Please be advised that this same account has already been removed from my XXXX credit report, and I am requesting immediate removal from XXXX records based on the following points, as outlined by Metro 2 reporting standards and federal consumer protection laws.\n\n1. Compliance with Metro 2 Reporting Standards Under the Metro 2 Format Guidelines developed by the XXXX XXXX XXXX XXXX ( XXXX ), all furnished data must be complete, accurate, and compliant with the Fair Credit Reporting Act ( FCRA ). The reporting of my XXXX XXXX account is inconsistent with these standards, as it contains inaccuracies and has not been properly verified. This discrepancy raises significant concerns regarding compliance with the Metro 2 Format. \n\nAdditionally, XXXX XXXX is responsible for ensuring the accuracy of the data they furnish. Given that this account has already been removed from XXXX due to an apparent error or violation, it must be similarly rectified in XXXX report. I request a full investigation to determine the account 's accuracy and its subsequent removal in compliance with Metro 2 standards.\n\n2. Violation of the Fair Credit Reporting Act ( FCRA ) Per Section 611 of the FCRA, consumers have the right to dispute inaccurate or unverifiable information on their credit reports. Since this XXXX XXXX account has already been removed from XXXX, the continued presence of this account on my Experian report violates my rights under the FCRA. Moreover, if Experian is unable to verify the legitimacy of this account within 30 days, it must be removed in accordance with FCRA guidelines.\n\n3. Failure to Meet Consumer Data Integrity Laws The FCRA, specifically Sections 607 ( b ) and 623, obligates credit reporting agencies and furnishers to maintain maximum possible accuracy in consumer reporting. The inconsistent reporting of this account across different credit bureaus clearly indicates a failure in adhering to data integrity laws. This data discrepancy is materially affecting my credit report and score, which constitutes harm under consumer protection laws.\n\n4. Potential Non-Compliance with the Consumer Financial Protection Bureau ( CFPB ) Standards XXXX XXXX has previously been subject to scrutiny for consumer reporting violations by the Consumer Financial Protection Bureau ( CFPB ). The continued presence of this account on my Experian report despite removal from XXXX suggests potential non-compliance with CFPB standards, further warranting an investigation. \n\nRequest for Immediate Action Based on the above violations of Metro 2, FCRA, and other applicable consumer protection laws, I am requesting the immediate removal of the XXXX XXXX account from my Experian credit report. My name is XXXX XXXX XXXX, and my address is XXXX XXXX XXXX XXXX, XXXX, TX XXXX. My date of birth is XX/XX/year>, and my Social Security Number is XXXX. Upon reviewing my COMENITYCB credit report, I discovered several accounts that are not only inaccurate but also fraudulent in nature. These accounts were included in my credit file without my knowledge or consent, which directly violates the FCRAs requirement that credit reporting agencies ensure the accuracy and integrity of the information they report.\n\nSpecifically, under Section 1681e ( b ) of the FCRA, COMENITYCB has failed to follow reasonable procedures to ensure that the information it reports is accurate.\n\nFurthermore, under Section 1681c-2 of the FCRA, which mandates the removal of outdated or inaccurate accounts, these fraudulent entries should have been investigated and removed immediately. In addition, the inclusion of these fraudulent accounts also appears to be a violation of FACTA regulations, which safeguard consumers by requiring creditors and credit reporting agencies to adopt accurate and effective identity theft protection procedures. I did not open any of these accounts, nor was I notified about them, indicating a severe lapse in compliance with FACTAs requirements for consumer notification and security. I have already taken steps to address these issues by contacting COMENITYCB directly, submitting a formal dispute, and providing supporting documentation, including my drivers license, Social Security card, proof of address, and FTC report number XXXX. Despite these efforts, COMENITYCB has failed to rectify the inaccuracies or remove the fraudulent accounts from my credit report, which is a clear violation of its obligations under both the FCRA and FACTA. This failure has had a significant negative impact on my creditworthiness and financial stability. Both letters were sent via certified mail and I have confirmed they were received by TransUnion. The initial dispute letter requested verification of certain accounts listed on my credit report. As mandated under the Fair Credit Reporting Act ( FCRA ), TransUnion is required to investigate and respond within 30 days of receiving a dispute. Despite providing sufficient time and a second letter reminding XXXX of their obligations, I have not received any results or acknowledgment of my requests. This lack of response has caused unnecessary stress and inconvenience, as I am unable to obtain accurate information regarding my credit report. XXXX inaction constitutes non-compliance with FCRA regulations, and I am seeking your assistance in ensuring they fulfill their legal obligations. TransUnion 's failure to act on my dispute violates the Fair Credit Reporting Act ( FCRA ), specifically the following provisions : Failure to Investigate ( 15 U.S.C. 1681i ( a ) ( 1 ) ( A ) ) : Under the FCRA, credit reporting agencies ( CRAs ) like TransUnion must investigate disputes regarding the accuracy of information on a consumer 's credit report. They are required to complete this investigation within 30 days ( 45 days if additional information is provided by the consumer ) of receiving the dispute. Failure to Notify Data Furnishers ( 15 U.S.C. 1681i ( a ) ( 2 ) ) : CRAs must notify the furnisher of the disputed information within 5 business days of receiving a dispute from a consumer. Failure to Provide Results of the Investigation ( 15 U.S.C. 1681i ( a ) ( 6 ) ) : After completing the investigation, the CRA must notify the consumer of the results within 5 business days and provide a revised credit report if the information is found to be inaccurate. By not responding to your dispute within the legally mandated timeframe, TransUnion is in violation of these provisions. Their non-compliance deprives me of my rights under the FCRA to ensure the accuracy and completeness of your credit report. This inaction can also expose them to liability under 15 U.S.C. 1681n ( willful noncompliance ) or 15 U.S.C. 1681o ( negligent noncompliance ), which could result in statutory damages, actual damages, and reimbursement of legal costs, should I choose to pursue further action. I am demanding that they : Remove the following accounts in accordance with law immediately. Address their failure to meet the FCRA deadlines and take corrective measures to prevent future non-compliance. Please find attached copies of my dispute letter, and the demand-to-comply letter. I have also filed FTC Identity Theft Affidavits that include these two accounts. I appreciate your attention to this matter and look forward to your assistance in resolving this issue.
