On XX/XX/XXXX my granddaughter took her vehicle to the local XXXX dealership XXXX of XXXX XXXX, NC. to work out payment arrangements on her car which we knew was considerably over the allowed mileage even after extended lease renewal. I told him I accepted the terms and asked him to send me the documents electronically for completion. XXXX also instructed me to pay the lease payment if another one came due before the purchase loan was processed and that if I continued receiving calls from the lease side I could either answer them or ignore them. This could be confirmed by listening to calls between myself and XXXX.I received the documents electronically but also received them via XXXX overnight XX/XX/XXXX. I executed the documents ( contract, power of attorney ), paid {$20.00} to have my signature notarized on the POA documents, and sent back all documents that were on the provided checklist, along with copies of my vehicle registration, insurance card and driver 's license. These items were returned to Chase XX/XX/XXXX via XXXX overnight. The contract date indicated on the documents was XX/XX/XXXX. \nOn XX/XX/XXXX, I received a call from Chase Auto. Thinking it was regarding finalization of the loan and how to make payment, I returned the call. It was actually the lease side. I indicated I had returned the purchase documents the week prior and that I assumed the loan would be fully processed and the lease paid out shortly. Also on XXXX XXXX, I received a XXXX envelope at my home. The envelope included a letter from Chase Auto dated XX/XX/XXXX and an odometer disclosure statement. The letter indicated my documents had been received and the odometer statement was all that was needed to finalize the loan. ( Please note : an odometer statement was not part of the original package ). I completed and signed the odometer statement and returned it to Chase Auto XX/XX/XXXX in the XXXX overnight envelope they provided to me. \nI never received any further correspondence from Chase Auto. \nAnother lease payment was due XX/XX/XXXX, so I did as instructed by the retail lending side and paid the lease payment. This payment was accepted. \nThe first retail loan payment was supposed to be due XX/XX/XXXX. As I still had not received anything further regarding how to pay the loan, and the lease was still showing open for me on the Chase app ad Chase online, I started calling the number provided on the letter of XX/XX/XXXX ( XXXX ). The letter indicated to call that number and choose Option 6. There is NO option 6. I chose option 3 for applications already made, then option 1 for apps made by phone. I have called that number XX/XX/XXXX, XXXX, XXXX, XXXX, XX/XX/XXXX and XX/XX/XXXX. All I ever got is a recording stating they are experiencing high call volume and I will be handled by the next available representative. After 20-30 minutes with no one picking up, I would give up. This occurred more than once a day on most of those dates. I also tried the number I had for XXXX XXXX on XX/XX/XXXX. That number was no longer in service, as they are apparently no longer taking credit apps by phone. \nDuring this whole time, I was monitoring Chase online and the Chase app to see if the lease had been paid off yet. \nThe evening of XX/XX/XXXX, the lease no longer showed on the app or Chase online, so I thought it had finally been paid by the retail side and closed out. \nSunday XX/XX/XXXX, I walked out of my house to go celebrate XXXX 's Day with my stepfather, and my vehicle was gone. I called the police and was told it had been repossessed. I called Chase at XXXX, which was a number I found online. it was the automated payment number, but I got transferred to the Redemptions dept and spoke with XXXX ( ID number XXXX ) who provided me with contact info for the repossession agent and told me I would have to contact them Monday morning. I explained the situation regarding already executing a contract to purchase the vehicle at the beginning of XXXX, and she indicated she forwarded the situation to Disputes and they would contact me in XXXX hours. I had to then go purchase some items I would need for work the next day, as the items I needed were in the vehicle. \nMonday XX/XX/XXXX : I had to find a ride to work. My security badge for work was in the vehicle, so I had to obtain a temporary. The temporary badge did not allow me access through any of the security doors. I work on an enhanced security floor, so could not even get back to my desk if I went out to use the restroom. \nAt XXXX, I contacted the repossession company I was given by XXXX the previous evening. I informed them this is a wrongful repossession and the finance company would need to return the vehicle to me. I also told them not to do anything with the vehicle including open it, remove contents, cut a key. \nAt XXXX XXXX I called XXXX again and was transferred to XXXX ( ID XXXX ) in the Redemptions Dept at Chase. She advised me she sees XXXX emailed Disputes yesterday about the situation and we just have to wait for them. I told her this is a wrongful repossession, and I want the vehicle returned today, I asked for a supervisor and was transferred to Account Supervisor XXXX ( ID XXXX ). I informed him of the above course of events. I told him this is a wrongful repossession, and I want the vehicle back today. I informed him I was filing a CFPB complaint and Executive complaint. I made it clear how disturbing this is given the fact that both loans are with the same bank. He told me there is a note that the credit app expired XX/XX/XXXX. He told me maybe I could start the application process again. I asked how this could happen when all paperwork to complete the loan was returned weeks before. He attempted to transfer me to a number for loans, and the call disconnected. He indicated the number was XXXX. \nXXXX XXXX : Called XXXX and again received a recording indicating they were experiencing extended wait time. \nXXXX XXXX : Called XXXX and received a recording indicating that to apply you need to go online to chaseautoloan.com XXXX XXXX : Called XXXX ( Chase customer service ) again. Agent indicated she didnt see it was flagged for repo and said she was going to transfer me to the Collection Dept. I was transferred to Account Supervisor XXXX ( ID XXXX ) at XXXX XXXX. I gave her the story and again informed her this is a wrongful repo. She attempted to transfer me to XXXX option 3, which is the number Ive been trying to call for weeks and never reached a person. She stayed on the line until XXXX, at which time she told me they were experiencing extended wait time. She suggested I talk to a loan XXXX at a Chase branch who XXXX have a better number. \nAt XXXX XXXX, I again called XXXX trying to determine why my purchase loan never got properly processed thus leading to the wrongful repossession. I again received the recording indicating they were experiencing extended wait time. It was 2 hours and 5 minutes before anyone came on the line. I held that entire time, while I was also attempting to perform my job. Finally, the call was answered by someone named XXXX at XXXX XXXX. XXXX advised that Resolutions was working on it and had actually contacted her for a piece of information. She stated that the tracking number for the Odometer Statement I sent back to Chase XX/XX/XXXX showed that it was received in the mailroom at Chase XX/XX/XXXX ( the next business day ). She said they need to find out what happened between receipt of the final document and the booking team, as it was not showing as received by booking until a month after the mailroom ( XX/XX/XXXX ). Booking supposedly was reaching out to the lease side for a new payoff. XXXX told me she emailed XXXX ( XXXX? ) from Resolutions who is working on the case and appeared to be at lunch. She stated that she would call me back and recited my phone number to me. XXXX further told me this was not my fault since I had returned everything on time and they would work on trying to get it resolved. Once again, I stressed that this was a wrongful repossession and I wanted the vehicle returned today. \n\nTo summarize : I had a vehicle lease with Chase. I was approved by Chase for a new loan to convert from lease to purchase, and I supplied all documents within the requested time. I followed the instructions of the retail side and paid the next lease payment that came due, and it was accepted. Chase admits to receiving my paperwork on time, yet no one started processing it until a month after it was received. Due to the lack of controls and their improper practices, my vehicle was repossessed causing me great hardship, embarrassment, stress and consumed my time. As of this writing ( XX/XX/XXXX at XXXX XXXX ), I have not received a call back, and I still do not have my vehicle.","date_sent_to_company":"2019-06-17T20:44:27.000Z","issue":"Problems at the end of the loan or lease","sub_product":"Lease","zip_code":"32223","tags":null,"has_narrative":true,"complaint_id":"3277784","timely":"Yes","company_response":"Closed with monetary relief","submitted_via":"Web","company":"JPMORGAN CHASE & CO.","date_received":"2019-06-17T20:33:21.000Z","state":"FL","company_public_response":null,"sub_issue":"Problem when attempting to purchase vehicle at the end of the lease"},"highlight":{"complaint_what_happened":["My <em>vehicle</em> was wrongfully repossessed. On XX/XX/XXXX, I received a response from the company through the BBB response portal stating that the vehicle will be sold at auction and I can get it back but must pay the full price due {$11000.00}. They sent me a letter and the contract that I signed in XXXX when I purchased the vehicle. I have financed and paid in full with no event, 2 other vehicles through other loan companies and at the time of the signing, I looked at the cost of the vehicle and the interest rate and signed. I do not feel that this type of lending should be legal. The company will now be asking for the remaining car balance of approximately {$3600.00} + {$11000.00} + the cost of repossession and other costs. I looked at several review websites and found there are so many people who have been taken advantage of by this company. Please do something about this so that no one else have to go through this and I hope it helps others as well. The economy is too tight and there is no way I would have knowingly paid {$31000.00} for a XXXX XXXX XXXX. Thank you for reviewing my complaint. I had always planned to purchase my vehicle by financing through my XXXX XXXX. I was told there was a representative of my credit union at the dealership to facilitate the loan. But when I went to pick up my vehicle I was told I needed to lease the vehicle so I could get the benefit of the electric vehicle incentives, that they told me was to offset inflation, and that was not guaranteed... They were helping me out. I told them I would switch to financing through my credit union in the next couple months. They said it would not be a problem. \n\nA few months went by and in XXXX I notified the dealership that I wanted to payoff the lease through financing with my XXXX XXXX. I was told I would need to come into the dealership. So I did. But when I was there, I was told they could not do that. I would need to call VW credit. I went to my credit union for help. The loan officer called for a payoff amount and the paperwork. We were told we would need to wait for them to send me the paperwork in the mail. This took a couple more weeks. As soon as I received the paperwork, I went back to the credit union loan officer, who cut a check for the pay off amount listed on the paperwork, although the payoff amount ( @ {$36000.00} ) was much higher than the remaining cost of the vehicle ( @ {$21000.00} ). We submitted the odometer and title paperwork. \n\nNow, at the end of XXXX, although they have cashed the check for $ XXXX, I am being told that I am overdue on my lease payments and being charged late fees. I am told they will not accept the paperwork my loan officer submitted ( who has completed lots of car loans ). I am told that because the check did not get to VW credit on time, the payoff amount has changed, and I am in arrears. \n\nIt seems to me that this tactic of not letting me payoff my lease directly, slow walking the information to pay off the lease, has resulted in them charging me hundreds of dollars. I feel I was given false information. They were slow to mail terms to pay off, which put me into the next month, with added interest payment. When I called in, I was told there was no way to electronically send the forms, which also slows down the process, resulting in more paid in interest. \n\nThis is only the latest problem with Volkswagen Credit I've experienced. The following is the initial complaint I filed with XXXX regarding what I found to be misleading and fraudulent practices : From : XXXX XXXX XXXX Date : XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX To : XXXX Subject : Re : XXXX Please confirm you have received my complaint. I would like to know whether Volkswagen is considering changing its reservation process so people who reserve can compare dealer prices. Should I expect to hear back about my personal experience purchasing the XXXX? \n\nThank you, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I reserved my XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX, as it it is marketed as a moderately priced electric SUV with MSRP just over {$50000.00}. For the next 9 months I was budgeting for that amount. \n\nI received emails that it would be here soon. In fact I was notified by XXXX XXXX that it was out for a test drive with someone else. Then they said they were mistaken. \n\nI checked the car ads. They were advertising my vehicle, XXXX XXXX XXXX XXXX for {$54000.00}. It was over MSRP, but I thought I could live with it. \n\nXXXX XXXX dealership in XXXX reached out to me on XX/XX/XXXX to tell me my XXXX had arrived. I told them I was getting over XXXX and would like to wait until the following weekend to pick it up, when I could also get my financing in order, transfer money in my accounts. I was told they would only hold my vehicle for 5 days then sell it to someone else. I XXXX XXXX and went to the dealership to pick up the car that Sunday. \n\nThats when they told me I would need to pay more than {$61000.00} for my vehicle, because they could sell it to someone else for that amount. I felt trapped. I could not move my business to a different dealer. If I ordered another car from the factory, it would take another 9 months and would not be built in XXXX ( which I preferred. ) I was told that the state and federal incentives were available to bring the cost down closer to XXXX. I told them the purpose of the incentives is not to counter inflation but was to encourage people to switch to electric. They stuck to their story that the state is offsetting inflation to normalize their price gouging me. \n\nThey talked me into the lease instead of financing because I hadnt had time to get my money in order. They did not put the {$500.00} I had spent reserving the car toward my cost. I had to return to the dealership a couple of times to get that money back. \n\nI did not get a test drive or any explanation of the vehicle. When I was leaving with the car, I was told I would have to return for a XXXX for the vehicle. I guess it had not been fully set up yet. \n\nIt would have been helpful if I could have compared prices ( mark ups over MSRP ) between dealerships so they could compete for my business. so I could have had a choice on how much markup I would be willing to pay for the convenience of picking up my car near my home. As it was, they could charge me anything, and they did. They cashed in on the state and federal rebates with none of it coming to the consumer. If Id known ahead of time, I could have flown to XXXX XXXX XXXX to pick up my car and paid less. \n\nI believe I was over charged for the vehicle because they did not have to compete for my business. I was pressured to come in while I was still XXXX XXXXXXXX XXXX XXXX because they said they would sell it to someone else. \n\nI believe the {$11000.00} mark up was excessive, made possible because of the lack of competition in the reservation process. I then proceeded to take the chuckle as I'm a girl so I would not understand mechanic or vehicle repair jargon. Following this response from him I asked for Mr.XXXX to write down the issues so that I can do some further research at home. Upon arriving home I XXXX the term \" XXXX Brake Master Cylinder Issues '' and immediately on the first page and site was \" XXXX CLASS ACTION LAWSUIT OVER BRAKE MASTER CYLINDER ISSUES '' I proceeded to read the article and jot down the name of the attorney handling the case. It turns out a couple with the same issues as I brought their XXXXXXXX XXXX in to the shop for service for the brakes that were stiffening. Soon after the dealership told them they fixed it. The couple believing it was fixed drove the car got into an accident and nearly got killed. This couple then commenced a Class Action to which inadvertently I guess I will be a part of or not ... Not sure if I am. In any event getting back to my vehicle I called the following day for a status and to explained to Mr. XXXX that I had uncovered something I had not been made privy to. You see approximately several months before I had my brakes worked on by XXXX XXXX and no one let me know that they existed an issue with the brakes. At the very least if this bulletin has been out since XX/XX/XXXX when I leased my car and it is XX/XX/XXXX couldn't anyone notify us that there exist a SERIOUS ISSUE that can kill my entire family??? No instead I nearly get killed, the elderly couple who commenced the action almost get killed and scores of other helpless individuals that own or lease XXXX Vehicles Including the Nations Entire Police Force are forced to play XXXX Roulette with our lives in faulty vehicles and XXXX and General Motors CEO XXXX XXXX XXXX are reluctant to make this apriority and issue recalls on ALL XXXX XXXX, XXXX, AND 1500 TRUCKS!!! There are numerous complaints lodged with the National Highway Safety And Transportation Board and yet nothing has been done to remedy this serious issue. What's more is that if your out of warranty they will not fix it either!!!! I have contacted the General Motors Corporate Division to no avail. No help or assistance was provided. To add insult to injury XXXX XXXX the dealership my vehicle was at after learning I knew forced me to bring back the loaner and take my XXXX XXXX XXXX if I was NOT willing to pay for repairs!!!! When I explained that my husband was not home and I had my kids with me but did NOT want to risk putting in this vehicle they did not care. Not only were they callous but I was forced to go and get the vehicle with my infant daughters and son. When I yelled at the Service Manager out of anger for making take that risk they apparently called General Motors and requested that I service my vehicles elsewhere! A day or two after a rep from General Motors called and I was told never come back to the XXXX XXXX for service because XXXX XXXX had called to complain about me. Now mind you I leased my XXXX XXXX from them. I am outraged at the service from the XXXX Dealership and General Motors and at this point want them to let me out of this vehicle that I continue paying {$730.00} on and CAN NOT USE! its a lemon and will never perform satisfactory or safely. I will not feel comfortable letting anyone in my vehicle let alone drive it myself. Further research showed the XX/XX/XXXX-XX/XX/XXXX XXXX XXXX and numerous other XXXX models have Brakes Master Cylinder Issues, Vibration at Hwy Speeds, Lack of Air Bag Deployment, Air Conditioning Issues and other problems with Front Drivers Side Knocking Noises! I pray you can assist me with this XXXX XXXX!!!!! Having previously completed a lease with BMW and having had the car inspected and returned on the same day, I showed up to BMW of XXXX on XX/XX/XXXX to do the same. When I arrived I was told that the car had to be inspected by a third party, XXXX, before the lease can be returned. They told me as such, they would provide me with a 5 day grace period to have the car inspected and return the vehicle. I was surprised as this was not my experience before, but I nevertheless I made sure to call XXXX that same day, XX/XX/XXXX, to request a inspection. On XX/XX/XXXX I called XXXX back to inquire about the status of my inspection request as my grace period was now over. I spoke to XXXX who is a Customer Service Reprehensive and her Supervisor XXXX in the XXXX call center and they advised me that BMW had canceled my request for an inspection, as they saw my lease maturity date passed and they assumed the request must have been a mistake. As such, XXXX put my name back on the list for an inspection, however, I was now being added to the bottom of said list, and it can take two to three weeks to get my car inspected. During this time, BMW Financial has stated that I must pay for the car for each day that it continues to be in my procession because per the lease the car must be inspected before returned. Despite BMW Financials stance my complaint is the following : a ) Nowhere in my lease does BMW Financial explain that my car had to be inspected by a third party. Furthermore, there was never warning that this third party works on a 3 week to 1 month lead time. Therefore, by providing no such stipulation or warning in the written contract or any future correspondence, BMW Financial forces customers to pay them extra money each day they are waiting for the third party to inspect their vehicle.\n\nb ) BMW Financial did not mail me any documentation prior to my lease-end describing this process. BMW Financial does claim they emailed me in XXXX describing that I should call XXXX however, I can locate no such email, BMW can not provide a read-receipt, and I never agreed to electronic communication as my sole form of contact. BMW Financial mails me a paper statement monthly, however, would not mail something as important as this. \nc ) In reviewing my previous lease documentation with BMW Financial and this lease contract, aside from the date, amount, and VIN number, the two documents are identical. If they are identical documents, and there was no indication to me that the process to return the lease would not be identical, why would me as the consumer think differently.\n\nd ) In speaking with XXXX, a maturity specialist for the lease end department at BMW Financial, my concerns were completely dismissed and disregarded as void because BMW Financial is not the same company as BMW and BMW Financials lease clearly states that a inspection is required before lease end. Therefore, any cancellation or mistake made on the part of BMW XXXX is not their problem. However, stipulations of the third party inspection, the three week-1 month lead time, and email as sole notification of such, is not in the lease. \n\nIt is my claim that BMW and BMW Financial are harvesting additional monies out of unsuspecting customers by requiring a third party inspection, not giving proper advance notice of this requirement, and by sneaky tactics such as canceling the request for appointments in order to prolong the lease term. In response to XXXX, the maturity specialist for the lease end department at BMW Financial, BMW Financial and BMW may be two separate legal entities but BMW Financial was birthed out of BMW Retail and any retail establishment that persuades consumers to use their financing company and actively dissuades consumers to use competitors, is directly tied to that company. In addition, if BMW Retail is directly benefiting from closing loans with BMW Financial, in the forms of increase commissions or bonuses, then in fact any action by one or both entities which negatively effect the consumer, can be legally attributed to both entities. \n\nWhat has taken place with BMW XXXX and BMW Financial is unethical and I suspect, illegal. I was only able to click one. So I will list the rest within this complaint. My vehicle was repossessed in XXXX XXXX Texas while visiting family for XXXX. I dont live in the state of Texas XXXX I live in Arkansas. So when they repossessed my vehicle which I feel they shouldve told me knowing that Im a resident of Arkansas that they was taking the vehicle. It was parked outside of a hotel. By them doing this me and my family was stranded in Texas for over 2 weeks. I never once hid the vehicle. When I arrived to retrieve my belongings out of the car. There was real bad front bumper damaged done to the car. Looks as if it was hanging at some point. Due to the zip ties I saw. That was not there. I called the finance company and they told me to contact the towing company. Which I feel the finance company shouldve done since they hired this company. They damaged my property. I have a video of the car. There also was a dent that wasnt there either. It was right above the fender on the drivers side above the tire. The ONLY documented damage to my car was on the passenger side due to someone side swiping me. That happened in XX/XX/XXXX. It was scheduled to repairs in XX/XX/XXXX. That couldnt happen when they had repossessed my vehicle in XX/XX/XXXX. Next, they really didnt give me the opportunity to try to get my vehicle back. They sent a letter stating that they have my vehicle and something about it being sold. They did not send me any information about the sale of my vehicle, the date, time nor the place of the auction. So this wouldve gave me a chance to retrieve my vehicle back. According to the Arkansas law. They was supposed to notify me through a letter. Texas law is the same as well. So with that, that gave me NO chance at ALL to try to get my vehicle back in good standing. This financial company really doesnt work or try to work with you on your financial breakdowns. They dont refinance, they offer one hold back if you cant pay your note. But it has to be in good standing. Ive tried to get back on track. There was things that transpired while trying to pay for my loan. Missing lots of work due to workplace injurys, roommate left, left me with all of the responsibilities while they broke our lease doing so. Family members getting XXXX at that time it was 14 days so it was lots of things that had me behind. But for them to not notify me of the sale and damages my vehicle feels like a cover up. They sent me a letter saying how much it was sold for. They sold that vehicle for XXXX which was way below its value. They didnt try to get the face value of my vehicle. Which was a XXXX XXXX under XXXX miles brand new tires Hyundai Motor Finance company sold my car and didnt make an effort to sell my vehicle for fair market value. I want to know when and where & who has my vehicle. They are asking me to pay XXXX}. Which I know is incorrect. My property was damaged by them and the towing. They breached my peace so bad and leaving me and my family stranded in another state. That amount needs to be adjusted to cover the damage they caused. Heres a list of things they didnt do for me THE LAW SAYS, and I quote : the lender is legally required to send you a notice that includes important information before your car is sold. You also have the right to \" redeem '' your vehicle after it has been repossessed by paying the total remaining balance along with any repossession costs. However, you must exercise this right before the vehicle is sold They did NOT do any of these things so I could at least had a chance. As of right now XXXX cant afford to have a wage garnishment. Ive already took the first steps to filling bankruptcy. Also, and I quote : They must send you written notice prior to the sale stating : a description the vehicle that it is a sale that you are entitled to an accounting of the unpaid indebtedness and any charge for an accounting the time and place of a public disposition or the time after which another disposition is to be made any liability for a deficiency a telephone number to redeem collateral a phone number or mailing address from which more information about the sale is available NONE of this was done for me or too me. I feel like by them NOT doing these things They really didnt want me to have my vehicle back or work with me to give me a chance. This wasnt my first vehicle with this financial company. My first one ended with them due to the fact that I was reared with having that vehicle 7 months. So I dont know why they didnt work with me, or provide any assistance or information that couldve possibly helped me.","date_sent_to_company":"2024-02-04T17:53:56.000Z","issue":"Repossession","sub_product":"Loan","zip_code":"72034","tags":null,"has_narrative":true,"complaint_id":"8282124","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"HYUNDAI CAPITAL AMERICA","date_received":"2024-02-04T15:31:44.000Z","state":"AR","company_public_response":"Company has responded to the consumer and the CFPB and chooses not to provide a public response","sub_issue":"Loan balance remaining after the vehicle is repossessed and sold"},"highlight":{"complaint_what_happened":["That couldnt happen when they had repossessed my <em>vehicle</em> in XX/XX/XXXX. On XX/XX/XXXX, XXXX reached out to me to see if I would consider co-signing a vehicle loan. I was hesitant to do so because I did not feel comfortable with co-signing a loan with anyone. I said I wasnt sure and told him that due to my short credit history, I would not be approved. He said, Thats fine, let 's just run your credit and see your credit score. I said, \" I guess thats fine. \n\nXX/XX/XXXX I hadnt heard from XXXX, so I reached out to him and asked him how everything went with the vehicle. He then told me that he got approved and he got the vehicle. \n\nXX/XX/XXXX I had Chrysler Capital calling me about the loan and I was confused because I thought I wasnt on the loan. I then found out that my brother used my information and took out this loan in my name. I told my fianc and he asked, Did you ever sign any contract for the vehicle? and I said, No. He then said, Well then you are not legally bound to that loan at all. He committed fraud. I reported that my identity had been stolen with XXXX and went through my checklist on IdentityFraud.gov. So, I then talked with Chrysler Capital, and they told me to reach out to the dealership to get some explanation as to what happened. \n\nI called XXXX XXXX on XX/XX/XXXX and spoke with a young gentleman in the Finance department briefly about the forgery/identity theft matter and kind of explained what happened. He said to me, \" It sounds like a problem you are going to have to take up with the credit company. We can't take your name off as cosigner. '' I then said, \" But I've already spoken with Chrysler Capital, and they told me that I needed to work this out with y'all. '' He said, \" That's not really how it works. '' I then asked, \" Can I speak with your XXXX XXXX? '' He then put me on hold for some time. He got back on and said, \" You are going to have to speak with XXXX, my XXXX. '' and then transferred me. When I initially stoke initially spoke with XXXX she said, \" This matter is my top concern. '' She then said that she would investigate it and call me back. So, I waited a few hours and got no call. \n\nI then took it upon myself to call them back myself and XXXX then told me she had XXXX in Finance ( AKA the employee that signed off on the sale of the vehicle ), call XXXX and apparently XXXX told them, that he took me the contract and that we looked over it together and I signed it, and he brought it back. I then said, \" I never got to see any of the documents, copies, or anything. I never got to see an agreement, the loan, the credit application, nothing. '' She then said, \" Well there's a signature that looks like your name on the contract. '' I then asked, \" Could you send me a copy of this contract so I can see it for myself because I don't remember ever signing any contract. '' She then replied, \" You are going to have to wait for my record keeper to get back in the office. She already left for the weekend. '' I then said, \" Okay, can you call me back on Monday? I had the front desk transfer me to XXXX. She picked it up and we started talking. \" XXXX, you said you would call me back on Friday and I have yet to receive a single call from y'all. '' I spoke. \" Sorry, we were really busy today and sadly my record keeper is out of the office today. She was sick. Also, we will need an email with a copy of your Driver 's License and a statement that you are requesting a copy of the contract. '' I then said, \" Okay, look, I know you have the contract on your computer. Can't you just email it to me? '' She said, \" Sorry I need permission from my XXXX and he's not here at the moment. '' I said, \" Fine, I'll send the email. Can you just call me tomorrow then when the record keeper gets in? '' \" Yes, I'll be sure to do that. '' she said. \n\nThe next day, XX/XX/XXXX, I received no phone calls from XXXX or anyone at XXXX XXXX. So, I then took it upon myself to type this email to XXXX ( the supposed XXXX ), XXXX XXXX ( the XXXX ), and XXXX XXXX the controller ) : \" I'm writing in regard to a situation that I hope you have all been made aware of. I am a victim of Identity Fraud/Possible Forgery stemming from a lease that was made back in XXXX of XXXX. An employee by the name of XXXX XXXX took my information and made me co-signer on a lease that I have never seen, and someone signed my name for me, or he produced a facsimile of my signature. As a result of all of this, XXXX XXXX has failed to remain current under the lease contract, which has had a completely detrimental impact on what was my very good credit. \n\nI've spoken with XXXX on several occasions, and not only has she not taken my name off as a cosigner or gotten the information back to me that I need, but she also reached out to XXXX and let him know that I was reaching out about this matter. I have not gotten any answers and I, myself, have had to reach out now every time to try and figure out what's going on. And from what XXXX told me, there was no Notarized signature to accompany XXXX 's signature or the forged/facsimile XXXX. I can tell you that I've never stepped foot into XXXX XXXX ever, so I'm very curious as to why this lease was ever even processed through? I was told lies from XXXX XXXX regarding this vehicle and loan, and I have proof through text communications that prove I never saw or signed any of that lease paperwork. Now I'm stuck here wondering whether or not XXXX was the only person at that dealership who was involved in this scheme. Who is running your XXXX department and why did he accept this lease without myself present or at the minimum -- a notarized signature ( as it states in your policy that you require )? I demand answers or I will be forced to seek, through my counsel, whatever relief I XXXX be entitled to Under Texas XXXX, legal or equitable, without further notice. \nRegards, XXXX XXXX XXXX '' The next day on XX/XX/XXXX I received an email from XXXX with no words. Just a copy of the contract. I contacted them back the same day with an email saying : \" As I'm sure you can tell by the signature on my ID, that signature looks absolutely nothing like mine. I would like my name taken off as co-buyer on this vehicle and report it to the credit agency immediately. I would like it to be clearly stated that I'm NOT disputing this is not my debt, but that it HAS NEVER been my debt. \nRegards, XXXX XXXX XXXX '' Since I was able to finally see the contract myself and confirm that the signature on it was definitely NOT MINE, on XX/XX/XXXX, I went and filed a police report with the XXXX Police Department. \n\nXX/XX/XXXX I kept contacting Chrysler Capital about the incident and they said that they couldnt do anything without a civil case against XXXX and a handwriting expert, because even though there was suspected fraud on the account, they couldnt prove that the account wasnt mine. \n\nXX/XX/XXXX I decided to reach back out to the dealership via email and wrote : \" I'm still waiting for the notation on my account that this has never been my debt. Please advise as to when that will be done. \nRespectfully, XXXX XXXX XXXX '' Still, I have yet to receive any response or phone calls from them. \n\nOn XX/XX/XXXX I reached out to the XXXX and filed a complaint. I spoke with XXXX XXXX and sent her the copy of the contract and all the info about the incident. She said she would review everything and get back to me. \n\nXX/XX/XXXX XXXX reached out to me and said that even though the signature looked forged, that I would have to move forward with a civil suit because XXXX XXXX said they didnt know it wasnt my signature and I would have to press charges against XXXX individually. \n\nAdditional notes : Ive included a copy of the contract for your inspection. The signature on the contract is very obviously forged. It looks almost exactly like his signature, except uses a C instead of a B. He even signed his signature in place of where mine wouldve had to go. My signature looks absolutely nothing like the signature that was forged onto the contract. Im trying to find out what company is best to talk with about my extremely bad experience with Equifax. My mother and I were both victims of being hacked on our XXXX a few days ago. So I and my mom wanted to freeze our credit so that no more damage could be done. Fisrt two major credit report agencies no issues at all. Then I submitted my information online and had to Answer some security questions just like the other companies except these questions I was given 4 had nothing to do with proving my identity. They asked me if normal questions about my self then came the 4 questions to prove it was me. First question was do you have a vehicle that you lease from 2014. I answered no because I do not. Then second question who do I have my loan for this vehicle with I answered none of the above. 3rd question how much is your payment each month on that vehicle One again I answered none of the above. Then I was told we cant confirm your identity. We will need more information. Thats fine with me so a few hours later My mom does her credit freeze with Equifax and attempts to prove her identity which shes lived at same residence for almost 20 yrs. I have no issues with sending more paper work to prove mine or my moms identity. So my moms gets her security questions and all the exact same about a vehicle form 2014 She of course answers the questions and same issue cant prove her identity. No problem so I call explain whats going on and the person who worked there says ok I can see the issue then asked me to verify with questions pertaining to me and I get them all correct. Then she says I cant tell you anything else until you send paperwork once again thats fine. The other 2 credit report agencies ask about my self or family things that actually pertain to me instead of some questions about a vehicle. No problem Ill send the paper work in. Heres my complaint they are one of the 3 major credit agencies and they are extremely rude very unprofessional and they have all my personal information. and millions of Americans. They played the run around game when I tried to speak to someone else she hung up on me and I just told her my entire S.S. # thats when I felt very uncomfortable.I end up talking to another employee that doesnt state that he is the supervisor like I requested. So basically same run round extremely rude. Not one out of 3 who I talked with were even close to a professional level. I honestly wish I never called but as one of major 3 credit agencies we kind of have no choice. So Then I say can we at lest get my moms credit frozen so she gets on phone says its not her vehicle either he states its a mistake and verified her credit as hes mumbling into the phone unprofessional. My mom gets off the phone and she said right away I dont feel comfortable at all with them having my SS #. My issues are that they are completely unprofessional my mom I will never call Equfax again. well just use the other credit agencies. They havent emailed either of us like the other companies did. After that I XXXX reviews and The XXXX XXXX XXXX has them at 2 stars. How is that possible to have a company that every American has to use for credit based issues. I read the reviews and many complaints were about what I experienced. Lack of professionalism and many more.the gentleman on the phone then also mumbled to me about where to fax my paperwork I just gave up. I will never prove to them its not my vehicle or that I am the person I say I am which is not ok its either put up with a company that treats us like XXXX or let our credit suffer. The other 2 agencies had the identities correct and my moms reports all correct. The issue is not about me proving That its me or about the vehicle.thats no problem at all like I already stated. My major complaint is extremely unprofessional every single person. I have no idea why they are allowed to even be in business they have all our personal information and talk to customers extremely rude. Why would a 2 star company with all the same complaints even be allowed to be considered let alone we have almost no choice since they are part of the major XXXX that basically have the power over your personal information and credit history. I know its hard to understand my complaints in this long rambling letter I wrote. I just feel that something needs to be done and people have no choice but to use them for credit and major financial issues. Im ok with proving my identity Im not ok being treated and talk to that unprofessional. It was a huge nightmare Im not even going to take the time to prove that vehicle isnt mine or who I am Ill just use my info from the other 2 companies which were correct and do not show a vehicle on my report. Its not right some people have no choice because they are looking to purchase a house or vehicle or any credit matter. I really hope soon that the government or who ever can realizes whats going on and take that power away from a company that has everyones personal information. If whoever wants to just read all the bad reviews and see how people feel they can just XXXX exquifax This is my first complaint in my life Im very patient and keep to my self. I know this letter wont go anywhere just maybe open one persons eyes at what many millions of Americans are almost forced to use. Thats all. I could bring up more issues but it all points to the same issues. Lack of professionalism. The XXXX was in immaculate condition and due to the shortage of used cars, XXXX offered me substantially more than the end of the lease buyout price. The paperwork was done, the plates were off the car and I was ready to sign when XXXX informed me that the check amount that they were going to pay was {$1700.00} less than their offer. The reason given was that Chrysler Capital refused to give them a dealer buyout cost and would only allow XXXX to purchase the vehicle for the same amount that I would have to pay which would include the sales tax for the residual value of the car. Since dealers are exempt from paying sales tax the typical buyout purchase for dealers would only be the residual value plus a {$350.00} purchase option fee. I cancelled the deal with XXXX and went home to try to contact Chrysler Capital to resolve what was to me an obvious error on their part. \n\nThis effort turned out to be a several month long exasperating and fruitless search for a straight or even consistent answer. I repeatedly requested a response in writing. Instead I received a wide variety of false justifications and conflicting excuses from the numerous representatives that I spoke with over the phone. I finally discovered that they feel they can get away with charging me this penalty disguised as sales tax for something I did not purchase by implementing an undisclosed policy that they say allows them to do this when a car is sold to certain dealers if there are less than 60 days left on the lease. \n\nThis clearly falls into the category of a special or hidden loan term. There is absolutely nothing in my lease agreement referring to this policy. In fact ITEM No.17 NOTICES states \" THIS LEASE CONTAINS THE ENTIRE AGREEMENT BETWEEN YOU AND US XXXX No agreements exist between you and Lessor except as set forth in the lease. '' The same paragraph goes on to say that at the end of the original lease it may be extended by agreement at their discretion. I did in fact request an extension at the end of the lease but they denied my request. \n\nThere is NOTHING in the lease agreement pointing to any potential or unforeseen costs for trading in or selling the car to a dealer toward the end of the lease. To the contrary in bold capitalized letters there IS such a warning regarding costs and penalties for ending the lease early. It states in bold letters : \" EARLY TERMINATION. You may have to pay a substantial charge if you end this Lease early. The charge may be up to several thousand dollars. The actual charge will depend on when the Lease is terminated. The earlier you end the Lease, the greater this charge is likely to be. \n\nI have opened and reopened the complaint on this numerous times with Chrysler Capital because they repeatedly closed my complaints as if they were resolved. My last phone calls were to simply request a written response clarifying their justification. I last spoke with them on XX/XX/XXXX when I was told flatly that \" the legal team will not allow any such letter '' and that \" Chrysler Capital does not include policies and procedures in the contract ''. She also stated that she is \" entering this into the file and closing the complaint with this resolution. '' I stated that \" this is not by definition a resolution because I do not accept it.
