for the law states, Whenever a consumer reporting agency prepares a consumer report, it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Transunion also made a false statement that \" I can not afford to make payment for the credit cards due to Extensive medical bills ''. What I said was, \" There is Payment Issue at work, it has been slow, and how that has been a problem for some time. '' I find the false statement made by TransUnion on my Credit Report Defaming, very damaging, and in violation ( per se ). Additionally, FCRA Section 611 requires proper reinvestigation, which was not done in my case. This ongoing misreporting is damaging my creditworthiness and must be corrected immediately. Because of this false late payment, I have been denied access to affordable credit, my credit card limits were lowered, and I had to pay higher interest rates on loans. Under the Higher Education Act and FCRA Section 605 ( a ) ( 5 ), obsolete or false reporting of government-related obligations is prohibited. This is damaging my record unfairly and needs removal. Because of this inaccurate reporting, I have faced emotional stress, denial of refinancing options, and limited access to financial aid programs. It is unjust for me to carry the burden of inaccurate reporting on an account that should not be marked as charged off in this manner. \nXXXX XXXX XXXXXXXX XXXX XXXXXXXX Account XXXX. XXXX Open Date XXXX XXXX, XXXX High Balance {$9200.00} Charge Off This is another duplicate entry of the same obligation being reported twice, which is misleading and unlawful. The FCRA requires fair and accurate reporting and duplication of the same debt is a violation of FCRA Section 607 ( b ). This double reporting inflates the appearance of my debt burden and is causing serious harm. This duplication makes it look like I owe twice as much as I actually do, which has caused me to be denied loans, denied credit cards, and embarrassed when creditors assume I am a high-risk borrower. XXXX XXXX is a debt collector and under the FDCPA Section 807 ( 8 ), it is illegal to report credit information which is known or should be known to be false. This item must be deleted because the reporting is incomplete and unverifiable. This inaccurate entry makes it look like I am unwilling to pay even a small debt, which is damaging my integrity and character in front of lenders. I have suffered financial loss because even though the amount is small, the negative reporting has a huge impact on my credit score. \nXXXX XXXX  Account XXXX. XXXX Open Date XXXX XXXX, XXXX High Balance {$1400.00} Charge Off This account is being reported inaccurately as a charge off. This reporting is misleading and does not reflect the true status. FCRA Section 602 ( A ) clearly states that consumer reporting must be fair and equitable, yet this furnisher and the bureaus have failed to maintain accuracy. Because of this false charge-off, I have been denied rental housing, turned away by lenders, and placed in a position where I can not move forward financially. Because of this false reporting, I have suffered higher interest rates, been denied fair credit opportunities, and endured unnecessary stress trying to prove my payment history. XXXX Date Opened XX/XX/XXXX High Balance {$2300.00} Collection XXXX XXXX  is a third-party debt buyer, and this account is being reported inaccurately. XXXX has a history of misreporting and failing to provide proper validation of debts. Reporting this collection without sufficient proof is a violation of FDCPA Section 807 and FCRA Section 623. However, as consumers, we are never told who these vendors are or what methods they use to investigate disputesleaving the process entirely opaque and unaccountable. In my case, Experian only initiated any investigation after I filed a separate complaint highlighting their failure to act professionally or at all, contrary to federal law and federal regulations. Their claim that there was not enough information was not only false but seemed to be a deliberate attempt to avoid initiating a reinvestigation. Once that complaint forced them to act, Experian quickly ruled against meclearly favoring a result that would shield them from admitting that they had failed to follow federal law and had neglected their legal obligations to consumers. To acknowledge the error would have been to admit that they did not perform their duties under the Fair Credit Reporting Act and that they allowed inaccurate information to harm consumers like myself.
