I attempted to take them to civil court but was unable to. Frustrated, and without any help or financial assistance, I ended my lease early to escape that horrible, abusive environment. Despite never once helping me in an issue THEY were responsible for, they still demanded final month 's rent. I will not pay this until they are finally willing to reimburse me for the money owed due to the water leak. When contacting your company, I was directed to a Mrs. XXXX XXXX who told me that WaterStone Mortgage has a strenuous process for FHA loans to be reviewed under and that the information that I was suggesting was totally false. I was also told at the time that the loan was purchased on the second market by XXXX XXXX and if I had further concerns about the validity of the loan, to contact them. Mrs. XXXX firmly stated that the problem was for WaterStone Mortage to resolve. I have pursued XXXX XXXX and have spoken to senior management regarding this serious allegation. They emphatically state that since WaterStone was the company that originated the loan and the supposed fraud took place at the origination of the FHA loan, it is solely the responsibility of WaterStone Mortgage to investigated the fraudulence, since it occurred under their governance. The facts are as such ; the entire comparison set of dwellings used to support the FHA funding are completely false. If one carefully examines the appraisal in question, the dwellings used for comparison are of an entirely different construction structure that that of the home that the FHA funded through XXXX Mortgage. The home located at XXXX XXXX XXXX XXXX, Iowa is categorically a SPLIT - FOYER classification of dwelling when illegally compared to single and two story homes commanding an entirely different price set than a split - foyer property. The financial loss here is quite significant. In the year of funding the property ( 2019 ) the entire Iowa county of XXXX home sales, clearly shows dwellings that have closed escrow in the range of {$100000.00} to low to mid {$200000.00} range when this dwelling was funded for {$340000.00} resulting from WaterStone Mortgage and their negligence, by clearly overlooking this enormous error. There could be no defense on the part of WaterStone Mortgage other than to admit the lack of oversight on the part of WaterStone Mortgage solely. Why would XXXX XXXX be at fault, when the loan origination took place solely by WaterStone Mortgage. Why would the fault of the federal crime be viewed anything other than neglect? Simply, the laws for an FHA certified appraisal are the compliance of a comparison study of like for like dwellings, not those of a completely different construction, as is shown in my appraisal that WaterStone Mortgage gave their blessings to and wrote-off on to be submitted to the FHA for federal government funding. The aforementioned dwelling has been on the real estate market in XXXX, Iowa for 18 months with not one valid offer. The home is so upside - down in value, I simply can not even sell the property for what the home was originally funded for by the FHA with the approval of WaterStone Mortgage. It comes to the basic underwriting of the federal loan which WaterStone Mortgage failed miserably and is in non-compliance legally. They also mentioned that there might be a small issue with the rental reported by someone that was supposed to have cleaned the unit but it was probably okay now. When my girlfriend and I entered the unit we heard running water immediately. we went to find it and found the kitchen flooded by water pouring from a broken air conditioner in the ceiling and the temperature in the rental was 90 degrees. The water was inches deep on the floor and as we investigated further found the plumbing to be broken as well under the sink. We started taking pictures to try to get relocated by XXXX and noticed there were dirty dishes and bugs in the kitchen sink spilled food and open drinks in the refrigerator and open food containers and more bugs in the cupboard along with a dishwasher full of dirty dishes in a broken dishwasher. the closet contained a mop bucket full of sour dirty mop water and the floors were covered with dust and hair. The bathroom sink didn't run water and the toilet wouldn't flush. We located the bedroom which boasted clean linens and room for 10 guests and found a 3 level bunk bed with no linens and broken safety railing. We immediately contacted the XXXX  and explained the situation that the listing was not as described and not sanitary or safe for use with the flooded floor and no access to clean water and we're told they couldn't rebook us somewhere but would refund our reservation. We contacted the management company who said we figured it had been fixed and then refused to return my messages asking for a refund and letting them know I was leaving immediately because there was no way we could stay there 2 weeks. XXXX XXXX listened to my complaints and asked me to send the picture evidence I did that my girlfriend and I left where we rented another place on her credit card to stay since my money was tied up in this unoccupiable rental. as I waited for my refund and it never came I contacted my credit card company and filed a dispute on XXXX XXXX they came back shortly with a denial because they said the booking was not refundable I asked for the information they reviewed to make their decision and have yet to receive that from them. I believe this property management company knew of the condition of this rental when they took my money and allowed me to rent it anyways in order to keep my money and scam me and my credit card company. I only moved my furniture because the water was flooding the kitchen, living/dining area, hallway and 2 of the 4 bedrooms, plus there was the broken window lock. We called three more times over the next month, leaving messages, but heard nothing back. We wanted to have a professional plumber fix the issue but our contract with XXXX stated that only their personnel could perform service in on the item and its components or our warranty would be voided. After months of dealing with this situation we began to notice the quality of our water declining. Evidence of hard water residue was in our bathtubs and sinks. We called againXX/XX/XXXX to request a service appointment and heard nothing back. Months later, XXXX sent a text with a service check reminder and we called them right away. Our appointment was confirmed for XX/XX/XXXX. When they called me days before the appointment I was informed that they would service our unit, for a charge of {$250.00}. I explained that according to our warranty, that the first year of service was free. They informed me that the year had past but I explained that we never received the service as requested during the first year. It took a bit of back and forth but after checking their records they saw I was correct and that they would come out at no charge. The appointment never happened. The day before our appointment I was contacted by XXXX who said their service guy got into an accident and could n't make it. I completely understood and we rescheduled for the next week. The day before that appointment I was called by a different employee of XXXX with the same story that their service guy just got into an accident. I clearly realized that they were lying and had no plans to service my unit. I began researching the company because the whole thing seemed suspicious to me. During my investigation I found that the water treatment specialist, XXXX XXXX, who sold us our unit was using a contractor 's license number ( CA # XXXX ) that was not registered to him. I found no evidence that he is actually licensed. That was the first count of fraud. The second was our contract of credit for XXXX XXXX was never signed by us. We only signed the contract for the water system, not for the revolving credit, which was opened without our consent.
