During this lease, XXXX managed all aspects of the lease through their app, including payment of the lease, XXXX insurance, and charging costs. I made all payments on time and had no issues or missed payments. \n\nWhen my first lease ended, I began a new lease with XXXX around XX/XX/XXXX. As in the previous lease, I submitted my down payment through the XXXX app and maintained my banking information there for all related payments, including XXXX insurance, vehicle charging, and accessory purchases. \n\nHowever, XXXX failed to inform me that with this new lease, the loan servicing would now be transferred to Ally Bank. XXXX collected my down payment via the app and forwarded it to Ally Bank without providing me any written or verbal notification about this transfer or about any new payment portal or account I would need to set up with Ally Bank. \n\nDespite having my correct phone numberTesla had contacted me repeatedly by phone in the past during my first lease to encourage me to renewI received no personal calls or direct communication regarding the loan servicing transfer. Ally Bank claims they mailed notifications to my address, but I was never made aware of these mails. If I had not been notified properly of the loan transfer, how could I have known to take those mails seriously or to distinguish them from marketing materials? \n\nOver the next three months, I did not know I had any account with Ally Bank and never created an online account with them or made any payments directly to Ally. Ally Bank informed me that they tried to reach me through automated calls ( robocalls ). However, due to my phone providers spam filtering ( XXXX ), these automated calls were blocked and never reached me. I confirmed with Ally customer service that these robocalls were their only attempt to contact me about missed payments. \n\nAfter three missed paymentsmy first three payments under Allys servicingthe vehicle was repossessed without any direct prior warning that I was late or who the servicer was. This repossession has severely damaged my credit report, and as a result, I am currently unable to lease another vehicle. While I have maintained the XXXX lease to current payments, and paid the repossession costs, this car was leased for my son. My car was recently rear-ended and deemed a total loss, but due to this damage to my credit, I am unable to lease a car for myself and for the last month made multiple attempts to lease a vehicle with no luck due to this on my credit. \n\nI have attempted to contact Ally Bank several times to resolve this issue, but I have not received any meaningful response or assistance. While applying in my granddaughters name for lease approval I only noted later that the dealer actually placed me as the lessee when the following issue arose. On XX/XX/XXXX my granddaughter took her vehicle to the local XXXX dealership XXXX of XXXX XXXX, NC. to work out payment arrangements on her car which we knew was considerably over the allowed mileage even after extended lease renewal. The salespersons at the dealership told my granddaughter they would take care of the lease turn-in and proceeded to sell her a new vehicle. They then reported her old vehicle as an abandoned leased vehicle somehow removing my granddaughter from the old lease and converting the lease to me as the leaseholder and coordinated the lease turn-in with Hyundai Motor Finance ( HMF ) /Hyundai Finance Company ( HFC )/ Hyundai Capital America ( HCA ) .With no contact with me the vehicle was processed by HMF/HFC/HCA with a value of {$6800.00} and I am told by HMF/HFC/HCA sold with a {$14000.00} balance due after penalties and fees . ( I could have and would have paid for the vehicle had I known it was being sold as it was worth {$6800.00} ). While HMF/HFC/HCA had been in contact with me the entirety of the lease term if there was any issue they indicated they couldnt contact me about the lease turn-in issue. They never bothered to simply ask my granddaughter how to contact me, neither the dealership nor the finance company. Or to just contact me with the email address they had been using for years. I found out about the whole process when I noted my credit score had dropped and could not figure out why. After several contacts with the HMF/HFC/HCA XXXX the dealer and finally two complaints with the XXXX I noted that HMF/HFC/HCA was reporting the issue as a leasing write-off and I dropped the active pursuit of resolution. I am now getting a new home mortgage and am being told that this reporting is having a negative effect on my credit score and thereby loan worthiness. Sure would appreciate your help with this issue. I assume the collateral security attached to this account was sold to Financial Pacific Leasing. Which Financial Pacific Leasing hired an attorney and repossessing the vehicle through the courts, when in reality the contract was paid through performance. I have a counterclaim in the Federal Courts as all my motions to vacate the judgement have been denied representing Pro Se. I attempted to settle the matter out of court, however I am at a lost at this point and damages are adding up daily as this vehicle is means of feeding my boys.Violating Title 42 USC 1983 under the color of Law. The car shouldve been declared a lemon since it had been brought into serve 3 times over recall XXXX. Thinking it was regarding finalization of the loan and how to make payment, I returned the call. It was actually the lease side. I indicated I had returned the purchase documents the week prior and that I assumed the loan would be fully processed and the lease paid out shortly. Also on XXXX XXXX, I received a XXXX envelope at my home. The envelope included a letter from Chase Auto dated XX/XX/XXXX and an odometer disclosure statement. The letter indicated my documents had been received and the odometer statement was all that was needed to finalize the loan. I completed and signed the odometer statement and returned it to Chase Auto XX/XX/XXXX in the XXXX   overnight envelope they provided to me. \nI never received any further correspondence from Chase Auto. \nAnother lease payment was due XX/XX/XXXX, so I did as instructed by the retail lending side and paid the lease payment. This payment was accepted. \nThe first retail loan payment was supposed to be due XX/XX/XXXX. As I still had not received anything further regarding how to pay the loan, and the lease was still showing open for me on the Chase app ad Chase online, I started calling the number provided on the letter of XX/XX/XXXX ( XXXX ). The letter indicated to call that number and choose Option 6. There is NO option 6. I chose option 3 for applications already made, then option 1 for apps made by phone. I have called that number XX/XX/XXXX, XXXX, XXXX, XXXX, XX/XX/XXXX and XX/XX/XXXX. All I ever got is a recording stating they are experiencing high call volume and I will be handled by the next available representative. After 20-30 minutes with no one picking up, I would give up. This occurred more than once a day on most of those dates. I also tried the number I had for XXXX XXXX on XX/XX/XXXX. That number was no longer in service, as they are apparently no longer taking credit apps by phone. \nDuring this whole time, I was monitoring Chase online and the Chase app to see if the lease had been paid off yet. \nThe evening of XX/XX/XXXX, the lease no longer showed on the app or Chase online, so I thought it had finally been paid by the retail side and closed out. \nSunday XX/XX/XXXX, I walked out of my house to go celebrate XXXX 's Day with my stepfather, and my vehicle was gone. I called the police and was told it had been repossessed. I called Chase at XXXX, which was a number I found online. it was the automated payment number, but I got transferred to the Redemptions dept and spoke with XXXX ( ID number XXXX ) who provided me with contact info for the repossession agent and told me I would have to contact them Monday morning. I explained the situation regarding already executing a contract to purchase the vehicle at the beginning of XXXX, and she indicated she forwarded the situation to Disputes and they would contact me in XXXX hours. I had to then go purchase some items I would need for work the next day, as the items I needed were in the vehicle. \nMonday XX/XX/XXXX : I had to find a ride to work. My security badge for work was in the vehicle, so I had to obtain a temporary. The temporary badge did not allow me access through any of the security doors. I work on an enhanced security floor, so could not even get back to my desk if I went out to use the restroom. \nAt XXXX, I contacted the repossession company I was given by XXXX the previous evening. I informed them this is a wrongful repossession and the finance company would need to return the vehicle to me. He told me maybe I could start the application process again. I asked how this could happen when all paperwork to complete the loan was returned weeks before. He attempted to transfer me to a number for loans, and the call disconnected. Agent indicated she didnt see it was flagged for repo and said she was going to transfer me to the Collection Dept. I was transferred to Account Supervisor XXXX ( ID XXXX ) at XXXX XXXX. I gave her the story and again informed her this is a wrongful repo. She attempted to transfer me to XXXX option 3, which is the number Ive been trying to call for weeks and never reached a person. She stayed on the line until XXXX, at which time she told me they were experiencing extended wait time. She stated that she would call me back and recited my phone number to me. Also, within this time my ex decided not to make payments on his vehicle so I now have that on my credit report as a charged off because of the whole situation. I have called TOYOTA FINANCIAL several times to try and resolve this and they were just rude and blew it off. Both incidents were dangerous. Police were involved. The car could not shift into neutral, emitted a strong smell, made a ticking sound, and failed to restart. It was towed to a Mercedes-Benz service center . \n\nOn XX/XX/XXXX, when I signed for a loaner vehicle at the service center, the representative ( XXXX XXXX told me there was no record of my lease extension, no mileage approval, and no active warranty in their system. He had me sign for diagnostics. I contacted Mercedes-Benz Financial , who then admitted that yes, the XX/XX/XXXX call exists and the rep told me I had warranty but that he misspoke. They now refer me back to my original lease agreement, which expired in XX/XX/XXXX. Yet this is a new lease term, and they refuse to provide any valid documentation for the current agreement. \n\nNow I am being told the issue was a starter motor failure and this raises a critical safety and technical concern. How does a starter motor cause a vehicle to shut down while driving? A starter motor is designed to start the vehicle, not maintain engine operation during motion. If it failed while I was already driving, why would that result in total engine loss, inability to shift, and dashboard failure? What really failed in this vehicle? Why wont Mercedes-Benz provide written confirmation of this diagnosis and state that the car is safe to drive?\n\nIve requested documentation of the diagnostics and repair, but I have received no confirmation that the vehicle is safe, and yet they expect me to return the loaner and resume using the same vehicle. Why would a leaseholder be required to drive a vehicle with no warranty protection, no written safety clearance, and questionable repair transparency? I contacted customer service via email on XX/XX/XXXX and received a response that I would hear from them in a few days. They never responded so I filed a complaint with BBB on XX/XX/XXXX. I have financed and paid in full with no event, 2 other vehicles through other loan companies and at the time of the signing, I looked at the cost of the vehicle and the interest rate and signed. I do not feel that this type of lending should be legal. I looked at several review websites and found there are so many people who have been taken advantage of by this company. Please do something about this so that no one else have to go through this and I hope it helps others as well. I was told I needed to hurry so the loan could process and me being a first time dealership lease user I trusted the process. I legally did not sign any documents my initials were electronically typed in. I did not see anything about an apr rate nor was I told one in fact I had to ask for my paperwork due to the fact the dealer did not juts willingly give it to me and that is how I learned about the XXXX interest on my XXXX loan. When I called to ask if I could pay extra to my loan to try to decrease it I was told by the customer service that I could not pay extra to my loan itself u had to pay for both the loan and the interest. I also called to see if I could refinance with credit acceptance and of course they refused. I have had the car a little under 6 months and it has transmission problems and is out of commission. They will not negotiate my price nor take the vehicle back and relinquish my debt so I am out of a vehicle and my recently decent credit score will now be completely destroyed. During this visit, XXXX XXXX informed me of the documents ( e.g. last two pay stubs ) I would need to complete the purchase of my vehicle. TFS had not previously told me about the needed documents ( and this was my first vehicle purchase ), or else I could have brought them during the visit. The rep told me to bring the documents and I could complete the purchase. I returned to XXXX Toyota onXX/XX/XXXX and completed the purchase ( the agreement will be included with this complaint ). TFS also financed the purchase in XX/XX/XXXX. \n\nAbout a week or two after the purchase, I received a call from TFS ( also verifiable with its records ) informing me that I was past due on my account and needed to either return or purchase my vehicle. I informed TFS that I had already signed a purchase agreement with XXXX in XXXXXX/XX/XXXX. TFS said as of the call, it was not showing in its system ( despite TFS also financing the new loan ), but that it would verify this information ( there was also a problem with obtaining my new registration/plates due to TFS having not received the verification of the purchase, and thus having not sent over the title information ). The information apparently was verified, because the calls stopped and I received my plates towards the end of XXXX ( which took longer than usual, per the XXXX rep ). \n\nAlso in XXXX, I received a notice from my credit monitoring service that I had a delinquent mark on my reports from TFS indicating that I was 30 days late on my XXXX payment. I sent a letter to TFS informing them of the error, specifically because 1 ) I had not payment due in XX/XX/XXXXand 2 ) my purchase of the vehicle was complete in XX/XX/XXXX. TFS sent me a letter, datedXX/XX/XXXX, informing me that it reviewed the issue and determined the reporting to be correct. \n\nI disagree with this self-assessment by TFS. Any delay in reporting the purchase was the result of actions by TFS and/or its authorized agent, XXXX Toyota. My last payment due in XX/XX/XXXX was paid on time. I had no other payments due after that day. While I have previously been late with payments ( and have not challenged the reporting ), I made every attempt comply with the instructions provided by TFS.
