When you receive a discharge in bankruptcy it also discharges your personal liability for the mortgages on the home. It does not remove the mortgage lien that exists on your home. This means that if you fail to make the payments on the home, then the mortgage company can foreclose on the home but can not pursue you for any deficiency judgment. \nMortgage companies will not report your mortgage payments because they are concerned that it violates the automatic stay or discharge injunction. The concern is that reporting the payments on the credit report can be treated as an attempt to collect a discharged debt. This can subject the mortgage company to a discharge violation in bankruptcy court. During all this time from XXXX to present, I have been responsible for the mortgage payment. Payments have been made on time. The loan originated in XXXX and was in my name only and we refinanced in XXXX and at that time my ex husband was added to the mortgage. My name was not included at all in his bankruptcy. Fast forward to XXXX, I apply for a new mortgage and am told my mortgage is not on my credit report. There is no record of me having a mortgage even from XXXX or from XXXX. I called my mortgage company and they said in XXXX when he filed bankruptcy they stopped reporting mortgage payments. I could understand this if was still responsible for the loan in anyway or if we were both listed on the bankruptcy. I don't understand why my credit reporting was stopped due to his bankruptcy. Now, I have no record of 16 years of mortgage payments in excellent standing. My credit is horrible through no fault of my own. The mortgage company said they will start reporting my mortgage payments as of XX/XX/XXXX but will not do anything about the past 16 years. I would like my credit report to reflect my mortgage for the entire life of the mortgage or at least from XXXX forward. They said it was a past due balance on our mortgage.
