This includes : Providing a detailed history of all payments made by the borrower. \nAuditing and verifying principal, interest, and escrow balances before transferring the loan. \nCaliber failed to meet these requirements, as evidenced by XXXX XXXX incomplete responses and the lack of clarity regarding the adjustments made to the balance during the transfer.\n\nNon-compliance with the Truth in Lending Act ( TILA ) ( 15 U.S.C. 1639 ) : TILA requires borrowers to receive clear and accurate information about how their payments have been applied to the loan balance.\n\nCalibers refusal to provide a complete and verifiable payment history constitutes a violation of this right, as it prevents borrowers from understanding how their loan was managed.\n\nLack of transparency : The absence of a detailed payment history and discrepancies in the transferred balances demonstrate mismanagement and a lack of transparency, raising concerns about the accuracy of the account while it was under Caliber Home Loans servicing.\n\nImpact of Violations The lack of clear and detailed information has created confusion about how payments made were applied to principal, interest, and escrow.\n\nDiscrepancies in the transferred balances have undermined my confidence in the management of my mortgage account.\n\nCaliber Home Loans failure to audit the account has shifted the burden of verification onto the borrower, which is unacceptable under applicable laws.\n\nFormal Requests I respectfully request the CFPBs intervention to ensure that Caliber Home Loans complies with its legal obligations under RESPA and TILA. Instead, Valon Mortgage received incomplete and fragmented information, as evidenced by their inability to provide a full breakdown of payments dating back to the loans origination in XX/XX/XXXX. \nRepeated Requests for a Complete Audit : Starting in XX/XX/XXXX, I have repeatedly requested a full and detailed payment history, including a breakdown of how payments were applied to the principal, interest, escrow, and other charges from the loans inception. \nValon Mortgage has consistently avoided providing a full audit or verifying the accuracy of the data transferred from XXXX. Instead, they have cited limitations, including their inability to generate a historical amortization schedule or audit how additional principal payments impacted the loan. \nEscalations and Delays : Valon Mortgage has repeatedly delayed addressing my concerns. Most recently, on XX/XX/XXXX, they requested an additional XXXX XXXX for an investigation, continuing a pattern of delay that has persisted for nearly XXXX XXXX \nImpact of Incomplete Information : The absence of a complete payment history has created significant confusion regarding : How payments were applied prior to and after the transfer. \nHow escrow funds were managed, including contributions and disbursements. \nHow additional principal payments were allocated. \nThis lack of clarity prevents me from verifying the accuracy of my account and raises doubts about whether XXXX XXXX XXXX conducted a proper audit before transferring the account. \nViolations Identified Federal Violations ( RESPA and TILA ) : Real Estate Settlement Procedures Act ( RESPA ) ( 12 U.S.C. 2605 ) : Requires loan servicers to ensure that all account information, including payment histories, is accurately transferred during a servicing transfer. \nMandates that servicers provide a detailed and complete payment history upon request, including an explanation of how payments were applied. The note has been separated from the deed and I have proof. My loan audits from the XXXX XXXX and from XXXX XXXX are available upon request. I am in Florida now caring for my ailing Mother since XXXX. Keep this in mind as if I reinstate the case in XXXX I'll need to obtain a lawyer. Otherwise maybe other arrangements could be made. I made my three trial payments for modification then they illegally forclosed twice before as XXXX XXXX saved my house by filing bankruptcy for me in XXXX and XXXX. I was not the borrower on this loan, did not apply for this loan, and did not authorize any involvement. The 2025 loan application was submitted solely by my wife, who resides in another state. I reside in Virginia. Despite this, the loan officer repeatedly contacted me attempting to schedule a signing appointment.\n\n2. The signing packet I was given contained multiple blank documents, including blank Affidavit of Title pages and other blank documents related to my ownership interest. These blank documents were included inside the official closing package. I was pressured to sign the entire packet, even though several documents were blank and others contained misspellings, inaccurate information, and incorrect references. No consumer should ever be asked or pressured to sign blank or inaccurate documents in a mortgage transaction. This raises serious concerns about document integrity, potential misuse, and compliance violations.\n\n3. After I refused to sign the packet due to the blank and inaccurate documents, the loan officer offered me a {$300.00} gift card. When I still refused, I was offered a {$500.00} gift card. These inducements were inappropriate, coercive, and raise serious concerns about the legitimacy of the transaction.\n\n4. I also received a separate phone call and text message from an individual claiming to be the loan officers supervisor ( boss ). This person attempted to reassure me that the loan officers actions were legitimate and encouraged me to sign documents. All calls and texts came from personal cell phones. If the lender claims they have no internal record of these contacts, that would indicate a failure to maintain required communication logs, which is itself a compliance violation. 5. My wife emailed me askin\ng me to sign documents. Independence Home Loans was aware that we live in different states. Any electronic signature attributed to me that originated from her email address, her device, or her location should have been an immediate compliance red flag.\n\n6. The lenders previous response falsely stated that I took one document from the notary appointment. This is incorrect. The notary provided me with the entire unsigned closing package ( over 100 pages ) and told me I could keep it since I would not be signing. I still have the full package.\n\n7. The lender misrepresented this transaction as the second part of your loan, which is false. I did not apply for a second loan, did not initiate a 2025 application, and did not request any additional transaction.\n\n8. The lender told me to ask your wife who signed, which is not an acceptable response under federal esignature laws. It is the lenders responsibilitynot mineto maintain and produce the XXXX esignature XXXX XXXX, XXXX of XXXX, XXXX XXXX, authentication method, device metadata, and identityverification records. \n\n9. To date, Independence Home Loans has not provided any of the required esignature compliance documentation. They have not provided the XXXX XXXX XXXX or any identityverification evidence necessary to validate the signature attributed to me. \n\n10. The lenders internal statements contradict the facts. She later stated my entitlement was insufficient but offered that I could bring approximately {$3400.00} to closing to cover the gap and proceed with the assumption. Relying on this guidance, we sold our home and prepared to close. \nShortly thereafter, the assumption was denied. I appealed the decision, and XXXX XXXX conducted an internal audit that included listening to recorded phone conversations between myself and the loan XXXX, as well as reviewing all email correspondence. The audit confirmed I was given incorrect information multiple times. Navy Federal then offered to initiate a new VA loan and honor the XXXX XXXX interest rate from the assumption. However, they required me to reapply from scratch for the new loan, which included pulling my credit again. Based on these assurances, I moved forward, believing the matter was resolved. \nOnce the new loan was in process, Navy Federals pricing team refused to honor the agreed XXXX XXXX rate. This decision was upheld by supervisors despite prior promises. The issue was escalated to NFCUs compliance team, which is now reviewing whether any policies or regulations were violated.\n\nThis process dragged on for nearly three months. During that time, the sellers of the home we were purchasing almost terminated the contract after we had already sold our home. To keep the deal alive, we had to negotiate a rental agreement while the matter was being investigated. Navy Federal never fixed the issues they created, forcing us to take drastic measures to secure the purchase. \nTo complete the transaction, we were forced to pay off a rental property to free up our VA entitlement ( requiring us to get money from family members and liquidate assets ).
