While I acknowledge your recognition of my FTC Identity Theft Report and affidavit, your insistence on a police report or law enforcement signature as a condition for blocking the disputed tradelines is inconsistent with the Fair Credit Reporting Act ( FCRA ) 1681c-2.\n\nKey Points 1.Legal Framework : FCRA 1681c-2 requires consumer reporting agencies to block fraudulent information within four business days when : A valid identity theft report ( e.g., FTC Identity Theft Report ) is submitted ; Specific fraudulent items are identified ; and Proof of identity is provided.\n\nNowhere in the statute does it mandate a police report or a law enforcement signature. The FTC Identity Theft Report meets the definition of an identity theft report under FCRA 1681a ( q ) ( 4 ), as confirmed by official FTC guidance. Conditioning compliance on additional documentation imposes an undue burden on identity theft victims, contrary to federal law.\n\n2.Reinvestigation vs. Blocking : While you claim a reinvestigation was conducted, this is not a substitute for the mandatory blocking of fraudulent information under 1681c-2. The law explicitly requires blocking fraudulent data within four business days upon receiving a valid identity theft report. Reinvestigations are separate processes and can not delay or replace this obligation. \n3.Lack of Correspondence : Your response states that multiple letters were sent to me regarding the reinvestigation. However, I have received no such correspondence aside from your reply through the CFPB portal. This discrepancy raises concerns about whether ChexSystems has fulfilled its obligations to provide timely and accurate communication with consumers.\n\n4.Ongoing Harm : ChexSystems failure to act in accordance with 1681c-2 has caused significant harm to my credit standing and approval chances, including emotional distress and financial losses. Despite providing the FTC Identity Theft Report and evidence of my involvement in the XXXX data breach, your delays continue to negatively affect my ability to restore my creditworthiness.
