HSBC 's illegal acts have caused me significant hardship. I am currently unemployed and do not have a permanent residence. Because of my difficult financial situation, I rely almost entirely on unemployment income deposited to my account to make ends meet. Over a XXXX month period, HSBC repeatedly refused to release the exempt funds in my account despite my concerted efforts. I had no money at all during this time and had to rely on friends and family to support me. \nOn or around XXXX XXXX, 2015, HSBC received a restraining notice against my account and levied a {$100.00} fee. ( Exhibit 1 ) The restraining notice was issued pursuant to XXXX law, in enforcement of a XXXX judgment. ( Exhibit 2 XXXX XXXX law provides that a restraining notice shall not apply to a bank account that contains less than a statutorily protected minimum amount ( currently {$2100.00} XXXX. If the account contains less than {$2100.00}, the restraining notice is deemed void. XXXX XXXX XXXX ( i ). At the time of the restraint, I had only {$270.00} in my account, far below the statutory minimum of {$2100.00}. Therefore, the restraining notice was void and my account never should have been restrained. \nUpon unlawfully restraining the account, HSBC failed to send me notice and an exemption claim form. XXXX XXXX XXXX ( b ) ( XXXX ). The next day, XXXX XXXX, {$490.00} in unemployment benefits were directly deposited to my account and restrained, even though unemployment benefits are exempt from restraint by law. ( Exhibit 1 ). Shortly thereafter, I attempted to make cash withdrawal from an HSBC branch XXXX, and was only then informed for the first time that the account was frozen. When I complained that my account contained exempt funds, the bank representative told me that there was nothing she could do. \nOn XXXX XXXX, 2015, with the help of an advocate from New Economy Project, I reached out to the HSBC XXXX Department and was wrongly told by a representative that the restraint was not governed by XXXX law because the account was opened XXXX. The representative proceeded to place me on hold for over one hour and told me that an attorney from HSBC would contact me during the week, but no attorney ever contacted me. On XXXX XXXX, 2015, I reached out to HSBC a second time and was told by a representative to call the following Monday as no one in their Legal Department was available. The following Monday, XXXX XXXX, 2015, I called HSBC for a third time and was not allowed to speak to a bank attorney but was told once more that XXXX law did not apply. On XXXX XXXX, 2015, an attorney from New Economy Project spoke directly with the HSBC XXXX Department and explained that EIPA applies to my account and that the restraint was void, but once again HSBC refused to release the account. \nOn XXXX XXXX, 2015, New Economy Project reached out to the creditor 's attorney who agreed that the account should not have been restrained and offered to request that HSBC release the account. The creditor 's attorney informed us that she had received a legal opinion letter from HSBC reiterating an incorrect legal position. HSBC did not share the opinion letter with me or New Economy Project, but apparently the letter stated that EIPA did not apply because the account was opened XXXX. There is no basis in XXXX law for this opinion. To the contrary, the law is quite clear that a XXXX restraining notice does not apply to bank accounts containing less than {$2100.00}, and there is no geographic limitation on this protection. It is only now in XX/XX/XXXX, that I called again to discuss repayment possibilities because I became aware of programs that apply to me that were never offered by Navient. And it is only now, Navient was more than helpful. As a XXXX I am eligible for Loan Forgiveness. I am also, miraculously, eligible for Income-Driven Repayment, which was denied to me before and will not do anything for me now that  Navient has collected all of their interest from my loans. It will actually only lengthen my payments to provide Navient with additional interest. I am very displeased with the prior service of my Navient provider. I missed out on very helpful programs that I was eligible for at the time they were denied or not offered. I made very large payments that were interest-only, only benefiting Navient and putting my family in turmoil. I was advised by the XXXX that the account has been terminated as fraudulent and that no further action was required. \n\nOn XX/XX/2021, KeyBank mailed an account statement, related to the fraudulent account to the address that was used to fraudulently obtain unemployment benefits. This letter included my identification information and the last XXXX digits of an account that was reportedly ( 1 ) never opened and ( 2 ) terminated by inactivity. I called KeyBank yesterday to report the fraudulent transaction. I was disconnected by their automated system twice. There was no option to speak with a representative directly. Their fraud department would not permit me to file a fraud complaint because it could not locate the fraudulent account. Upon reaching a supervisor, I was instructed that my only recourse was to contact the XXXX. When I inquired as to the recent letter, which was mailed by KeyBank, not the DOL, I was told that they mailed XXXX XXXX letters to anyone that may or may not have accounts, without regard to any reports of fraud. I was told that they do not scrub their accounts for reports of fraud to make sure that the notices that they are mailing are not sent to addresses that were previously reported as fraudulent. Despite having reported the fraud XXXX months ago, the fraudulent address remains an active and valid address in KeyBank 's system, without explanation, and without the ability for me to do anything about it. I was told that since I did not open the account, even though it was opened in my name and I am the reported beneficiary, but rather the XXXX opened the account, without my consent, I have no right to any information regarding the account. Therefore, KeyBank refuses to confirm in writing that the account has been closed. So, that they could reduce my monthly interest from 30 % to 6 %. However, when I return from XXXX my statement still showed that I was being charged 30 % and I paid off the balance because I did not want any problems unfortunately they did not lower the percentage they were charging me from 30 % to 6 % all the time that I was XXXX in XXXX. \n\nI want to add that when I return from XXXX I applied for unemployment benefits I received some payments, but unemployment benefits were taken from me by the state of XXXX. I got only XXXX check for {$500.00}. \n\nPresident Obama signed an extension of unemployment benefits I went ahead and applied for unemployment benefits extension, and the web site told me that I did not qualify for unemployment Benefits. I had no income to pay or do anything extra all I had was my {$360.00} dollars a month for my XXXXXXXX XXXX  weekends. All this time that I was unemployed I attended school. I enrolled in an XXXX XXXX XXXX XXXX, so that I could apply for an IT job. I now work for the IRS and started to work in XX/XX/XXXX. I contacted the bank spoke with claims department, dispute resolution XXXX but all I got was there was no error or I must have gave another person authorization to get the money from my account. I was working in the XXXX area at that time and I was having trouble with my mail and receiving my important mail, I had to put a hold on my mail because it was being stolen. Apparently I had received notices from the bank about my account reevaluation of my claims and they were all in my favor. I explained that I was not getting the mail, I had my room broken into and my information was stolen. There was apparently several new cards ordered and sent to my residence but I never knew anything because I was only able to go home on the weekends and sometimes not even that. I almost never was home so it was impossible to get my mail or anything for that matter, I tried to get help with the bank account and I asked on several occasions if they could close the account and open a new one due to the account being compromised but i was told that they were not able to do that. I have gotten notice after notice denying the reimbursement of the stolen funds and I have been evicted from my apartment, lost my car because I was not able to make the payments and I would like to get my money back from the fraudulent activity. I have filed reports, complaints, grievance and even filed a report to the FDIC but I have not gotten any results. How can they determine that when i never received a card at my address BECAUSE ALL MY MAIL WAS BEING FORWARDED TO A DIFFERENT MAILING ADDRESS. I ALSO ASKED FOR THEM TO SEND ME THEIR SUPPORTING DOCUMENTS ON THEIR FINDING FOR THAT DENIAL AND ALL THEY SEND ME WAS THAT REASON BUT NOTHING ELSE SHOWING THE CARDS WERE SUCCESSFULLY ACTIVATED WITH MY CREDENTIALS. I have dealt with people giving me conflicting information and receive conflicting letters regarding what options may be available for me to save my house. Now Ocwen is trying to sell my home at auction and I have had to take extraordinary measures to stop this from happening. I have owned my home for 18 years and feel that Ocwen is not being straight with me or giving me a chance to fix this problem. \n\nI feel I was misled from the beginning when I took out this loan. I had refinanced in XX/XX/XXXX into a bad adjustable rate loan with an interest rate of 9.95 % and then just five months later the same people at XXXX steered me into a NEW adjustable rate loan. They made it seem like a good deal at the time but I did not realize they were slamming me with points and junk fees and a bad loan with a rate starting at 9.9 % that could go up to 13.9 %. I feel they steered me into these predatory loans so that they could keep me refinancing over and over as property values were going up in order to maximize their points and fees. \n\nWhen the recession hit in XX/XX/XXXX I was in a tough spot. I worked in XXXX and lost my job, and then was in and out of work for a couple of years. At the same time my mortgage had adjusted and the payment went up and due to these two factors I began missing payments. Eventually the loan was transferred to Litton Loans and my job situation stabilized and I reached out in hopes that I could be reviewed for a loan modification. I went through the ringer with Litton, submitting and resubmitting my information on multiple occasions and never making any progress. It was beyond frustrating, because at that I time I was making good money and wanted to resolve my mortgage problem. Unfortunately I never was able to actually get reviewed. \n\nI then found that the loan had been transferred to Ocwen ( several months after the transfer actually occurred! ). I call in and speak with agents who tell me that I am eligible for loan modification options and receive letters that say the same thing. But when I apply and send the paperwork in I receive a response letter that there are no options available except for short sale or deed in lieu of foreclosure. There is no explanation as to why these are the only options available, the letter just says that is the way it is. Then when I call in I am invited to apply for modification again and then I receive new letters that tell me to apply for modification. So it is like I am on a hamster wheel going round and round and making no progress and getting no answers. \n\nAt this time I am unemployed, but have an unemployment hearing coming up in a couple of weeks. I believe there are programs available that allow homeowners who are unemployed to defer payments or receive some type of forbearance plan while waiting for benefit approval. Because of this, I was forced to file for Chapter XXXX Bankruptcy in XXXX and at about the same time, XXXX XXXX was finally able to put together a modification package that in no way I did agree with because the market value of my home was in the low 100s and XXXX XXXX was asking that I pay Mortgage amount $ XXXX+ {$93000.00} (??? ) = {>= $1,000,000} at a time when they knew it would had been impossible for them to sell my home for that amount, which it was over 3 times the market value. I had no other way to save my home and applying for another mortgage was not an option due to unemployment. Therefore, unless I was willing to be homeless, I had no other alternative but to accept XXXX XXXX modification, which I did in XXXX. According to Modification documents, the interest rate to be applied was contained in Section 3C of the Modification and NO INTEREST would be accrued/added on the {$93000.00} amount that it was deferred although I never agreed in having that amount added to the Principal as it was accrued during the time XXXX XXXX could not accept payments and/or negotiate a modification due to its Attorneys wrong doing. The attorneys should have been liable for that amount. No me. To my surprise, as I was putting together documents to file Income Tax in XXXX, I realized that I was being charged interest in the {$93000.00} Deferred amount since XXXX and continue to be charged ( copy of Statements attached ), which it was confirmed by XXXX XXXX, Executive Resolution Specialist, as per letter dated XX/XX/XXXX attached. To make things worse, I just received Letter signed by XXXX XXXX, XXXX Senior Vice President, stating that my Original Mortgage Note had been sold/transferred to another Server : Rushmore Loan Management Services , LLC. My original loan was not confirmed under Bankruptcy under chapter XXXX that I filed prior to Modification and therefore, I am not liable to pay that amount. Besides, the original note is for amount higher that I did owe at time of Modification, however, I contacted Rushmore Loan Management Services , LLC to request clarification on this and could not get a response. \n\nI feel that XXXX XXXX used the Modification Mechanism to take advantage of People who like myself, did not have any other choice in order to save their homes. If the Modification really demanded interest in the deferred amount, the Modification material was totally deceiving in its content and I feel victimized by XXXX XXXX actions. According to a new policy statement, the Consumer Financial Protection Bureau ( CFPB ) will cite conduct as abusive only when the harm to consumers outweighs the benefit. It has been over 90 days, and this dispute still has not been resolved. I have not received any edd payment or provisional credit. On XXXX I called the customer service line at XXXX XXXX processing, and spoke to a customer service representative, who advised me my claim had been escalated to an escalation team and that provisional credit was not required to be granted as I dont think actually happened as Bank of America made a decision within XXXX days of me filing a dispute.and stated I only have {$7.00} on a card I never spent unemployment on and been waiting the last 3 years, There is nothing in the Code of Fedderal regulations that states provisional credit will not be granted if a decision and determination regarding the claim is made within 10 days. Bank of America has exceeded the 90 day time frame as specified in the CFR, denied my request for provisional credit, and did not complete their investigation in a timely manner. I am requesting provisional credit to be credited to my account immediately, and I want Bank of America to provide me a written explanation of their investigation findings, which was conducted in XXXX  of XXXX. There is no way that a thorough investigation could be completed XXXX  days, given the number of claimants during this time who had disputes against Bank of America for unauthorized purchases and transactions taken out from their XXXX benefits. This was something we didnt anticipate happening and certainly took a toll on our financial situation. I applied for unemployment and was granted a percentage of what I was making but it wasnt enough to be able to sustain our household expenses. I immediately began looking for work and reviewing all of our options to be able to have a place to live. Because of our circumstances we had no other choice but to reach out to you ( SPS ) and ask for consideration of a loan modification. I was told that because I was receiving unemployment, we would not be able to do a loan modification. Both my husband and I would have to be working to be able to apply for a loan modification. I was then offered the Unemployment Forbearance Plan. I applied for the plan and qualified. Our mortgage payment was reduced to {$170.00} a month and it was going to be effective for the next 6 months. We accepted the offer and started making our new monthly mortgage payment according to the plan. I continued looking for a job but unfortunately, I was not successful in finding anything. In the beginning of XXXX Covid hit, and my unemployment installments automatically renewed. I began receiving unemployment again. I reached out to SPS to make them aware of the situation and they required me to send a copy of the letter from unemployment where it stated that they were going to renew my unemployment benefits. After SPS reviewed the letter, our monthly mortgage payment was revised to {$310.00}, and our Unemployment Forbearance Plan was extended for an additional 6 months. My unemployment benefits continued being renewed so SPS continued extending our Unemployment Forbearance Plan. In XX/XX/XXXX I received a call from SPS and was told that the Unemployment Forbearance Plan had taken its course and that they could no longer keep me on that plan. I conversated with the person who called to see what other options we had to be able to stay in our home, the person questioned if I felt that we were affected by Covid 19, I answered yes because due to the pandemic it was impossible for me to find a job. We filled out a Covid-19 relief application and in XXXX of XXXX we were put on a Covid Forbearance plan for 6 months. This time they did not require us to make any monthly payments, but we continued making the {$310.00} payment anyways. I was in constant communication with SPS throughout this whole time trying to find out what options we had so we would not lose our home. My Covid Forbearance Plan was ending in XXXX of XXXX. In XXXX of XXXX I reached out to SPS because I had started a new job and wanted to see if we were ablet to now apply for a loan modification. SPS didnt want to work with me or talk to me about any possible options until my forbearance plan ran its course. SPS suggested I call back 2 weeks prior to the plan ending to find out what my options were. When I called back, I was told that I would receive a letter in the mail indicating the final decision. On XX/XX/XXXX I received a letter indicating that I had been granted the opportunity to stay in my home with the condition that I would pay {$1600.00} ( monthly mortgage payment ) + {$1500.00} ( towards the delinquent amount ), totaling {$3200.00} every month for the next year. The new payment plan was not possible for us to make so I called and tried working out something with SPS, but they indicated that it was the only offer they would be able to give to us. I asked the person what would happen if I didnt accept the offer. She said it would be a matter of time before my house would go into foreclosure and we end up losing it. I mentioned to her that if that was the case then it would probably be best to consider selling it so I wouldnt lose getting the equity I had. The person then said that if I wanted to let go of the house, SPS would offer us {$3000.00} - {$10000.00} to leave the house and SPS would just take over it. I told the person that my house had more than that amount in equity and if we decide to sell it, it would be done on our own terms. She stated that she was going to add those notes to our account, and she asked that we look into other outside options such as HUD or maybe finding someone that could help us maybe refinance. I then called HUD and started the process to speak with a counselor. On XX/XX/XXXX my financial counselor ( XXXX XXXX ) and myself got on a three-way call with SPS the mortgage company and tried to figure out what our options were in moving forward and being able to remain in our home. According to the manager XXXX XXXX XXXX she stated that my Covid forbearance had ran out and that the investor ( XXXX ) did not want to offer me any other options other than paying back all the money back that I owed being delinquent. I have family members in similar situations and their mortgage companies have worked with them in providing them with different program that are available here in California to remain in their home. We have not been given the same opportunity and we feel we have done everything in our capacity to work with our mortgage company and I feel that they are not doing their part in helping with the situation. I don't understand how they supposedly offer these programs for people that are in need like myself and then expect for us to pay all the money back. I was and continue to be in a financial hardship because I do not make what I was making before I lost my job, but I am willing and able to make my regular monthly mortgage. But I simply can not afford to pay the additional {$1500.00} on top of my regular monthly mortgage of ( {$1600.00} ) like SPS is requesting if we want to remain in our home. On XX/XX/XXXX I called SPS and spoke to XXXX in customer service and he told me that my account was in fact still protected by the Covid forbearance. He said it did not have an end date because as long as the state still offers Covid forbearance then I would be protected by it. XXXX also stated that there were programs out there for me since I do reside in the state ( California ) that has the most programs available for people like myself. He mentioned about California Relief Program that was implemented in XXXX of XXXX, he also provided me with a number for state assistance ( XXXX ) XXXX for XXXX XXXX XXXX. At this point I was left very confused because the day prior XXXX the manager had stated to my HUD counselor and myself that I was no longer in the Covid forbearance program and that there were no programs or other options available for us. On XXXX I called the customer service line at XXXX XXXX processing, and spoke to a customer service representative, who advised me my claim had been escalated to an escalation team and that provisional credit was not required to be granted as I dont think actually happened as Bank of America made a decision within XXXX days of me filing a dispute.and stated I only have {$7.00} on a card I never spent unemployment on and been waiting the last 3 years, There is nothing in the Code of Fedderal regulations that states provisional credit will not be granted if a decision and determination regarding the claim is made within 10 days. Bank of America has exceeded the 90 day time frame as specified in the CFR, denied my request for provisional credit, and did not complete their investigation in a timely manner. Each you are required to re-apply for the program. You are interviewed and asked about your monthly income, your spouses income and the sum total of your various bills related to basic needs. In this particular interview I was asked by the representative, after explaining to them in detail that I 'm currently not working and on unemployment, how much I make when I am working and how often am I paid. I gave them an estimation of my bi weekly income when I am working for a company. Navient took this information and calculated that I have XXXX in excess income at the end of the month with which to pay my student loans and was denied access to continuing the rate reduction program. I politely asked \" Should I have given you my monthly income on Unemployment? Because that is my current reality '' The representative said I could gather bank statements to submit to them to show proof of my lessening income and reapply. I took her advice, submitted the documents and called again a few days later. The new representative looked at my information and said the original representative would call me back later that day. I waited till the afternoon and received no call so I called back. A new representative explained to me she received my info but never worked on my account and the original representative who told me about the bank statements no longer works for the company. This frustrated me because I had no knowledge of this and should n't a company dealing with such high financial burdens and payments be looking out for the people they are supposed to be aiding in paying them, should n't they have reviewed this ex-employee 's information and noticed that they informed me to submit more information and keep in touch with me. The new representative then explained that the head manager denied my application and there was no way around it. I asked to speak to their manager and while I was transferred it was n't without them adding \" Well my manager looked over you account with me but ok '' I spoke with the next manager and was explained with no sense of empathy that his manager who is \" 3 levels above him '' denied my application, and again \" this is black and white, theres no way around it. The lack of empathy and the almost subtle frustration I could hear in the representatives voice was incredibly offensive considering that my financial burden is n't their personal problem, they do n't have to live with it, they do n't have to talk to their staff and try to find the best solution. I would encourage Navient to actually acquire a heart in their business practices and train their staff to exercise all possible options to aid someone in trying to actively stay \" current '' with their bills. I do not trust that a wire transfer will get it into my bank account, and I have nothing but time with no job so I figure I might as well manually move the money I have been doing this every week without fail since XXXX when I was furloughed from my job. \nNow it is a year later and on Tuesday XX/XX/2021, I go to the ATM to pull out my money as usual and see that I only have a balance of {$4.00} and I was confused because I do did recall seeing the email alerting me to the deposits of {$450.00} and the {$300.00} and so I get back in my car and I look on my Bank of America app to see the transactions on my card and it shows me that {$750.00} was in fact taken out of my account through a XXXX XXXX ATM on the other side of town a XXXX XXXX ATM that I have never been to. So, I call Bank of America to report that money has been stolen out of my account. Later that I did research through the website and saw that it is a standalone ATM machine at XXXX XXXX XXXX XXXX. XXXX XXXX, NV XXXX that sits in the middle of a parking lot. \nI would assume that if Bank of America looked at my pattern of transactions that I take the money out of the only the same ATM each week at XXXX XXXX XXXX XXXX, XXXX, NV XXXX and do not even use my card online or even for regular transactions except for the occasional drive-through order with the remaining balance left on my card less than {$10.00}. The only way that I used my unemployment Bank of America ATM card is at the same ATM machine at XXXX XXXX XXXX XXXX, XXXX, NV XXXX. I am always very careful, and the card has been in my possession the entire time. There is nobody at all with access to my card or pin. Leading me to believe a skimmer has been used to steal my bank information from that ATM machine. \nWhen I talk to somebody at Bank of America, she tells me that there's going to be an investigation to see if I get the missing {$750.00} that was stolen from my account paid back to me, she said that they would send me a new ATM card and turn off my old ATM card and she said that when I received the ATM card in the mail to activate it and check the balance. I then received the card on Thursday XX/XX/2021 and call in to activate it when I was told that my card account was blocked. \nI then spoke to a different young lady that told me that I would have to call the unemployment line to report the fraud and I asked her if she was mistaken because this was a situation that happened through Bank of America 's card and has nothing to do with my unemployment claim and I was told something completely different the day I called to report my card stolen. I asked her if I could speak to somebody else because I felt like she did not understand my situation and she said I could not and told me I would have to call unemployment so I ended my conversation with her and called back to speak to somebody else where I was told the same information over again and told that I would have to call the unemployment line again. I ask her for the actual number that I am supposed to call to report the fraud and at that point she then proceeds to hang up on me. \nAfter trying several times to get back through to Bank of America I finally got ahold of a lady who gave me a contact number which was in fact the same number that everybody else uses for unemployment XXXX. No one I spoke to at Bank of America told me about the actual number for specifically for fraud XXXX. No one I spoke to at Bank of America told me about the websitXXXX XXXX XXXX XXXX XXXX  ) where I would have to upload my driver 's license and social security card front and back before an investigation could even be started it would be helpful if one person at Bank of America had all this information together saving some time. When I get through to unemployment it took me almost 3 hours on hold the first day and another day of 540 total calls to get through to confirm they received my copies of my ID and Social Security card. When I finally got to speak to someone, I was told that I would have to call back in two weeks to see if any progress was made in the investigation into my fraud case and in two weeks I could find out if they were ready to release my identification to Bank of America to tell them to release the block on my account. This was after Bank of America told me that their investigation would take 25 days at least. \nThis does not seem right that Bank of America is punishing the person who was stolen from and blocking me from receiving my NEEDED my unemployment benefits. That was my only source of income. I am a single Mother with a Mortgage and bills to pay and no money to pay them. I have been desperately applying for work since XXXX with no luck and now I can not sleep at night in fear of how long this investigation will take. Bank of America says they are here to help on the letter they sent saying my claim has been closed. Which I believe is very poorly worded and not helpful or comforting at all to someone who lost their only source of income with no relief or timeline coming from Bank of America or XXXX. I understand that there is a lot of fraud investigations in the state of Nevada during this pandemic. In XXXX of XXXX the reliacard was issued XX/XX/XXXX the first unauthorized transaction took place at XXXX in XXXX, wa in the amount of {$1000.00} XX/XX/XXXX XXXX XXXX - {$1000.00} XX/XX/XXXX XXXX XXXX - {$1000.00} XX/XX/XXXX ATM withdrawal - {$500.00} XXXX a {$4.00} fee XX/XX/XXXX ATM withdrawal - {$500.00} XXXX {$4.00} fee XX/XX/XXXX XXXX XXXX - {$1000.00} XX/XX/XXXX XXXX XXXX - {$1000.00} XX/XX/XXXX XXXX XXXX - {$1000.00} XX/XX/XXXX XXXX XXXX - {$1000.00} For a total of {$8100.00} When I was able to confront her about my unemployment claim she gave me the reliacard and a good story to go with it and told me my unemployment benefits were deposited. I was so happy to have it finally I didnt even question anything. Because I no longer had access to my SAW account I had no idea how much money I was suppose to get in the first place leaving me no reason to question the amount of money I had so I went on as usual. Its clear as you look at the transaction history the difference in spending patterns. A very specific set amount at a specific store from the XXXX to the XXXX and then it all becomes very random. This should prove my case even more however the bank said that because the purchases were made in the same city that was used against me. On XX/XX/XXXX I learned of the unauthorized activity and I promptly reported it. It was from this moment on that the bank completely screwed me at every turn. XXXX they did the initial dispute for All the transactions that occurred on my account and that is not how I reported it. They requested specific information from me and that I fax this information to me before they would begin their investigation. I did send them everything requested ( even though I didnt understand all of it ) and when I would call back to check status they would tell me they never received my fax. Sent again, told same thing. When I called to find out why a provisional credit hadnt been given they said they couldnt give XXXX because they needed a police report. So I sent them XXXX. They said they never got it so I sent again. All of this is being done in an attempt to allow so much time to pass that I would no longer be protected under XXXX XXXX The bank opens the dispute on XX/XX/XXXX and sends a denial letter on XX/XX/XXXX that is well over the days 10 days the law allows to provide provisional credit but they never did allow such credit, therefore breaking the law. Everytime I requested evidence be sent to me in their determination they would send to the wrong address. This happens time and time again and when I tried to update my address or phone number they would either say it was updated but never was because I wouldnt get correspondence or they would tell me they couldnt update an address on an account that was stuck in the status mine was in at the time until eventually closed. Again, all this in an attempt to delay any timely correspondences. Ive been lied to repeatedly and no real assistance was ever provided to me. I ended up filing a complaint with the OCC # XXXX but the result of that complaint was that they were not the regulator for that bank. There are several things the bank did in addition to breaking the law that in my opinion are deceptive and misleading for example : When I requested evidence they used in making their decision they repeatedly sent to wrong address even after several phone calls informing them I never received it and updating my information. I NEVER did get anything from the bank it wasnt until I reviewed all the documents in my case filed with the OCC that I saw more discrepancies. \nThey present evidence in such a way that makes it look as though it is me doing the transactions but if you look closely at the atm footage with respect to the date and time you can clearly see the dates do not match up to the dates in question. Yet they present the footage with a ledger balance and activity summary as if those apply. No where in any of the documents or evidence presented do they show any footage of the dates of the actual unauthorized activity. Why dont they show footage from the atm for XX/XX/XXXX and XX/XX/XXXX? Why do they provide evidence for dates of transactions that are not in dispute??? Why dont they show footage of the POS transactions at XXXX XXXX for those first XXXX transactions? Why didnt they provide provisional credit when their investigation was over 10 days? Why didnt they do a complete investigation and if they did then they would clearly see it wasnt me. Why present documentation in such a way to make it look like it was something that it wasnt? Thats probably because they DO have footage or proof it wasnt me but they dont want to credit me my money! Why did they require certain information before beginning their investigation? Why did they require a police report from me? XXXX XXXX XXXX was or is doing business in a misleading and deceptive manner and their business practices have screwed me and probably many others out of their money which in turn has left me homeless. The domino effect this has had on my life is nothing short of tragedy and I want them held accountable. I want my money returned to me and any interest that would have occurred had the fraud not took place and I want the bank to change how they deal with unauthorized activity.
