I had a screening process in place which obviously was ineffective, so I continued to believe that the lender I was dealing with was honest. The problem I need help with is that several of those lenders contacted me and agreed to give me the loan. Three or four times, their method was to tell me they would be depositing a check into my checking account to verify it was authentic. Once the check cleared, I was to withdraw the amount of the check and wire it back to them which was when they would be transferring my loan. Each time, the check bounced a few days later. As a result, both the bank and I lost money. The last couple of times, I contacted the bank to make sure the check had cleared. I was assured it had so I did withdraw the funds and wire them back to the \" lender ''. I never got a penny from any of them but the worst thing was that, eventually, I was listed on ChexSystems (? ) and I have not been able to open any kind of bank account for the last two years. I did not make a penny from the transactions and, although it was my checking account, the bank did clear the checks before I withdrew the amount of the check. I have receipts for just about every penny that I was scammed out of online. In fact, I have been notified that I will be getting a decent amount from a suit the government has done with XXXX XXXX regarding their participation in these scams. I hope there is someway you can give me to get this cleared up and my name removed from ChexSystems so I can open a checking/savings account. They were aware of the issue and currently resolving the problem. He then proceeded to assure me the funds would be available by XXXX XXXX on XX/XX/2021. At XXXX, there was no deposit. The funds were received over 36 hrs ago as confirmed by both the sender and USAA representative, XXXX. \n\nAt XXXX XXXX, I contacted USAA Customer Service. I was informed the wire department was gone for the day. I politely asked to speak to a supervisor in hopes of elevating the issue and ensuring the case was documented. No supervisor was available. All I could speak to was an executive resolution specialist, XXXX could not provide any indication if/when the funds would be posted. She also explained that there were no supervisors available ( she inferred a supervisor might be able to access more information to explain why this was occurred ). \n\nI'm sorry, this is unacceptable. {$77000.00} is a lot of money and not being deposited in a timely manner is not in accordance with standard practices/regulations. I'm now with XXXX XXXX XXXX XXXX because I have a credit card through them and in order to keep the credit card you need a savings account so I went to a capital one branch, got a check written out to me and closed my savings account but I only took out so much and left the remaining balance in the 360 checking account. On XX/XX/XXXX ( the very next day ) I called into capital one to dispute some transactions that only added up to {$20.00} dollars. While I was on the phone, one of the representatives asked me to hold because there were notes on my account ( I always call into capital one and their is never any notes on my account ). She had me on hold for about 10mins reviewing the notes, she gets back on the phone and tells me that my funds will be on hold because capital one doesn't want to do business with me anymore because of the issue that happened LAST summer. I was so confused because capital one had already informed me that the fraud account was closed and that I didn't owe them anything which is why they opened me up a brand new 360 checking account with a savings. If capital one didn't want to do business with me, they would have said that after they investigated the account instead of giving me a new XXXX and telling me that I'm ok. I deposited over XXXX in my savings and once I removed it thats when capital one threw this at me. I spoke with the head manager of the department and she basically laughed in my face and said I owe them that money but I don't because the account was supposed to have been closed months ago! I even called capital one in XX/XX/XXXX to make sure the account was closed before I put my money in the savings account and the representative said \" yes you shouldn't see the account on your online banking because its closing '' I said ok thank you and he told me not to worry about the account. Everyone knows that when you put money into a savings account its helping the bank. In anticipation of todays closing, I called customer service at your bank last week ( XX/XX/XXXX ) to confirm that I would in fact be able to process a wire transfer to the title company ahead of closing. No problem XXXX XXXX I was told, just give us a call and we can help you out. So, last night ( XX/XX/XXXX ) as instructed, I called to execute the wire transfer only to be told that no, I would not be able to send said wire as the account was less than 60 days old. But, you can drive 1 hour out of your way XXXX XXXX to our branch in XXXX, NJ and they will be able to issue you a cashiers check. Ok, I asked again to re-confirm and was told unequivocally that I would have no problems getting the check. \n\nSo today ( XX/XX/XXXX ) we hopped in the car, drove to XXXX and arrived at the branch to collect the cashiers check, only to be told that, no, they were in fact unable to authorize a check because my mobile phone doesnt match some mysterious registry in your system. My phone is in my name, with my billing address, but provided to me through XXXX XXXX XXXX. I spent over 6 hours in the XXXX branch, trying to reason with the branch manager, calling your customer support lines, speaking with anyone I could. All I got were redirects, non-answers and no clear help. I did get my identity verified through my passport, my SSN, my license, my physical presence in the branch, a text message to the very mobile phone they said they could not send a OTP to but none of this helped resolve the problem. \n\nSo we have now missed our home closing and have no clear path to resolving this problem. Anyway, I called Bank of America on XX/XX/XXXX and spoke with a representative. I was concerned about this being reported to the credit bureau he said it would not if I made the payment within 30 days so I immediately made the payment. I also inquired what would happen with the auto withdrawal from my checking because it appeared as if it was going to take out over {$2000.00} for XXXX and XXXX and not reset to reflect the payment I had made. It is important to note the appropriate amount of money was in the account to cover the XXXX payment. I was advised to speak with the check and savings department to stop the payment and was transferred. The call was then dropped. The issue is I could not stop the payment on my end. Everything had already been programmed even though my home equity account said I only owed my XXXX amount. \n\nOn XX/XX/XXXX, Bank of America withdrew over {$2000.00} to apparently cover XXXX and XXXX which makes NO SENSE. But there was only money in the account to cover XXXX. When I discovered this on XX/XX/XXXX, I immediately called XXXX at XXXX. My account said the $ XXXX was to cover XXXX and the remaining was to be applied to the principal ( THIS IS NOT WHAT MY ACCOUNT CURRENTLY SAYS... THEY CHANGED IT ). In the call on XX/XX/XXXX, I said put only the principal amount back into my checking account so that does not show overdrawn and keep the XXXX payment, and the representative said no problem and I was on the phone with her until she was finished putting in the request. I was under the impression everything was fine. She gave me no reason to think otherwise. \n\nToday, XX/XX/XXXX, EVERYTHING is NOT fine. They said I insufficient funds in the account to cover the XXXX payment which is a complete LIE!! Additionally, they did not do what I asked them to do and what they told me they were going to do. I was then going to make the payment with them over the phone using my Bank of America account and I was told my home equity account had been flagged where I could no longer do electronic transfers or send a check. I have to get a money order or certified check and mail it to them. I am FURIOUS about this because the WHOLE thing was created by their system problems even in XXXX. \n\nI should not be flagged and I should not be punished for their systems. Also, a lender SHOULD NOT make it more difficult for someone to make their mortgage payment. I even asked if I could to to the branch and the answer was NO. I am also very concerned because information on my account continues to mysteriously change. For example, on XX/XX/XXXX my account said a payment had been applied to the principal and then that mysteriously changed to Insufficient Funds for the XXXX payment ( THAT MAKES NO SENSE!!! They should not be withdrawing ANYTHING for XXXX ). It should state the principal amount was refunded to my account which they DID NOT do. We made a phone pmt on XX/XX/XXXX. It is now XX/XX/XXXX and they still have not posted the pmt. We have talked to them 3 times since making pmt. Each phone call last average of two hours. They PURPOSEFULLY make it Very difficult to pay. We called on the XXXX and asked why the pmt wasn't posted, they claimed bank rejected it. We went to bank and got a read out of the day before, day of and day after and talked to bank. They said PHH never attempted to withdrawal funds even though PHH claimed it was bank error. It was NOT. On XXXX XXXX  they reinitiated the pmt and again said it would not post for several days ( they declined to make a debit card payment and only would accept check ). We also have attempted to fill out paperwork to be able to make online pmts. NEVER has any other company been so deceptive, and purposefully negligent that makes it close to impossible to make payments and have them correctly posted. XXXX XXXX in the loan holder and they used to use OCWEN Mortgage Servicing but had to pay out due to fraudulent/predatory lending. They had to pay us as well. Then they just changed names to PHH but same fraudulent/predatory practices are remaining. WE WILL NOT LOOSE THIS HOUSE. THEY WILL NOT WIN! \nLast time they did this they held all our funds they would not apply to account ( because they said since it was late it was all due... XXXX assured us that we would only be responsible for a {$4000.00} earnest deposit, of which was to ensure were serious about the purchase and that check would be refunded back to us at closing. \n\nWe were also told that additional savings of {$8500.00} closing cost would be taken care of by XXXX. We were advised of the stipulations of the agreement of which we would have to list and sell my current home by a certain dates as well as pre-qualify with their lender. After consideration we agreed to the offer and paid the earnest deposit. We had also been pre-qualified with their chosen lender. \n\nIn a few months after the pre-qualification, we had kept our end of the contract and listed and sold our home within the specified time frame. We were then contacted by the lender advised that we were not qualified anymore because I had been in a loan modification and was now ineligible due to. I assured him that was an error and that had not been in a modification and regardless was told I no longer qualified. \n\nI went back to XXXX of which XXXX then told us that he had gotten approval to honor the agreement with any lender we chose. We immediately found another lender, XXXX XXXX on XX/XX/XXXX who pre-approved us with no issues even at a better interest rate. The previous lender then found and error they made as we advised them and then tried to come back and continue business after they had rudely treated us. We had another hard inquiry on my credit report but other than that XXXX had been very professional and had worked diligently to ensure our loan process was timely, so we happily continued working with him. \n\nAround XX/XX/XXXX we were notified by XXXX that XXXX was nullifying their previous agreement and to continue to have the {$8500.00} of closing cost I would have to go through another of XXXX chosen lenders, Embrace Home Loans. I have been under the impression that due to the changing value of the home since the pandemic XXXX has been trying to push me away intentionally. \nWe were notified that we would not be getting the {$4000.00} earnest deposit back. I have purchased homes in my past but never have I been made to give 12 months of bank statements. I was told I am not allowed to redact ANY of my personal information off my bank statements down to the price if gas and a cheeseburger. \n\nI was accused of not providing correct information of my child support and that I was delinquent on the payment. I have been not only proudly taking care of my children I have been employed with same employer for over 10 years. I had also supplied several of my government pay stubs that showed child support had been continually taken out of my check and the exact same amounts on each check. \n\nI provided several documents from the attorney general, all of which proving I have not been delinquent. I was finally told they understood my payments and then other issues arose regarding bills that I have timely paid. I asked them to place the money back in my checking. They essentially told me 'tough luck ', but you can take another draw on the PayDay loan tomorrow... for which they'll naturally assess a fee, I pointed out, and that would not give me access to necessary funds today. \n\nI've since discovered that Fifth Third is charging me an exorbitant amount of fees monthly, again, for which I'm sure I'm responsible for not reading the fine print. I've always been told that they were considered 'fee heavy ', conservative lenders, but since I've had only a few minor problems with them over the years, I chose to ignore it. Today was the last straw. \n\nI know PayDay loans are legal, but they are without a doubt, predatory, and Fifth Third 's is no exception. In spite of multiple attempts to give address corrections to Dovenmuehle since XX/XX/XXXX, Dovenmuehle failed to make corrections to our mailing address and also inform us of the account changes. Even Dovenmuehle sold the loan to XXXX XXXX, they continued to cash our checks. XX/XX/XXXX-XX/XX/XXXX they forwarded our money to XXXX XXXX, however in XX/XX/XXXX they stopped forwarding the money to lender-live, however continued to cash our checks vs returning the checks to our banking institution ( XXXX ). The only reason we became aware of the now 4 months past due amount on this loan for our rental property in XXXX is because we are trying to buy a home here in XXXX since XXXX. Our credit score was in the XXXX 's back in XXXX and now they are at XXXX and we need this black eye removed from our credit ASAP so we can buy this house and get kids in schoolWe have brought the account current by taking XXXX dollars out of our savings because Dovenmuehle refuses to tell us when we will have our money back. XXXX refuses to acknowledge the mix up and provide us a letter to clear the issue up with the ( XXXX ) credit companies. My wife and I own XXXX homes as we have spent the last 20 years in the service to our country and through deployments we still have religiously paid all of our bills through the XXXX bill pay service every month for payment on this property ( XXXX XXXX XXXX XXXX, XXXX XXXX ) and every other property. \n\nI confident that when you review the attachments outlining the facts, you will see that we are not at fault here and an investigation into this prepdatory lending on all the above named parties in warranted.
