I previously submitted to TransUnion a valid FTC Identity Theft Report, along with proof of identity and proof of address, identifying this Wayfair credit card account as fraudulent. \n\nThat same identity theft documentation has already resulted in the blocking and deletion of the account by XXXX  and XXXX. TransUnion is now the only consumer reporting agency continuing to report this identity-theft-related tradeline. \n\nThis establishes that my identity theft report was valid, complete, and sufficient, and that TransUnions continued reporting is not the result of missing documentation, confusion, or a pending investigation, but rather a failure to comply with federal law. \n\n\n\nStatutory Violations Despite receiving proper notice and documentation, TransUnion has failed to comply with its independent obligations under the FCRA, including : 1. Violation of FCRA 605B Failure to Block Identity-Theft-Related Information Once TransUnion received a valid FTC Identity Theft Report, it was required by law to permanently block and delete the account within four ( 4 ) business days. TransUnion failed to do so and continues to report the account.\n\n2. Willful Non-Compliance After Notice TransUnion has been on notice of the identity theft and its statutory obligations. Continued reporting after notice constitutes willful non-compliance under FCRA 616.\n\n3. Improper Treatment as a Dispute This matter is not a dispute under FCRA 611. Any attempt to verify, reinvestigate, or delay blocking is legally improper once a valid identity theft report has been submitted.\n\n4. Continued Reporting of Materially Inaccurate Information The tradeline is being reported with internally contradictory and inaccurate information, including charged-off status while simultaneously reporting a balance, utilization, and payment history.
