She replied \" No ''. \nI said okay I would like to apply for a payday loan of {$200.00}. She took my personal information, and processed the application for a payday loan. At no time did the clerk ever tell me that I was applying for a XXXX XXXX XXXX loan. That loan is not a payday loan. \nNo where on the payday loan documents does it say the word XXXX XXXX XXXX. I had never heard of XXXX XXXX XXXX until I received a letter from then from a phony address over a month after I had already paid back the payday loan. I received a letter stating that I had applied for a XXXX XXXX which is a lie. It stated that I did not qualify for the loan and that they had accessed both XXXX  and XXXX. They violated the Fair Credit Reporting Act by illegally accessing my credit reports and doing what is called a hard Inquiry. What really is happening is that XXXX XXXX along with check cashing businesses are going behind consumers backs and attempting to use their personal information to open up loans. This is illegal and its identity theft along with a direct violation of the 1964 Civil Rights Act, Criminal Identity Theft California Criminal Code 530.5 PC # 619 obtaining  information under false pretenses. I contacted the Check Cashing CEO and I made an undisclosed settlement with the Check Cashing for these violations. That does not excuse them from breaking the law. XXXX XXXX has continuously lied about this. XXXX XXXX does not have a signed loan application with my signature on it which is required by federal law, and state of California law. I do not intend to allow them to get away with this fraudulent behavior. So I realize that CFPB will only contact XXXX XXXX and tell them to contact me. This will not solve this injustice, and I intend to bring the full law down on them in Federal Court very soon. \nXXXX XXXX XXXX is using numerous names, like Lendify and Insikit, they use several false addresses also, and they have false information filed with the Secretary of State in California. They were recently sued in Federal Court in the northern district of California, for breaking other consumer laws on loans. XXXX XXXX XXXX address is : XXXX XXXX XXXX XXXX   XXXX, XXXX XXXX California XXXX. XXXX XXXX XXXX, uses voip to send all calls to a third world country where the people who answer their line can not speak or comprehend english, that number is XXXX. I expect this complaint should be turned over to federal investigators because I am making a direct accusation that I am not the only victim of this fraud. In order to be approved for this loan, my last XXXX employment deposits had to be verified. I agreed as there was no other way. At this point I thought my loan was approved so I said yes. I was a returning customer and assumed all was completed and approved. The rep said all that needed to be done, after I had just lied to my bank, was submit the application through XXXX??? Who is XXXX XXXX. Something came back, probably my Tax Lien as I have a current payment plan with the IRS, so the loan was denied. I called another payday lender, XXXX, and received the approval instantly and funds were deposited for the next business day. My number one complaint with XXXX Loans is that you must lie in order for your bank deposits to be verified. My second complaint is that I never should have electronically signed any loan documents and been disclosed monthly payments and due dates if my loan was not approved. Many payday lenders do this from what I have been told because it makes the process easier for them. What about us as a consumer that believes their loan to be completed and approved when loan documents have been signed?? We need to stop dishonest payday lenders and loan document signing prior to the loan being approved/denied. I refused to provide such information unless they could prove they already had it. I was harassed with phone calls sometimes on a daily basis if not more. Eventually, I learned in each instance these companies do n't actually do credit checks with the major credit services nor are the loans identified on the credit reports -- makes it hard to determine there are fraudulent loans when they are n't reported on your credit. I have opened an incident report with my local police department, opened a complaint with the FTC, and put fraud alerts with the major credit services. I have sent dispute letters to each company when I learn of the loan and how I can file a dispute. All MAJOR inconveniences. The product turns out to be a very expensive ; never ending, PAYDAY LOAN. \n\nI received a loan for {$1800.00} and paid 1 time per month. Mobiloans.com is debiting our checking account 2 to 3 times per month. Every payment they take is completely different. Some payments they take are {$160.00} and others are {$180.00}. When they take the payments, between {$120.00} and {$150.00} of it is nothing but their fees. Two payments ; possibly 3, per month and {$20.00} to {$30.00} of each payment is going to the principal. The way this is trap is set up ; it will take 30 months to pay off the loan of {$1800.00}. The original loan amount of {$1800.00} will cost me {$9600.00}. One would think that every law in lending has been broken. \n\nMobiloans.com has taken XXXX XXXX and XXXX XXXX 's playbook. Everything from the way it is advertised to how the products work is all a scam. The loan was taken out to report to the credit agencies and to help with the overall credit picture. We were trying to paint a picture for VA Home Lenders to finally live the American Dream and purchase a home. \n\nSomething needs to be done with this to protect us as a consumer. There is no way a company should be able to advertise this product as a personal installment loan when it is nothing but predatory payday loans. There is absolutely no way in the world I would have signed up for this product had this information been presented to me from the beginning. She said that they will file the paperwork by the end of the week and I will be picked up on my job. She hung up on me - I called back and was hung up on by multiple people. After doing so the rep advised me that the loan would be deposited in approximately 3-5 business days and my first payment will be due 30 days after the loan deposited.the following day on XX/XX/2018 a rep called and said he had a few questions about a transaction on my banking statement a month ago from XXXX  shocked at this point because I was never told that me logging into my account to \" verify my routing and account number '' included them monitoring my transactions from a month ago. Never the less I went ahead and explained that it was indeed a payday loan that doesnt report to the credit bureaus and it was resolved if it was really that important to know. The rep Then challenged my answer by stating he was currently looking at XXXX and see that they offer lines of credit and that should report. I then again explained that XXXX doesnot report anything to the credit bureaus and since he was online he could XXXX   that to verify what i was telling him was correct or call them his self. The rep then said he understood and would call me back. Later on that day ( XX/XX/18 ) at exactly XXXX XXXX for 41 miutes I spoke to a supervisor named XXXX who said she have to go back and declined my loan because of a transaction ( from my personal bank ) from an online web site ( XXXX ) that could possibly be a recent loan and I cant have a new loan less than 60 days because it could effect my credit score if it report later which would Later make me en eligible for the loan. Now extremely frustrated but calm and pleading my case.. I explained that XXXX doesnt report to the credit bureaus and I got the loan in XXXX in which she indeed saw so if it was to report it would've reported already. I explained that she could contact them I could do a conference call, I could even fax over documentation or she could look on the website. Ms.XXXX then stated she cant look on the website or do any of the above to verify. she said it COULD be a payday loan and i COULD be telling the truth but she cant go off of the possibility. this was very contradicting because the supervisors rep that i talked to earlier had already explained that both him and her was looking up the website to get info. Fast forward I was denied the loan not due to my credit worthiness or my payment history but simply because my personal banking transaction that has NOTHING to do with the information they retrieved from my credit report at that time Especially if I was already approved. I was never told that they would snoop through my banking info, I was told the sole purpose of logging into my banking through their site was to confirm my routing and account number not dissect my transactions. I feel as if this company has invaded my privacy as well as violated federal laws and discriminated against me based upon something that was not factual. XXXX payday loan doesn't and will never report to my credit or anyone elses and legally a persons income That doesn't effect credit worthiness is considered an illegal way to deny a person and that being the ONLY reason. I called the number back and a Mr. XXXX XXXX answered the phone. He already knew who I was based on my phone number ( so he stated ). He asked if I was XXXX XXXX and I stated yes. He stated he was calling about an XXXX online payday loan I had taken out in XXXX and my case was currently in the legal processing department where they were getting ready to file a legal judgement against me for none payment. He asked if I had taken out the loan, and I responded I have no idea it was 4 years ago, but I do not recall ever taken out an online payday loan. He then proceeded to tell me I had 90 days to bring the account current or I would face legal action. I told him I was driving and could not provide my account infromation. I would have to call him when I got settled. He aggreed and said this was fine. I then began to research the phone numbers and found other complaints online about phone # XXXX. I then began to research the company XXXX. I found it was owned and opperated out of Texas by a parent copany named EZCOPR whom the CFpB had taken action against in XXXX and the company was ordered to repay thouasnds of consumers and stop any and all colleciton activity including 3rd pary debt collection. I then began to research the collection company XXXX XXXX XXXX and the only company I was able to find being \" dept collector '' was XXXX XXXX XXXX out of XXXX, MO. I contacted the company using the number listed ( XXXX ). I spoke to a man claiming to be the owner XXXX XXXX XXXX. The individual stated he had recieved several calls over the past month from individuals who had been contacted by XXXX XXXX of XXXX XXXX XXXX and he had no one working there by that name. He stated he even recived a letter from the Missouri Attorney General about unfair debt practices. He stated he runs a repo company and that is the only debt collection he condcuts. Customer deserves a written apology due to each past payday loan, when manager ignores customer requests for securing payday loans taken out in the past approximate two years ; not offering and when mentioned, ignoring him and not allowing customer to secure the loans by a written check ; which past two Advance America 's did do. In other words, she violated the law each and every time a payday loan was taken out, by applying ACH to all those loans, regardless of the customers requests not to do it that way. Company should be fined.\n_________ Customer is a long time faithful customer since about  XXXX , starting out at the  XXXX  and  XXXX ,   XXXX   CA store. Always on time. Those stores of past always insisted on a written check for security. This is why he knows there is something wrong with management at   XXXX   XXXX   CA, Advance America.\n_________ 3. Customer demands written apology for discrimination by  XXXX , when she took a snap photo with her phone app, and dressed him like a woman and shared it with  XXXX  and laughed at him. Making customer feel discriminated against because that is what they thought about him.\n_________ 4. Customer deserves an additional written apology from   XXXX   for  XXXX  shorting him {$10.00} cash upon a {$960.00} payment.   XXXX   applied {$950.00} on   XXXX   XXXX   XXXX  , to the installment loan. Had customer not caught it, then then  XXXX  and  XXXX  would have had {$10.00} extra for themselves. Causing customer to suspect extortion and/or, fraud because of the way he has been looked upon, made fun of, manipulated and mistreated previously by manager  XXXX  in the presence of   XXXX    ; including asking for food and accepting cash instead, for lunch when customer had no time to go get   XXXX   food ; and by  XXXX  allowing  XXXX  to assign a higher interest loan prior to that payment, then snickering about it, immediately after and then dragging   XXXX   away, outdoors quickly after the check and contract was handed to customer, etc..\nThis causes customer to be more suspect than ever, because he feels   XXXX   is teaching  XXXX  these bad habits. These two started treating customer differently over the past few months prior. Showing bad attitude and rejection, after customer made a large payment at another AA on a previous installment loan when it was not accepted by  XXXX . Customer was also forced to take out a payday loan at another AA when  XXXX  insisted customers bank account was closed ; causing customer stress and worry and it turned out to be a lie. These are the games customer has been putting up with.\nEven after that, manager   XXXX   refused customers new statement of proof of active bank account, when he took it in to prove it was not closed. And, manager   XXXX   locks  XXXX  out of taking payments or giving loans while manager goes on break so, only  XXXX  ( the less experienced and poorly groomed clerk ) could access computer for processing payments and loans. Customer would have preferred  XXXX , because of the way he was being treated by  XXXX  and  XXXX , and  XXXX  is the one with more experience, she is careful, mature and  XXXX  has not treated customer with disrespect or tricks. There are 30 days in the month and my mortgage is not late but as I have told you before they have been charging me late fees like my loan is a payday loan harassing like my loan was in default and treating it like a payday loan. This past month it was a glitch with my employer and sent in my paycheck through, which caused a payment to be rejected, but I have sent them payment which they should have received because I have the certified letter if not, they should have it in their office for XXXX and XXXX of this year. My complaint is I have received six certified letters saying the same thing. And I signed for three of them at the post office just the other day I opened them up at the post office cause I wanted somebody else to see just what I was getting. I can not post this letter online because it contains my account information and some personal information but nobody should get 11 letters every month in the post office and at my physical address saying the same thing. I know what has happened in my life. Im very conscious and cognizant of what is going on, and they need to stop the harassment process. No reputable financial institution like XXXX XXXX or which are the big banks continually sent out letters and six of them certified saying the same thing. Its a waste of time. Its a waste of resources. One letter would have sufficed. I have also notified the FHA of what has been going on and I have taken a picture of the check that I have sent them that they should have in their possession of {$3000.00} which has to be applied to my account and not set aside in their special account, which they have done in the past, which is not legal because they told me they have to accept and apply all payments to my account. Im quite sure if they had sent all these letters to me that they are harassing other people in the same way instead of the phone calls they just sent out multiple mailing stating the same thing. I plan to meet my obligation and you can not help computer glitches that occur within another company. Carrington LLC should be ashamed of their harassment tactics that they use against their customers.
