The last four numbers of the account number is XXXX. \n\nThere are several issues and concerns. I am writing about most significant ones in this process. \n\n1. PNC does not process and post transactions in a transparent way, that can be verified by me, the consumer.\n\n2. PNC punitively delays processing and posting transactions in my account.\n\n3. PNCs policy of a supervisor or representative returning a phone call in 24 to 48 hours is insane! When a customer has a serious issue with regards to bank activity, the bank should make yourself available to speak to the customer immediately.\n\n4. PNC delays responding to my concerns via the callback within 24-48 hour narrative.\n\nHow would bank officials like their checks to be delayed posted and or processed for 24 to 49 hours after the official expressed a concern about the check amount? \n\nI have experienced and documented PNC deliberately and intentionally not providing full identification and disclosure of, delaying processing and posting of transactions within my account, money taken out of my account fraudulently by PNC Bank, and PNC Bank doing punitive acts of denying me access to an online banking account that I had with PNC. \n\nThat PNC closed my online banking account and then requested and required that I give them total access to my phone, all my data, photos, contacts,? To reopen the account is horrific. \n\nAfter I denied PNC access, they denied me access to online banking. They then flipped the script to appear as though they did not deny me access to on line banking. \n\nTheir narrative was that I could access online banking, IF I agreed to allow them unlimited access to my phone, data, contacts, etc. I refused. Therefore I do no longer have online banking service with PNC. \n\nWith the only access I have to my account being voice mail, and recorded phone calls, I experience PNC punitively delaying processing and posting transactions in my account. \n\nDelay of processing and posting to my account on several occasions and of late, has become the norm with PNC. PNC Bank, delaying processing and posting transactions in the account, and their gangster bankster policy, narratives and practices MUST STOP! \n\nI stopped using PNC online banking several years ago because without my direct knowledge and or consent, PNC closed my on line banking account. \n\nWhen PNC offered to reopen online banking access to me, they had a list of demands of me, for them to reopen the account that they closed. \n\nIncluded in their demands was that I give them unlimited access to my phone, all my documents, data, photos, etc. \n\nWhen I refused to grant them access they requested, they refused to allow me to reopen my online banking account that they had closed. \n\nI opened an account with XXXX Bank and have online banking service with XXXX Bank. \n\nIt more appears that PNC and XXXX Bank are collaborating, coordinating, communicating, and working together and are accomplices in what amounts to manipulation and control of my finances, access to my finances and manipulation of processing and posting transactions. \n\nOn Monday XXXX XXXX, XXXX online banking that I have with XXXX Bank, I transferred {$35.00} and {$100.00} from PNC to XXXX Bank. \n\nNeither PNC nor XXXX Bank posted those transaction ( to me ) as processed until Tuesday, XX/XX/2021. XXXX Bank posted the transaction, PNC had not. \n\nXXXX Bank posted the transaction in my online banking account on Tuesday. \n\nPNC had not posted nor processed the transaction via their voicemail system. \n\nPNC did not post nor process those transactions until, Wednesday, XX/XX/2021. XXXX days after the transaction at the very moment when I transferred the funds FROM XXXX Bank, today Wednesday XXXX XXXX. \n\nI called PNC today, Wednesday XX/XX/2021 and spoke with XXXX. After I expressed my concerns the call was abruptly disconnected. \n\nI called a second time and spoke with XXXX. She stated that PNC doesnt process transactions until they are given a receipt. \n\nI called PNC a third time and Niar, refused to allow me to immediately speak with a supervisor, stating that she would, Escalate a complaint and a representative would contact me in 24 to 48 hours. \n\nPNCs do dirt and delay speaking about it tactic has been recorded and documented by other PNC customers. I experience their tactics. \n\nI have repeatedly called PNC and articulated my concerns with their tactics on recorded phone calls. \n\nThey think and have written their policy that if they record the phone call, they talk sugar honey Ive tea, If and only if they record the call. If they are informed that the call is recorded, they immediately hang up the call and refuse to speak their sugar honey ice tea narratives NOTE : PNC XXXXecords calls for quality assurance and training, however If informed that the call is recorded, PNC representatives immediately hang up the phone, so that their rudeness, crudeness and shrewdness is not documented to prove the exact nature of conversations that a customer has with PNC. \n\nI have repeatedly told PNC that I do not complain. \n\nTheir system identifies expressions of experiences to PNC as complaints. \n\nI have given PNC many opportunity to self correct, they refuse. \n\nAfter, having expressed to PNC my refusal to allow them car blanc access to my phone, data, contacts, etc., PNC voice mail system, seldom fully identifies all merchants, and their system delays processing and posting transactions that cause and or potentially cause my account to go into overdraft status and or in some sort of punitive way, my account gets hit. \n\nWhen I call PNC and ask PNC to identify merchants, their response is that they will escalate a complaint to which, to this very day, they have done nothing. \n\nAt one point in time they did identify every merchant. They stopped and now, their system XXXX banksters. \n\nThey still do not fully identify each and every merchant via their voice banking system. \n\nTheir lack of transparency with regards to what they are doing, has been documented in other complaints lodged against them. \n\nI have waited for years for PNC to self correct. \n\nNote that XXXX judgment is upon the earth, XXXX judge and exact justice! \n\nI am requesting that an independent investigation of my specific PNC account, and other PNC accounts throughout their system of ALL XXXX and XXXX people, be conducted. \n\nI am requesting that PNC immediately cease and desist from delaying posting and processing transactions in my account. \n\nI am requesting FRB, FDIC and the Securities Exchange Commission to investigate my claims and monitor my account with PNC. \n\nI am requesting that PNC return every penny that PNC has falsely taken out of my account over the years y that I have had the account with PNC. \n\nI am requesting PNC to immediately respond to my concerns, given that PNC online banking services are not accessible to me. \n\nIn the past, PNC regularly took money out of my account with fake transactions that I did not authorize nor agree to. \n\nAt the beginning of that time I was in XXXX, Delaware and had been hospitalized. There was thousands of dollars taken out of my account by PNC. \n\nAt this point, I have, do and will continue to document my experiences with PNC. \n\nAfter giving PNC opportunity to self correct, I have made known to my XXXX XXXX and now am doing so to you, what my experiences have been and have continued to be. \n\nThe majority of people I see, employed by PNC have been white peoples. Most of whom, are system soldiers, who act privileged and or disrespectful in a nice/nasty way. \n\nOn the same day, XX/XX/2021, that I had the rude experience with the three XXXX PNC phone center representatives, I went to a drive thru and made a request to a XXXX male teller. \n\nHe apparently gave the task to the XXXX female to process my transactions, without saying a word to me, that he was not doing the transaction. \n\nI sat and watched every car that was in the drive thru, get served and leave as I waited for the transactions I requested to be processed. That happened right after I had called and spoken to the three call center reps, who recorded, and post calls, complaints, etc. in their records. \n\nI am making known my experiences and concerns to the banking regulatory authorities to investigate and settle my claims. \n\nBecause XXXX is my XXXX XXXX, I do not fight men and people. XXXX fights all my battles and XXXX REIGNS! YHWH does! \n\nPNC, has been given opportunity to self correct. \n\nWith XXXX judgment upon the earth, it is wise for PNC to self correct. In previously communicating with Discover -- a representative named XXXX -- I was extremely detailed in my narrative and information sent regarding this dispute, and was advised that the Executive Office would work closely with the Disputes department to ensure timely and fair processing of my claim. On XX/XX/2019, I was very distressed to find that Discover sided with the merchant ambiguously and canceled my claim, even in lieu of the vast information provided by me to Discover 's offices. Discover opted to side with the merchant even in lieu of a vast lack of information provided by the merchant -- including not providing signed consent forms, forms with missing signatures, and an unrecognized signature on said receipt from the visit. In addition, the merchant ( XXXX ) refuses to speak with me at all, rendering it impossible for me to recover these funds as Discover also refuses to aid me in my concerns, and the Executive Office has become despondent and unprofessional in their dealings. \n\nAt this time, I am requesting an immediate reopening of this claim versus XXXX and reversal of the decision to side with the merchant even in lieu of my extensive submitted documentation, as Discover has not done right by me, the customer. This, also even in lieu of the vast information provided and the proof of medical protocol broken by XXXX. In addition, I have told XXXX, a Disputes Manager with Discover Bank, that XXXX is refusing outright to speak to me via phone and not returning my emails and hanging up when I call them, rendering it impossible ( through no fault of my own ) to recover documents to send to Discover regarding this dispute. I do have several emails back and forth between XXXX ( XXXX Patient Consultant ) & I regarding the dispute, and their ongoing outright ignoring of my requests for assistance. While I also filed a grievance with the XXXX XXXX XXXX, XXXX ignored this complaint and did not respond. To date, XXXX ignores my requests for assistance and will not speak to me about this matter, rendering my only capability of recovering my funds for this dishonored promise and breach of medical protocol the dispute process with Discover Bank. This company admitted verbally ( a contractual agreement upheld even in courts of law ) to refund 25 % as a courtesy due to misinformation provided me ( XXXX, XXXX Patient Consultant and XXXX XXXX, XXXX Operations Manager ), and then proceeded to ignore my requests for contact and resolution as I had already filed a dispute with my bank ( Discover ) ; to date, this ignoring of my phone calls and emails continues, leaving me with no recourse other than to dispute with my bank, which I have done. The fact remains that not only medical protocol was broken by the merchant in neglecting to take Before & After photos of my procedure, further rendering it difficult to get their treatments corrected at another practice in addition to not being able to recover my funds via the dispute opened with Discover Bank, as they refuse to assist me at this time further -- a fact that is both appalling and unethical. \n\nTo date, this matter has caused me severe distress during an already difficult time, and it is my hope that we are able to immediately resolve this matter in my favor given the detailed information I have provided -- now including XXXX 's outright refusal to speak to me regarding my issue or the promise of their refund. I am requesting that Discover Bank be investigated for their practices of simply accepting merchant 's word over the consumer 's, even in lieu of documented narratives, missing paperwork on part of the merchant, and the refusal of the merchant to provide recorded phone calls to prove my claim of the promised discount. It is is no way the fault of the consumer that said merchant is refusing to speak to me, and in the state of California, a verbal contract is a legally binding contract ( promise of said discount ), another fact that Discover has ignored. This erroneous reporting is severely affecting my livelihood and my ability to secure housing. \n\nReference to Relevant Law : The actions of Experian Credit Bureau in inaccurately reporting late payments on my credit builder accounts with XXXX XXXX XXXX XXXX XXXX XXXX appear to be in violation of the Fair Credit Reporting Act ( FCRA ), specifically : Section 1681e ( b ) : Experian has failed to follow reasonable procedures to assure maximum possible accuracy of the information regarding my accounts. \nSection 1681i : If these inaccuracies were previously disputed, Experian has failed to properly reinvestigate and correct the information within a reasonable period of time. \nSection 1681s-2 : XXXX XXXXXXXX XXXX XXXXXXXX XXXX XXXX have a responsibility to furnish accurate information to Experian. Their provision of incorrect information regarding late payments constitutes a failure to meet their obligations under this section. \nI request that the CFPB enforce these provisions to correct the inaccuracies and prevent further harm to my financial stability. \n\nBackground : Nature of Accounts : The accounts in question are credit builder accounts with XXXX XXXX XXXX XXXX XXXX XXXX. These accounts are specifically designed to help consumers build or improve their credit scores. No borrowed funds were disbursed under these accounts. Instead, I was making payments to myself, which were deposited into a savings account to be accessed upon the completion of the program. \n\nMisreporting of Payments : Contrary to the nature of these accounts, Experian has documented drastic late payments. These entries misleadingly suggest that I defaulted on borrowed amounts, thereby portraying a false narrative of my financial behavior and creditworthiness. \n\nImpact on Livelihood : The incorrect reporting of these late payments has had severe repercussions on my financial stability. It has resulted in a significant decrease in my credit score, which has in turn impeded my ability to obtain housing and has affected various other aspects of my financial life. \n\nComplaint Details : Account Information : Reporting Agency : Experian Credit Bureau Lenders Involved : XXXX XXXX XXXX XXXX XXXX Incorrect Information : The accounts have been inaccurately reported as traditional loans, and a charge card with late payments. This is fundamentally incorrect as no money was lent, and the payments made were essentially deposits into a savings account. \n\nRequested Action : Immediate Correction : I request an immediate correction of the records to accurately reflect the nature of these accounts as credit builder accounts, eliminating any indication of late payments or defaults. Specifically, I request that Experian either remove these late payments or update them to reflect that they were paid on time. \n\nPreventative Measures : I urge the CFPB to investigate the practices leading to these inaccuracies and implement measures to prevent such occurrences in the future, ensuring that credit builder accounts are accurately reported across all agencies. \n\nConclusion : The erroneous reporting of drastic late payments on credit builder accounts is causing substantial harm to my financial well-being and obstructing my ability to secure housing. This claim violates the Fair Debt Collection Practices Act ( FDCPA ), specifically 15 U.S.C. 1692e ( 12 ), which prohibits the false representation or implication that accounts have been legally assigned when such an assignment is not lawful. Complaint Detail 1. Unlawful Assignment of Debt : LVNV Funding LLC claims I owe a debt that was allegedly assigned to them. However, under Article 9 of the Uniform Commercial Code ( UCC ), the assignment of a defaulted debt is illegal without proper authorization and adherence to legal procedures. This creates liability for both the original creditor and LVNV Funding LLC as the assignee under 15 U.S.C. 1692e ( 12 ). 2. Lack of Contractual Relationship : I have no contractual agreement or relationship with LVNV Funding LLC. At no time did I agree to any terms or conditions, nor did I consent to have any debt transferred, assigned, or sold to this entity. This renders their claim invalid and unenforceable. 3. Violation of Debt Collection Practices : LVNV Funding LLC is falsely representing itself as the legal owner of this debt. Such representation misleads both consumers and credit reporting agencies, creating inaccuracies in my credit profile and constituting a violation of federal law. Affidavit of Facts Notice : It is a fact that I, the undersigned, have reason to believe and do so believe that LVNV Funding LLC, in collusion with the original creditor, is attempting to unlawfully collect on a debt that has been illegally assigned to them. Both the original creditor and LVNV Funding LLC are liable for violations under 15 U.S.C. 1692e ( 12 ), and I am requesting immediate action to resolve this issue. Relief Requested I demand the following actions : 1. Immediate Validation of Debt : Under 15 U.S.C. 1692g, LVNV Funding LLC is required to provide validation of the alleged debt, including but not limited to : Proof of the original agreement between myself and the original creditor. Documentation demonstrating the legal assignment of the debt to LVNV Funding LLC in compliance with Article 9 of the UCC. Proof that LVNV Funding LLC has the legal right to collect this debt. 2. Removal of Erroneous Reporting : I demand the removal of all references to this alleged debt from my credit reports with XXXX XXXX XXXX XXXX immediately, as it is inaccurate and misleading. 3. Cease All Collection Activities : LVNV Funding LLC must immediately cease all collection activities, including reporting inaccurate information to credit reporting agencies, until the debt is validated and proven lawful. Notice of Liability Failure to comply with this dispute and resolution request may result in legal action under 15 U.S.C. 1692k, where I may seek damages for violations of the FDCPA. LVNV Funding LLC and any involved parties will also be reported to the Consumer Financial Protection Bureau ( CFPB ) for further investigation. Supporting Documentation I am attaching the following documentation to support my dispute : A copy of my credit report showing the inaccurate reporting by LVNV Funding LLC. A statement affirming my lack of contractual relationship with LVNV Funding LLC. Conclusion This dispute serves as formal notice that LVNV Funding LLC is violating the FDCPA by claiming ownership of an illegitimately assigned debt and reporting inaccurate information. I respectfully request immediate correction of this matter to avoid further legal escalation.","date_sent_to_company":"2025-08-14T16:06:58.000Z","issue":"Written notification about debt","sub_product":"I do not know","zip_code":"33610","tags":null,"has_narrative":true,"complaint_id":"15292168","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Resurgent Capital Services L.P.","date_received":"2025-08-14T16:01:33.000Z","state":"FL","company_public_response":null,"sub_issue":"Didn't receive notice of right to dispute"},"highlight":{"complaint_what_happened":["Consumer complaint narrative Subject : Dispute of Alleged Debt and Violation of 15 U.S.C. 1692e ( 12 ) To Whom It May Concern : I am writing to formally dispute the debt allegedly owed to LVNV Funding LLC that is currently being reported on my credit report."]},"sort":[10.347837,"15292168"]},{"_index":"complaint-public-v1","_id":"18032791","_score":9.842908,"_source":{"product":"Credit reporting or other personal consumer reports","complaint_what_happened":"XX/XX/XXXX VIA CERTIFIED MAIL and CFPB PORTAL Equifax Information Service LLC XXXX. XXXX XXXX XXXX, Georgia XXXX Re : Formal FCRA dispute and demand for correction of inaccurate and fraudulent credit reporting To Whom It May Concern : This correspondence is a formal dispute of inaccurate and fraudulent information appearing in my consumer report and a demand for correction, deletion, and full compliance with federal consumer protection laws, including the Fair Credit Reporting Act ( FCRA ), XXXX U.S.C. XXXX et seq., its implementing Regulation V, the Federal Trade Commission ( FTC ) regulations and guidance, and the Consumer Financial Protection Bureau ( CFPB ) guidance governing the investigation of credit reporting disputes and identity theft. \n\nBackground And Nature Of Dispute My consumer report currently reflects XXXX or more accounts, tradelines, or derogatory items that do not belong to me and/or are the result of identity theft, as detailed in the attached list and documentation. I did not open, authorize, or benefit from these accounts or transactions, and I have already filed an identity theft report with the appropriate authorities and with the FTC, and I am providing copies of my FTC Identity Theft Report, police report ( if applicable ), and proof of identity. \n\nThese inaccurate entries are causing substantial harm, including damage to my credit reputation, denial or less favorable terms of credit, and other financial and personal injuries. You are now on notice that this information is disputed and that I assert my rights as an identity theft victim and as a consumer under federal law. \n\nFCRA Duties To Assure Accuracy And Conduct A Reasonable Investigation Under the FCRA, consumer reporting agencies must follow reasonable procedures to assure maximum possible accuracy of the information they report about consumers, and must conduct a reasonable reinvestigation of disputed information when notified by a consumer. This includes the duty to review all relevant information provided by the consumer, to communicate the dispute to the furnisher of the information, and to delete or correct information that can not be verified as accurate. \n\nCFPB supervisory guidance and circulars reiterate that both consumer reporting agencies and furnishers can face liability under the FCRA when they fail to conduct reasonable investigations of consumer disputes or create barriers to the submission of disputes. Federal regulators have emphasized that you must not ignore, summarily reject, or parrot verify disputed information without a genuine, reasonable investigation that considers the evidence submitted by the consumer. \n\nIdentity Theft and FCRA 605B Blocking Rights Because the disputed information results from identity theft, I am invoking my rights under FCRA 605B ( 15 U.S.C. 1681c2 ), which provides that a consumer reporting agency must block the reporting of information that the consumer identifies as resulting from identity theft when the consumer submits : ( XXXX ) appropriate proof of identity, ( XXXX ) a copy of an identity theft report, and ( XXXX ) an identification of the fraudulent information. Section 605B requires the credit reporting agency to block this information within a short timeframe after receiving the required documentation and to notify the furnisher that the information has been blocked due to identity theft. \n\nYour failure to promptly block and remove these identitytheftrelated items after receiving proper documentation would constitute a violation of FCRA 605B and related FTC and CFPB guidance for identity theft victims. Courts have recognized that identity theft victims have a private right of action against furnishers and reporting agencies that fail to conduct a reasonable investigation and continue reporting fraudulent accounts, and regulators have supported consumers in such actions. \n\nCase Law Regarding Failure To Investigate And Identity Theft Federal courts have repeatedly held that when a consumer disputes items on a credit report, the FCRA requires furnishers and agencies to conduct a reasonable investigation, and failure to do so can give rise to liability for actual, statutory, and punitive damages. In recent appellate decisions involving allegations of identity theft, courts have focused on whether the furnisher and agencies reasonably investigated the consumers identity theft claim and whether they deleted or corrected information that could not be verified as belonging to the consumer. These decisions make clear that ignoring consumerprovided identity theft affidavits and supporting evidence, or simply confirming the debt with the original furnisher without deeper inquiry, is insufficient. \n\nBy persisting in reporting fraudulent information after clear notice of identity theft and a dispute, and by failing to conduct a reasonable reinvestigation, a credit reporting agency and any involved furnisher violate their statutory duties under 15 U.S.C. 1681i and 1681s2 and can be held liable in a private civil action. \n\nFraudulent, Unverified Accounts or Inaccurate XXXX XXXX Closed ( Unverified/Fraudulent ) Creditor : XXXX XXXX / Account type : Credit card ( revolving ) Charge Off / Date opened : XX/XX/XXXX Date last paid : XX/XX/XXXX / Date of most recent update : XX/XX/XXXX / Original limit : XXXX dollars ( credit limit ) Amount in default : chargeoff amount XXXX dollars ; These mailing errors have repeatedly prevented me from receiving critical correspondence, responding to time-sensitive requests, and participating in important repayment and relief programs. This issue has been recurring for several years and has substantially affected my financial stability and my ability to act in good faith regarding my student loan obligations. \n\n\n\nPersistent Failure to Ensure Proper Delivery of Mail On XX/XX/XXXX, I received a letter from my loan servicer that once again demonstrated a problem I have repeatedly reported : the full address printed on the window envelope was not completely visible. This is an issue I have raised many times in past complaints and phone calls, including a documented conversation with a supervisor in XXXX. \n\nMy address is in a newly developed community, and because of its length, it requires clear formatting and full visibility for successful USPS delivery. The United States Postal Service requires the complete addressincluding unit number, city, state, and ZIP codeto be visible within the envelope window. When this is not done correctly, the mail is delayed or simply never arrives. \n\n\n\nHistory of Delivery Failures and Direct Impact In XXXX, my wages were garnished without any prior notice. I did not receive the legally required notification because the mail was not properly delivered. When I finally reached a supervisor, she attempted to correct the issue by moving my unit number ( XXXX XXXX ) to a second address line. This change caused a new problem : the city, state, and ZIP code no longer appeared in the visible window, leading to further delivery failures. \n\nThese issues have persisted for years, despite my repeated warnings that the formatting of my address must be corrected. I have experienced similar issues with other companies, reinforcing that this is not an isolated matter but one tied directly to how my address appears on windowed envelopes. \n\nBecause of these errors, I did not receive : A request for my 1040 tax form related to loan forgiveness. I could have immediately complied if I had received the correspondence. \nNotification of eligibility for the Fresh Start program, which I later learned I qualified for but never received due to address visibility issues. \n\nThese missed opportunities have caused significant and unnecessary financial hardship. \n\n\n\nDocumentation of Recent Mailing Delay I also want to bring attention to a discrepancy involving the XX/XX/XXXX letter. The letter was dated XX/XX/XXXX, but the envelope shows it was actually mailed on XX/XX/XXXX, XXXX four-day difference. If the letter had truly been mailed on the XXXX, the postmark would reflect that date. \n\nThis delay is significant because the matter was time-sensitive. I did not receive the letter until XX/XX/XXXX, as confirmed by USPS tracking, which I have submitted as supporting evidence. This delay deprived me of adequate time to submit my hardship documentation. \n\n\n\nFormal Requests In light of the repeated history, documented failures, and financial harm, I respectfully request the following : 1. A formal investigation into the loan servicers mailing practices, specifically address formatting, envelope window alignment, and compliance with USPS delivery standards. \n2. A review of my original XXXX loan forgiveness submission, with consideration that I never received proper notice due to mailing failures. \n3. Reinstatement or reconsideration of any programs I was eligible for, including Fresh Start, loan rehabilitation, or hardship-based relief, which I did not receive due to undelivered mail. \n4. Confirmation that my address will be formatted correctly on all future correspondence, ensuring full visibility through any envelope window. \n\nI am attaching a copy of the XX/XX/XXXX letter and the envelope as evidence demonstrating the ongoing issue. \n\n\n\nThank you for your attention to this matter. In their XX/XX/XXXX letter to the Consumer Financial Protection Bureau, Bridgecrest claimed that my vehicle was repossessed, sold at auction on XX/XX/XXXX, and the account was charged off. However, my credit reports as of XX/XX/XXXX, show the very same account as open and active with a reported balance of {$3500.00}, fifty payments made totaling {$14000.00}, and 79 % of the loan repaid. In their XX/XX/XXXX letter to the Consumer Financial Protection Bureau, XXXX claimed that my vehicle was repossessed, sold at auction on XX/XX/XXXX, and the account was charged off. However, my credit reports as of XX/XX/XXXX, show the very same account as open and active with a reported balance of {$3500.00}, XXXX payments made totaling {$14000.00}, and 79 % of the loan repaid. The report even reflects a last payment on XX/XX/XXXX. \n\nThese two versions can not both be true. Either the vehicle was repossessed and sold in XXXX ( meaning the account should be closed and settled ), or the account remains open and active with ongoing payments ( in which case, no repossession should be reported ). Despite paying {$5500.00} in fees and enrolling a total of {$28000.00} in debt, the outcomes have been drastically different from what was promised. I was originally told to expect savings of {$15000.00} and average settlements of 50 % neither of which materialized.\n\nKey events include : A retracted XXXX settlement offer ( originally for {$6200.00} ), confirmed by Beyond staff, which resulted in an increased balance and delayed resolution.\n\nA {$4800.00} lump-sum withdrawal mislabeled as an offer payment, with the majority going toward undisclosed fees not to creditors. \nFailure to notify me when XXXX XXXX escalated my account into legal status. \nInconsistent and conflicting statements from staff and managers regarding fees, savings, and internal policies. \nRefusal to release my enrollment call, which contains critical evidence of the original verbal promises made at enrollment and which is now being withheld under the claim that it is internal information. \n\nDespite multiple written and verbal requests for transparency and resolution, the company has remained evasive. The XX/XX/XXXX, call with XXXX XXXX XXXX is the latest example of Beyond Finances continued refusal to address these issues in good faith.\n\nThis message also serves as a formal rebuttal to their recent communication and a reiteration of my request that all future correspondence be provided in writing only, as stated multiple times. \n\nOn XX/XX/XXXX at XXXXXXXX XXXX, I spoke with Manager XXXX XXXX regarding the enrollment call Ive been requesting for several weeks. During this conversation : She stated the enrollment call is internal information and can not be shared with me despite this call forming the legal foundation of our agreement. \nWhen asked what was said about the fees, she deflected with answers like I dont remember, I dont have to disclose that, and Ill have to check if I can even send you an email confirming that.\n\nDespite claiming she couldnt share the contents of the call, she selectively disclosed that the recruiter mentioned 4060 % settlement offers and even gave an example conveniently reinforcing Beyond Finances current narrative. \nHowever, none of my actual settlements even met the minimum 40 % reduction, proving that I was misled during enrollment. \n\nThis selective disclosure is unethical and manipulative. It appears the call is being withheld precisely because it contains statements that would confirm my claim of misrepresentation especially regarding fee structure and promised savings. \n\nOn XX/XX/XXXX, I received a written response from Beyond Finance that continues to ignore the core of my complaint. In that letter, they claimed that correct expectations were set and that a 25 % fee and 4060 % debt reduction were disclosed during the enrollment call. \n\nHowever, even by their own admission, my results failed to meet even the lowest end of the promised savings range. For example, my XXXX account ultimately settled for {$9800.00} a drastic increase from the {$6200.00} offer initially confirmed by their own team. The failure to deliver even the minimum projected savings constitutes misrepresentation and false advertising of results. \n\nAdditional concerns : The response fails to acknowledge or remedy the retracted XXXX offer, which increased my debt by {$3500.00} due to Beyond Finances mismanagement.\n\nTheir proposed refund of {$3500.00} framed as a good faith gesture does not begin to address the full financial and legal harm Ive experienced, including unauthorized withdrawals and escalating creditor action.\n\nThey continue to promote a misleading fee structure by referencing a 6.25 % annual fee over four years, yet Ive paid {$5500.00} in fees in under one year far exceeding the $ XXXX implied by that formula. \nMost critically, they still refuse to release the original enrollment call, which prevents me from verifying their claims and defending myself using my own contractual evidence. \n\nAs a consumer, I am entitled to access any communication that forms the foundation of a financial agreement including the full contents of my enrollment call. If the recording can not be released, I formally request a transcript or detailed summary, including the exact language used to explain fees, estimated savings, timelines, and settlement expectations. \n\nWithholding evidence while selectively quoting parts that benefit their defense is a violation of transparency, fairness, and consumer trust. \n\nAs previously mentioned, I have paid {$5500.00} in fees within just 5 months of enrollment. This directly contradicts the claim that the 6.25 % noted in my program summary represents an annual fee, as it implies a total of only {$1700.00} per year for my {$28000.00} in enrolled debt. \n\nThe financial and legal consequences of these actions have been severe, including : My XXXX XXXX account being escalated into legal status without any prior warning or plan to resolve it. \nDecreased trust in the process and increased personal stress due to lack of transparency and accountability. \n\nGiven the unresolved and escalating nature of this issue, I am now filing complaints with the following regulatory bodies : Consumer Financial Protection Bureau ( CFPB ) XXXX XXXX XXXX XXXX XXXX XXXX Pennsylvania Attorney General : XXXXXXXX XXXX Illinois Attorney General : XXXX XXXX Texas Attorney General : XXXX XXXX Please confirm receipt of this message. Unfortunately, much of the information provided to you for your response was either incomplete or incorrect. \n\nAs you suggested, I am contacting you now to request a response to the following facts and questions outlined below. I have highlighted questionable banking processes. \n\nFollowing are quotes from your response letter, identified as TD Bank, followed by the facts : TD Bank : In your complaint you allege on XX/XX/2022, you processed an international wire transfer and learned later that day it was a scam. \n\nFACT : I completed an international wire transfer request and learned two hours later it was a scam. Processing that request by TD Bank was the first questionable banking process. The wire transfer form I signed stated if funds were not in the account the transfer would be cancelled. I told the bank attendant funds in my checking account for the wire were from XXXX XXXX I left TD bank with the understanding my request would be reviewed/approved by the branch manager that afternoon. When TD Bank processed the request the balance in my checking account was approximately XXXX, far short of the XXXX required for the wire transfer. Instead of adhering to TDs policy of cancelling the transfer XXXX was pulled from my savings account and deposited to my checking account and subsequently sent to XXXX XXXX. Given the circumstances ( i.e., knowing the XXXX} was coming from XXXX XXXX ), the common practice of pulling funds from one account ( savings ) to cover shortfalls in another account ( checking ), as explained by the bank manager, is unacceptable. \n\nThe second questionable banking process ( or lack of ) is identifying the various stopping points of the funds enroute to the final destination and how those points are determined. When I signed the transfer request I was told it would take three to five days for the funds to be sent to the international bank, giving TD Bank time to check if there were any problems with the transfer. In subsequent correspondence ( letter from TD bank ) I was told the funds were sent to XXXX XXXXXXXX XXXX and in another correspondence ( TD Banks response to my CFPB complaint ), funds are sent immediately upon request to the receiving bank. \n\nTD Bank : You went to the store and filed a claim and Request to Return Funds due to fraud was completed. \n\nFACT : This is the beginning of the incorrect and incomplete information you received in writing your response. I did not go to the store. I did not file a claim and Request to Return Funds. I called the Branch manager who said she would file a claim with the Fraud Division. She said nothing else could be done. She then forwarded me to the Fraud Division whose staff were helpful in closing my accounts and submitting a request for new accounts. A questionable banking process, or rather lack of a process, leads me to believe the Branch manager does not have a procedure for reporting fraud. In this case, she initially reported the fraud to one ( Fraud Division ) of the two divisions responsible for addressing the fraud and told me nothing else could be done. It wasnt until I talked with my contact at the XXXX and XXXX XXXX XXXX and learned the Branch manager had not filed the request. I called the Branch Manager and she agreed to send a Request to Return Funds due to fraud to the International and XXXX XXXX XXXX and did so within an hour, just before bank closure at XXXX on XX/XX/2022. \n\nTD Bank : XXXX was opened, and the investigation resulted in your being informed that the funds were withdrawn from the international bank and there are no funds remaining. You do not agree with this and feel it was a failed investigation, and you request that we review it again. \n\nFACT : My claim of a failed investigation, more accurately stated as no investigation, was not based on being told the funds were withdrawn from the international bank and there are no funds remaining. That was obvious. It was based on my correspondence with TD Bank employees between XXXX XXXX, XXXX, and XXXX XXXX, XXXX. Most of the information I received during my correspondence with TD Bank XXXX was false, leading me to believe someone was attempting to cover-up the facts in this case. The alleged cover-up became obvious to me during my correspondence with a TD Bank employee when I called XXXX on XX/XX/2022, with questions about a letter I received stating the funds had been sent to XXXX XXXX XXXX ( Receiver Bank ) . I asked the status of the funds. After a lengthy time on hold, the TD Bank employee returned to tell me the funds were with the Federal Reserve, the agency that works with TD Bank and the International bank to resolve the problem. The Narrative from XXXXXXXX XXXX XXXX informing TD Bank on XX/XX/2022 the funds were transferred on XXXXXXXX XXXX XXXX to the International Bank in XXXX proved the information I received from TD Bank employees between XX/XX/2022 and XX/XX/2022 was false. A questionable banking process is the lack of accountability for information provided to customers and the apparent failure to document said information, leading in this case to an apparent cover-up. \n\nThe Narrative from XXXX XXXX XXXX informing TD Bank on XX/XX/2022 the funds were transferred on XX/XX/2022 to the XXXX XXXX in XXXX is a questionable banking process given the international Bank does not participate in any attempt to stop fraud given their procedure is to contact the recipient ( an accomplice to the scam ) to request return of the funds and their instruction to TD Bank is to contact the recipient directly for any request to return funds in the future. Does XXXX XXXX XXXX in XXXX operate under the same policy? Are there no standards for banks operating in XXXX? \n\nThe Narrative confirms my belief TD Bank and XXXX XXXX XXXX were, at the very least, negligent in preventing fraud. There is more to this case that warrants further investigation. \n\nTD Bank : We have reviewed your concerns and confirmed the investigation was handled correctly and did not fail. On XX/XX/2022 XXXX. XXXX XXXX contacted you and advised you that this was investigated and a wire recall was initiated, however we received the response that no funds remained via indemnified recovery. \n\nFACT : XXXX. XXXX XXXX XXXX ( not XXXX ), TD Bank XXXX XXXX XXXX XXXX, called me from his NY home office on XX/XX/2022. He was not aware of the investigation by the International and XXXX XXXX XXXX ( i.e., the investigation I referred to throughout my correspondence with individuals and agencies, documenting the details of what was portrayed as an investigation ). He was calling in response to the report filed by the Fraud Division. After a brief discussion he concluded the investigation was handled correctly. He agreed to review the letter I sent to XXXX XXXXXXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XX/XX/2022, and then discussing the case with me. I emailed the letter to him and followed up several days letter. Although he did not respond to me, I see he is the only person quoted although he had no knowledge of the investigation of the case by the International and XXXX XXXX XXXX when he called me on XX/XX/2022. \n\nTD BANK : Our wire team has done everything possible to try to recover the funds. The beneficiarys bank stated the funds have already been withdrawn. TD Bank investigated the process to recall the wire and learned there were no delays or errors. Please note that recall attempts are never guaranteed but we make every effort to recover funds when possible. International wires are sent immediately upon request, and we do apologize that you were given incorrect information regarding the timing. We recommend that you contact the federal and local authorities in the foreign city where you sent the money. \n\nFACT : The incorrect information I received was far reaching, beyond the timing, and was suspicious. The above TD Bank statement is a summary of the incomplete and incorrect information provided throughout TD Banks response to my CFPB complaint. Please refer to the previous listed FACTS for the correct information. \n\nFollowing are my questions with responses from TD BANK in bold followed by the FACTS : 1. Where did the funds go immediately after withdrawal from my checking account? The wire was sent out immediately to the Beneficiary as you instructed. \n\nFACT : I did not instruct TD Bank to send the funds to the Beneficiary immediately. When I signed the transfer request I was told there is a holding period of between three and five days before the funds would be sent to the beneficiary. \n\n2. What specifically did the investigator do in conducting the investigation of my case? The case was created XX/XX/2022, the investigator received the case on XX/XX/2022 and sent an email out to the store to submit a Fraud intake form and sent out a recall for the Wire Via our XXXX XXXX Please keep in mind that XX/XX/XXXX was the holiday weekend. TD Bank may have been closed but other countries were not. \n\nFACT : TD Bank was not closed on XX/XX/2022. The holiday weekend was XXXX XXXX XXXX I received a call from TD Bank on XX/XX/2022 stating the investigator requested detailed information about the scam. I provided the information. Your response to my question asking what the investigator did in conducting the investigation indicates the only action by the investigator was sending an email to the store and a recall for the Wire via your correspondent Bank. Was the recall sent to XXXX XXXX XXXX or to XXXX Wire Transfer Investigators or to another agency? \n\n3. What role does XXXX XXXX have in TD Banks International Wire Transfers? XXXX XXXX is our correspondent bank. Every bank has a correspondent bank while sending an international wire. \n\nFACT : I know XXXX XXXX Bank is TD Banks correspondent bank and that XXXX XXXX has a bank in XXXX. My question is what role does XXXX XXXX Bank have in TD Banks International Wire Transfers? I was informed by TD Bank, via a letter, my funds were sent from TD Bank to XXXX XXXX Bank. What was the location of the XXXX XXXX Bank? Did XXXX XXXX Bank send the funds to their bank In XXXX and then to the receiver bank? If so, did they decide when the funds were sent to the receiver bank? \n\n4. What role if any does the Federal Reserve have in TD Banks International Wire Transfers? The wire process via the XXXX XXXXXXXX system or via XXXX XXXX system. The Federal reserve has nothing to do with a wire. \n\nFACT : As previously noted, I called XXXX on XX/XX/2022 with questions about a letter I received stating the funds had been sent to XXXX XXXX XXXX XXXX referred to as the Receiver Bank ). I asked the status of the funds. After a lengthy time on hold, the TD Bank employee returned to tell me the funds were with the Federal Reserve, the agency that works with TD Bank and the International bank to resolve the problem. Based on this and previous contacts with TD employees I suspect there was a cover-up. \n\n5. Who are the parties in the attached NARRATIVE, namely the XXXX, We and Your? TD Bank is the bank who initiated the wire, and our correspondent bank is XXXX XXXX. \n\nFACT : I know TD Bank is the bank who initiated the wire and XXXX XXXX Bank is the correspondent bank. Who is ATTN? ATTN wrote the Narrative received by TD Bank on XX/XX/2022 and are identified as ATTN wire transfer investigations. ATTN acknowledged receipt of your cancellation request dated XX/XX/2022 concerning your payment for USD XXXX dated XX/XX/2022. Who is your? Who paid? Who sent the cancellation request? TD Bank or XXXX XXXX XXXX? The funds were paid XX/XX/2022 confirming the false information I received by TD employees throughout what I was led to believe was an investigation of the case. \n\n6. When and by whom were the funds sent to and received by the XXXX XXXX XXXX? The funds were received by the Beneficiary that the wire was sent to, we received an incoming Swift message on XX/XX/2022 that the funds have been withdrawn and there were no funds in the account therefore the correspondent bank closed their case, in turn we must close our case. \n\nFACT : You did not answer the question. I see from the Narrative sent by ATTN Wire Transfer Investigations the funds were received by the XXXX XXXX XXXX the same day I initiated the request for the wire transfer. If the funds were sent from TD Bank to XXXX XXXX XXXX, as I was told, did XXXX XXXX XXXX send the funds? If not, who did? \n\n\n7. What is the procedure for processing reimbursement of funds by TD Bank for my loss resulting from a misleading and failed investigation of my case # XXXX? When the store files a fraud intake form, the Fraud team will contact the customer on the issue, as mentioned above this occurred on XX/XX/2022. \n\nFACT : You did not answer the question. XXXX. XXXX XXXX XXXX contacted me on XX/XX/2022. He was not aware of the investigation Ive referred to throughout this document. \n\nI hereby request TD Bank reimburse me for the stolen money and instruct me as to the procedure for doing so. \n\nFinal Comment My final comment refers to the certified letter I sent to XXXX XXXX, Vice President/Regional Marketing Manager, XXXX XXXX XXXX XX/XX/2022, describing the scam in detail. \n\nI was told by the XXXX TD Bank Branch staff that I would have to give them the letter to deliver to XXXX XXXX and later they told they would give him my telephone number and ask that he call me. \n\nI found XXXX XXXX address and sent the certified letter to him on XXXX XXXX. I sent a copy of the letter to the Branch manager at the TD Bank in XXXX, MD. \n\nAlthough I received confirmation via a U.S. Postal Service phone message ( XXXX with my tracking number ) my letter was delivered on XX/XX/2022, at XXXX XXXX, I did not receive the return receipt. \n\nWhen I didnt hear from XXXX XXXX I called the U.S . Postal Service on XX/XX/2022 with my Return Receipt Tracking Number. \n\nXXXX XXXX, the XXXX MD XXXX XXXX XXXX called me soon after to confirm XXXX XXXX mailing address. I confirmed and XXXX XXXX informed me the letter I sent was signed in the parking lot of the recipients address. \n\nOn XX/XX/2022, XXXX XXXX sent an email to me informing me my service request had been resolved ; they were unable to locate the letter and therefore it was not delivered as addressed. \n\nI did not agree my service request was resolved. An USPS Employee delivered the letter. I wanted to know the details of the delivery and asked for the USPS manager responsible for providing the information. I did not hear from XXXX XXXX. \n\nMy experience with the letter to XXXX XXXX and all the facts I provided in this document led me to conclude I needed to consult with a higher authority. I reached out to the Federal Reserve Bank and was informed the Consumer Financial Protection Bureau ( CFPB ) was the government agency responsible for addressing my complaint. Incorrect and Fraudulent Addresses Reported : The following addresses have been inaccurately associated with my credit report, none of which belong to me nor have I ever lived at these locations. This misinformation has negatively affected my credit profile and caused confusion in credit decisions : XXXX XXXX XXXX XXXX XXXX, XXXX, KY XXXX XXXX XXXX CI XXXX, XXXX, KY XXXX XXXX XXXX XXXX, XXXX, KY XXXX XXXX XXXX XXXX XXXX XXXX XXXX, KY XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, KY XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, KY XXXX XXXX Reference XXXX Under the FCRA XXXX XXXX and XXXX, credit reporting agencies are obligated to ensure the accuracy and completeness of information in consumer reports. Reporting inaccurate addresses is a violation of these provisions and must be corrected immediately. \nXXXX. Late Payments on Account : XXXXXXXX XXXX # XXXXXXXX XXXX XXXX XXXX XXXX Date Opened : XX/XX/XXXX Balance : {$1600.00} Reported with unjustified late payments Late payments have been reported without proper validation or context. These erroneous late payments violate my right to accurate credit reporting under FCRA Section 623. Charge-offs drastically impact credit scores and the ability to access future credit. \nAccording to FCRA Section 609 and FDCPA Section 807, I have the right to dispute any inaccurate or unverifiable information. Failure to properly verify and remove incorrect charge-offs constitutes a violation of these federal laws.\n\nNarrative of Harm and Request for Resolution : The persistent reporting of wrong addresses, inaccurate late payments, and charge-offs has caused me severe credit damage, including higher interest rates, denial of credit, and emotional distress. The presence of these errors undermines my ability to secure loans, housing, and even employment opportunities. Despite my attempts to communicate with creditors and credit bureaus, no satisfactory corrections have been made. \nI hereby request the Consumer Financial Protection Bureau to : 1. Investigate these reporting violations thoroughly.\n\n2. Enforce the removal or correction of all inaccurate addresses, late payments, and charge-offs on my credit reports.\n\n3. In Between XX/XX/XXXX , and XX/XX/XXXX , I contacted the original lender of XXXX XXXX , to advised them of my immediate financial hardships and extenuating circumstances that would prohibit me, from making continuous payments going forward. As such, they advised me to enter i nto one o f their affiliated credit counseling programs of which I complied and commenced. As such, about a month thereafter, I received a call from a gentleman stating that he was just calling to see if they were any changes in my financial status, and of which I said no. As such, he continued on by saying your almost a year behind on your mortgage and still under water with many other financial payments and companies. And right thereafter, to my surprise he proceeded by saying that as of today he no longer would be pursuing this matter, and therefore, this debt will be made nullified as under cease and desist order and will be shared with all of their affiliates, to comply with going forward as well. However, to that narrative in XX/XX/XXXX , while I was residing in the east coast wh ich is about XXXX states away a friend of mine had informed me about coming in contact with a subpoena order of which she founded on her door. So, I requested that she scan and e-mail such documents. Upon reviewing such documents it turned out that it was LVNV Funding LLC, who had filed a lawsuit by utilizing a law firm based out of XXXX XXXX Michigan suing for court costs, attorney fees, and other additional bogus charges other than the original left over debt balance of {$630.00}, range, and with theirs showing {$820.00}, from XXXX XXXX , and with the lawsuit debt showing {$920.00}, stemming from LVNV Funding LLC, and affiliates, that they were currently utilizing to place judgement against me, in a cunning, and gravalicious attempt. So, right after revising such documents I decided to contact the courts and shared to them the same sentiments of what was said, to me verbally and also advised them that I was also, no longer residing in the current state and county of where such lawsuits were filed and in further, advised the court clerk that It would also be difficult for me to make it there, as I was like XXXX states away. I also said, to the clerk, that if there was a way for me, to do the hearing over the phone on the date specified for such specific times as that would work out for me just fine. She replied by saying no, and that the information that I had provided her with was good enough to record down and proceed with. And in further, she also provided me with an email address and link to give such, shared verbal statements in writing of which I executed and completed, with also a follow up call to make sure, that such, request was received and of which was also verified out accurately. And that was that. In further, I also contacted the law firm and spoke to a gentleman and shared the same sentiments of what was said to me verbally over the phone stemming back from XX/XX/XXXX . That same gentleman at the law firm took my statement and replied by saying okay. Again, that was that, and to this day I have n't heard from any of the sources that I had called into about the shared sentiments and statements in general. But as such, I have been noticing constant reports being made against my credit under XXXX , enforced by all XXXX entities of LVNV Funding LLC, and C/O : R esurgent Capital Services, and XXXX XXXX and on many numerous occasions that I have made constant contacts with XXXX , and shared the same sentiments, and to no avail, to this day no such, actions of deletions has been made by any of the affiliated entities that 's reporting all such negative and derogatory reportings. And as such, in my closing out analysis and conclusion surrounding this entire matter. I for one have detected that these XXXX entities is full of ethical fallacies that supports their unethical behavior for how they all conduct their businesses with no good reputation or credibility behind them, and in further, they all utilize such disturbing approaches to entrap and take advantage of past and present customers that perhaps, would have never catch on to such undermining events, and for which many would deem as an act of non-de minimis attempts, which also supports acts of extortions on so many unjust levels. And as such, again, I therefore, request that all these XXXX entities cease, and desist all such reportings against my credit with XXXX , as one of your associates had already declared the aforementioned over six years ago which supports all my shared statements and sentiments with all the appropriate parties and entities here by in general. And as such, as it relates to the subject matter, I am requesting that very stiff penalties of swift acts of justices by the body of government that oversees, and regulates all XXXX entities as their ways of conducting businesses at all levels demonstrates nothing but an act of deeply disturbing business conduct in general in the marketplace.
